LB194, introduced by Sen. Steve Halloran of Hastings, would prohibit any state or political subdivision employee from enforcing any federal law regulating a firearm, firearm accessory or ammunition unless the measure also is codified in state law.

An individual in violation of the bill’s provisions would be subject to a fine of up to $3,000 for a first offense and a Class I misdemeanor for second or subsequent offenses. A political subdivision that adopts an ordinance in violation of the bill would be ineligible to receive state funds for one fiscal year.

Phoenix police are investigating a deadly shooting that happened Thursday night in what could be a case of self-defense.

Just after 7 p.m., officers on patrol near downtown Phoenix heard shots being fired in the area of 11th Avenue and Jefferson Street. Moments later, officers saw a man running toward them from the same area. After detaining him, police soon found another man nearby on Madison Street suffering from multiple gunshot wounds. He was taken to an area hospital, where he later died.

Investigators learned it started as an argument involving several people, with witnesses telling police the shooting was self-defense. The man officers originally detained was not arrested.

On January 27, the Haines City Police Department was dispatched to a home burglary after the homeowner and his girlfriend found two strangers in their kitchen.

Fearing for his life, police said the homeowner pulled out a gun and fired five rounds toward the strangers. Seconds later, he and his girlfriend got back in their vehicle and called 911. Police confirmed the homeowner has a concealed weapon license.

Once officers got to the scene, they started searching for the suspected burglars. They found shell casings and a blood trail inside the home, which led a K9 outside. Shortly after, police found one of the suspects down on the ground in a nearby park.

Given America’s epidemic of gun violence, perhaps we should test, license and tax owners of weapons and the weapons themselves. As the Supreme Court in the Heller case noted in passing, the right to arms “is not unlimited and does not preclude the existence of certain longstanding prohibitions” such as those forbidding “the possession of firearms by felons and the mentally ill” or restrictions on “the carrying of dangerous and unusual weapons.”

Two bills that would allow educators within Mississippi’s schools to be armed in the classroom have survived the committee deadline.

In an attempt to have workers within educational facilities armed and thoroughly trained, House Bill 532 and Senate Bill 2079 would establish the Mississippi School Guardian Training Program. The program would create an opportunity for teachers to be trained to carry firearms while in school buildings under the guidance of the Mississippi Department of Homeland Security.

Civil rights attorneys have filed a lawsuit against the City of Minneapolis and an officer over the death of 22-year-old Amir Locke, who was shot and killed during a no-knock search warrant executed last year.

Locke wasn't named in the search warrant, which was executed at apartment 701 at the Bolero Flats in downtown Minneapolis on Feb. 2, 2022. 

Citing "insufficient admissible evidence," the Hennepin County Attorney's Office and Office of Attorney General Keith Ellison declined to file criminal charges against officer Mark Hanneman — who fired the shots that killed Locke — as well as other officers involved in the search warrant.

On February 9th, the Senate Law and Justice Committee will hold a public hearing for Senate Bill 5232, the companion to House Bill 1144, which imposes a firearm permit requirement, a 10-day waiting period scheme, and allows indefinite delays on firearm transfers. The committee originally scheduled the bill for February 2nd, but did not hear it. NRA members and Second Amendment supporters are encouraged to oppose SB 5232 by noting their position for the legislative record and with in-person, remote, or written testimony. The only thing that stops bad guys with evil in their hearts is a good guy (or gal) with a gun. That concept is well-known and hearing it burns gun-haters like holy water thrown on a someone who’s possessed. Tell that to a gun control advocate and watch them squirm. So intense is their hatred of guns and armed self-defense that they’re happy to aid and abet criminals as long it means keeping good people defenseless against violent crime.

So it shouldn’t come as a shock to anyone that California Governor Gavin Newsom’s answer to the recent murder sprees in the Golden State is to disarm more good guys. Here we go again.

On Monday, February 6, the New Mexico Senate Health & Public Affairs Committee will hold a public hearing on Senate Bill 171 by Sen. Bill Soules (D-Las Cruces), legislation that attempts to supersede federal law and make it a FELONY to manufacture, sell, transfer, or acquire a firearm sound suppressor and other National Firearms Act items, as well as certain semi-automatic pistols. Please contact members of the Senate Health & Public Affairs Committee and urge them to OPPOSE SB 171. Also, make plans to attend this hearing in-person, on Monday, at 1:30pm, in Room 311 of the State Capitol in Santa Fe, and testify against this misguided proposal.

Crime happens at any hour of the day or night. Two people, a man and a woman, knocked on an apartment door at 10:30 on a Monday morning. We don’t know what the 51-year-old man or the 31-year-old woman said that convinced the homeowner to open his door. Once the 80-year-old resident unlocked the door, the couple forced their way inside his ground-floor apartment. The two younger attackers beat the older man.

An incident in Connecticut is showing how the Second Amendment makes the nation safer by allowing people to defend themselves against criminals.

According to local outlet WVIT-TV, on Thursday, two people wearing black ski masks entered a clothing store in East Hartford around 10:30 p.m.

After a brief struggle, one of the suspects pulled out a firearm and shot the store owner in the back. The owner then produced his own guns and returned fire, striking the suspect several times, according to the report.

Legislation being considered by North Carolina’s lawmakers would end the state’s Jim Crow era pistol purchase permit requirement.

Senate Bill 40, if signed into law, will allow North Carolinians to further exercise their Second Amendment rights and purchase a handgun without first needing a purchase permit issued by the sheriff. Once the purchase permit system is repealed, background checks will be done at the time and point of sale rather than up to five years prior.

A Texas court has ruled that a federal law that bans people with restraining orders due to domestic violence from owning firearms violates the Second Amendment.

The 5th Circuit Court of Appeals on Thursday threw out the Justice Department's bid to uphold the conviction of Zackey Rahimi, a Texas man who was convicted of possessing guns while under a restraining order for assaulting a former girlfriend.

But even where the record is clear, Thomas’ test leads to heinous results given that the “ancestors” in question were often violently racist and misogynistic white men. As the 5th Circuit tacitly acknowledged, “our ancestors” would “never have accepted” disarming domestic abusers because they did not believe domestic violence was a crime.

Ed.: Wow. Nothing in the opinion gets close to anything like that. In fact, the only people arguing in favor of racism was the government.

“Baltimore Police say [a] dispute between neighbors ended in one killed, and a family member arrested,” The Baltimore Sun reported back in October, 2021. “Alejandro Gonzalez of Georgia is charged with first-degree murder for allegedly fatally shooting Travis Ben-Watkins in the 5000 block of Corley Road in Southwest Baltimore on Sept. 4.”

“Gonzalez had retrieved his mother’s handgun that she kept for security on a bookshelf behind the front door and opened fire, shooting Ben-Watkins multiple times,” the report explains. “Gonzalez then got into his car with his girlfriend and two children and they fled the area, the charging documents said.”

A conservative appeals court has thrown out the federal law that prevents alleged domestic abusers from possessing guns, calling the statute “an ‘outlier’ that our ancestors would never have accepted.”

A panel of the U.S. Court of Appeals for the Fifth Circuit handed down a ruling Thursday in United States v. Rahimi that could undermine the government’s ability to keep firearms out of the hands of those with a history of violence.

The Trump-packed appeals court vacated the conviction of one alleged domestic abuser, which could open the door for many more with a similar criminal history to keep their weapons.

Armed security would be allowed in New York houses of worship under changes to the state's concealed carry law proposed by Gov. Kathy Hochul in her $227 billion budget plan.

Hochul's budget proposal released this week includes what were described as "technical" changes to the measure, approved last summer following a U.S. Supreme Court ruling that found the state's century-old concealed carry law was unconstitutional.

The proposed changes make a broad series of clarifications under the law of who can carry guns in public and where those firearms can be carried, according to budget language, addressing multiple concerns that have been raised with the gun law package for the last seven months.

On Monday, AG Campbell filed a brief in the First Circuit Court of Appeals in the matter of Granata v. Campbell. The brief argues that Massachusetts handgun safety regulations, as established through regulations issued by the Attorney General and by state statute, do not violate the Second Amendment of the United States Constitution. These regulations prohibit the commercial sale of handgun models that do not meet minimum safety requirements to protect against accidents like explosion or unintended discharge.

Last month The Florida Supreme Court upheld an element of the state’s firearm preemption law. The court found the court found ‘no merit in Petitioners’ argument,” and its decision is a big legal win for gun rights in Florida; also for those who want public officials held personally accountable for knowingly passing local ordinances that contradict state law.

Today, half of our states have enacted Constitutional Carry, with Georgia becoming number 25 in April 2022.

This year, we will take the push to expand Constitutional Carry to more states. We hope to bring the RTC movement full circle with Florida, but also have plans for Louisiana, Nebraska, North Carolina, North Dakota (improving the current system to include nonresidents) and South Carolina. None of these states will be easy battles, and other states may arise to present opportunities for expansion, so be sure to follow our regular legislative updates to see what you can do to help.

Besides Constitutional Carry, we’ll also be working on other improvements to RTC laws.

By law, veterans who are incapable of overseeing their own bills may be assigned a fiduciary who manages a veteran's financial affairs -- assistance the VA reports to the background check system as a disability that may preclude the veteran from purchasing a firearm.

Bost said VA staff's ability to decide that a veteran who can't manage their bills is a danger to themselves or society is a form of discrimination that he argues may actually hurt a veteran by preventing them from seeking care and benefits from the VA.

Tulsa County Sheriff Vic Regalado has refused to enforce the United States government’s new gun stabilizing brace rule, citing his belief that the rule will be overturned in the courts.

The Department of Justice now requires anyone who owns a stabilizing brace to register the gun accessory with the Bureau of Alcohol, Tobacco, Firearms and Explosives by the end of May or risk felony charges. ATF Director Steven Dettelbach argues stabilizing braces allow users to essentially convert pistols into short-barreled rifles, which are required to be registered with the feds under the National Firearms Act.

A Democratic lawmaker in the Nevada State Assembly plans to file a bill that will raise the age limit to purchase an assault weapon from 18 to 21.

Assembly Majority Leader Sandra Jauregui said she’s carrying the bill, though it hasn’t officially been filed yet. It’s still considered a Bill Draft Request (BDR) and simply reads “Revises provisions governing the prevention of firearm violence” on the Nevada Legislature website.
