In what appears to be a first-of-its-kind ruling in Louisville, a judge determined that a convicted felon can't be prosecuted on a firearms charge because it violates his Second Amendment rights. Jefferson Circuit Court Judge Melissa Logan Bellows ruled Wednesday that it is unconstitutional for prosecutors to move forward with their case against Jecory Lamont Frazier under a state law prohibiting felons from owning a gun because it doesn’t outweigh the Second Amendment right that belongs to “all Americans.”

Last week, Congress approved a package of legislation to fund various government agencies that corrects a longstanding and shameful practice that had been depriving American veterans of their Second Amendment rights since 1998. The development marked the culmination of a decades-long effort by the NRA to ensure that members of the military with service-connected disabilities could collect the benefits they had earned without fear of forfeiting the right to keep and bear arms.

A National Association of Sporting Goods Wholesalers and National Shooting Sports Foundation report released this month found most enthusiasts purchasing a new pistol either want a red-dot optic on the gun or the ability to mount an aftermarket version easily. The strength of the former trend, however, diminished after the pandemic’s heightened self-defense concerns no longer dominated headlines. The study notes the sale of pistols with pre-mounted reflex sights has been declining and “… been performing at a lower level than no red dot since mid-2022.”

 QUOTES TO REMEMBER
To trust arms in the hands of the people at large has, in Europe, been believed...to be an experiment fraught only with danger. Here by a long trial it has been proved to be perfectly harmless...If the government be equitable; if it be reasonable in its exactions; if proper attention be paid to the education of children in knowledge and religion, few men will be disposed to use arms, unless for their amusement, and for the defence of themselves and their country. — Timothy Dwight, Travels in New England and New York [London 1823]
