Assault Weapon Ban Extension Shot Down

FULL TEXT BELOW:

The Senate defeated Tuesday a measure that included an extension of the ban on assault weapons. It also would have immunized the gun industry from lawsuits.

The bill was voted down by Senate Republicans after Democrats succeeded earlier in the day in amending it so that it included extending the ban.

Senate Republican leaders argued against the ban, saying it was ineffective and unnecessary and could cause the House to kill the gunmaker immunity bill.

Tuesday's 90-8 vote against the gun bill virtually ends any chance for gun legislation to make it through Congress this year.

House leaders said last year they did not plan to renew the ban on the manufacture and importation of at least 19 types of common military-style assault weapons.

"Idaho Republican Sen. Larry Craig, the bill's principal sponsor, said the issue 'will not go away.' But he said the bill, as amended, was a 'bad bill.' "

" 'I would not send to this president or any president a bad bill of the kind that was crafted here in the Senate through the amendment process over the last several days,' he said."

"President Bush had promised to back reauthorization, but then he said he did not want the liability bill amended."

"The U.S. Senate, in a surprise about-face on Tuesday, defeated legislation to shield the gun industry from many civil lawsuits after gun control advocates attached language to it extending the 1994 assault weapons ban and the bill's own sponsor repudiated it."

"Bill sponsor Idaho Republican Sen. Larry Craig called the legislation 'dramatically wounded' and urged its defeat. Craig had wanted a clean lawsuit bill that could not get bogged down in Senate procedures or negotiations with the U.S. House of Representatives."

"The 90-8 vote stunned gun control forces, who just a few hours earlier had regarded their own victories on the assault weapons ban and a measure requiring background checks at guns shows as largely symbolic."

National Rifle Association Statement on S. 1805

"In a move to exploit meaningful legislation designed to preserve the firearms industry, gun-ban activists in Congress slipped through 'poison pill' amendments, which would have resulted in draconian restrictions on the rights of law-abiding gun owners. As a result, the National Rifle Association (NRA) withdrew its support for final passage and the 'Protection of Lawful Commerce in Arms Act,' S. 1805 amended was successfully defeated by a margin of 08-90."

"As NRA stated before S. 1805 was debated, this had to be a clean bill or we would not support it. While we will continue to work to save the U.S. firearms industry, we have said from the start that we would not allow this bill to become a vehicle for added restrictions on law-abiding Americans."

"Legislation to stop baseless lawsuits against the law-abiding American firearms industry has the support of the White House, the U.S. House of Representatives, countless conservation, commerce and union groups, and the American people. It is unfortunate that some in Congress are more interested in undermining the rights of law-abiding gun owners than in passing meaningful legislation."

Thank you for helping kill this gun-control laden monster, NRA!

" 'Anti-gunners tried to hijack the train,' quipped CCRKBA Chairman Alan Gottlieb, 'and we hijacked it back.' "

"The Senate's 90-8 final vote to defeat the poisoned bill came after unacceptable amendments were added that would have extended a ban on semi-automatic sport-utility rifles for ten more years, and placed such onerous restrictions on perfectly legal gun shows that many such events would have been literally put out of business. That was simply not acceptable, Gottlieb said."

Senate-Passed Assault Weapons "Ban" Will Do Little to Keep Assault Weapons Off Our Streets, Violence Policy Center (VPC) Warns

"Senate action renewing the current federal assault weapons ban will do little to protect America's police and public from assault weapons, the Violence Policy Center (VPC) warned today. The measure was passed as an amendment to a Senate bill granting America's firearms industry limited immunity from lawsuits."

" 'This bill merely continues the badly flawed 1994 ban, which is a ban in name only,' states Kristen Rand, VPC legislative director." ...

"A bipartisan coalition of United States Senators today rejected NRA extremism and passed important gun safety provisions -- setting up the collapse of efforts to pass a bill that would have given unprecedented legal protection to the most reckless gun dealers in America."

-------
Bi-partisan coalition? Several traitorous Republicans betrayed their constituents and the Constitution and these enemies of freedom claim it was a "bi-partisan coalition?"

And they didn't pass "gun safety provisions," they voted to attach unconstitutional gun control to a popular bill to give themselves a better chance of passage.

" 'The importance of today's vote cannot be overstated. Senators not only rejected the NRA's top legislative priority; they also approved measures that would help ensure public safety,' said Joshua Horwitz, executive director of the Coalition to Stop Gun Violence. ..."

-------
That would be a bit of a misleading overstatement. The Senate rejected unconstitutional gun control that would have been attached to the liability bill thanks to a few turncoat Republicans. They certainly did not reject the NRA's top legislative priority, and the cloture vote to proceed to S.1805 proves it.

"Today the Children's Defense Fund (CDF) applauded a victory for children when the U.S. Senate broke the strangle-hold of the gun industry and the National Rifle Association by passing important gun safety amendments and rejecting a bill that would have given immunity to the gun industry and its trade associations. The common sense safety measures passed included an extension of the assault weapons ban, a requirement for background checks before the sale or transfer of weapons at gun shows, and a requirement that gun manufacturers include childproof locks when selling handguns." ...

-------
How about setting a good example "for the children" by telling the truth? These amendments weren't passed. The Senate approved attaching them to S.1805, but the pro-gun forces defeated the bill rather than see it befouled by gun control.

NOTE: Dr. Lott wrote this column prior to the death of S.1805. However it still contains good information that reinforces the wrong-mindedness of suing the gun industry for the misdeeds of others and extending the "assault" weapons ban.

-------
"Too often the debate misleads people about the guns being banned. Sen. John Kerry, the obvious Democratic presidential nominee, supports extending the ban because he claims, 'When I go out there and hunt, I'm going out there with a 12-gauge shotgun, not an assault weapon.' Yet, the ban has nothing to do with shooting birds with machine guns. The guns' names or cosmetic features make them no less well suited for hunting."

"The guns have always been around, but the real threat to officials is the public's awakening to the fact that our liberties are being eroded, our institutions are dissed, and that we elect to respond with due process and follow-through. Knowing this, officials acted quickly to stub out Codrea's announced position like a cigarette butt, which they also crush in San Francisco. Picture it as a sort of rudeness that depends entirely on everybody elses refusal to be rude. They have an advantage if everybody else plays by the rules and they don't."

"But the officers were cool, Codrea was cool. But the response itself was uncool. Nothing went down, except Mr. Codrea's civil rights and a little bit of his personal dignity, through the weapon of choice of bureaucrats: intimidation. What they fail to understand here is something Codrea and Liberty nuts understand all too well: that Gays have suffered intimidation for so very long, they should be the very last people to use intimidation as a weapon. What are we to think of the Gays who won't speak out against intimidation?"

Read carefully. This is the approach the Democrats are taking on gun control in 2004.

"As Democrats have learned the hard way, silence is not golden on gun issues, because most voters will assume by default that they want to take even law-abiding citizens' guns away. Instead, as the DLC, Americans for Gun Safety and others have argued, Democrats should engage the gun debate by supporting gun rights, tough enforcement of existing laws, and sensible new gun safety measures."

NOTE: While the article was written prior to the death of S.1805, it does point out an interesting shift in strategy on the part of the Democrats when it comes to gun control.

-------
"The Democrats' willingness to press for gun restrictions marks a strategic shift for the party, which until recently had tiptoed quietly around the issue since some strategists concluded it contributed to Al Gore's election loss in 2000."

"Gore's platform in the 2000 race included support for new federal controls, such as mandatory child safety locks and the licensing of all new handgun owners."

"But even as they step gingerly back into the debate, Democrats are taking a more centrist tack that stresses support for the Second Amendment along with 'sensible' gun control measures."

"The first anti-gun MMM in 2000 attempted to redirect the focus of Mother’s Day from flowers and card giving to the gun deaths of children. The 2004 event continues this focus as its press release reminds us, '[W]ith memories of the horrible events at Columbine High School…people gathered [in 2000] on the Mall in Washington D.C. to demand saner gun policies.' The release quotes Mary Leigh Blek, the 'president emeritus' of MMM, as saying that almost 14,000 children 'have died from gun violence' since 'our last march.' " ...

"To begin with, Blek is probably referring to the 2000 MMM event. (In 2001, only about 100 people participated and the event is now virtually ignored.)" ...

"The definitive source for data on injury-death in America, including gun deaths, is the Centers For Disease Control (CDC)." ...

"During 2001, the CDC reported a total of 157,078 injury-deaths. On their interactive website, if you click 'Firearm' under 'Cause of Injury,' the figure becomes 29,573. For deaths in children, click on <1 as the lowest in the age range and 17 as the highest. Also select the 'No Age-Adjusting Requested' option. The figure becomes 1,433. Multiplied by four, this is 5,732 or roughly 40 percent of what MMM asserts."
