MI: School gun restrictions challenged in Michigan Supreme Court

Lawyers for gun owners urged the Michigan Supreme Court on Wednesday to stop schools from banning the open carry of guns by visitors, a controversy that will test the ability of school boards to set their own safety policies.
The Ann Arbor and Clio districts have adopted sweeping anti-weapon policies, despite a state law that allows certain licensed gun owners to openly carry a pistol on public school property.
"School districts do not have the ability to make law," said Dean Greenblatt, an attorney representing a Clio-area man who would like to openly carry his gun when he visits his daughter's school. |

Two local teens are heading to Colorado to compete in the Junior Olympic Shooting Championships.
They're the first ever shooters from the Demmer Center at Michigan State University to qualify for the Junior Olympics.
Coaches say they beat out almost 2,000 other competitors to get to this point.
"They are the cream of the crop when it comes to their ability to not just shoot, it's they want to learn. That's what this sport's all about," says USA Level 1 Shooting Coach, Gary Smith.
Lillian Warren and Soraya Nevin are teenagers that will soon be shooting for gold.
The girls will head to Colorado in a few weeks to compete for a National position on the Junior Olympic Team.

One of the founding principles of our nation is the rule of law. Our elected legislature has been tasked with creating the laws that we must all follow. In the case of Ann Arbor Public Schools v. MGO, AAPS would have you believe that they have the ability to prohibit a person who otherwise has a lawful purpose on their premises simply because the person is carrying a firearm. Unfortunately for AAPS, the law says otherwise.
At (Wednesday's) Supreme Court hearing, Chief Justice Markman correctly described the exemption that would allow a person with a Concealed Pistol License to openly carry a firearm on school property. |

In every sport, it’s nice to be recognized when you accomplish something so great. There are some athletes in the U.P. who need to fight for that publicity.
Their accomplishments, though astounding, seem to go unnoticed. Katherine Erickson and Sydney Smith are the best in the state at what they do. They both shoot air rifle and .22 for the American Legion, as well as 4–H. They are both first and second place in the state of Michigan in both divisions. The problem is very few people notice.
“It’s a lot harder of a sport to deal with because the football team–they can announce their win, everyone goes to their games, where for shooting sports, nobody really knows about it, or at least they don’t want to talk about it,” said Erickson. |

Marsy’s Law is well-intended: any sensible person cares about victims of crime. However, the unintended consequences of this proposed Constitutional Amendment are bad news for those who might lawfully use force to defend themselves.
It is not uncommon for law-abiding defenders who use force to defend themselves, often with a firearm, to end up criminally charged even though they were justified in their use of force. This is because “Self-Defense” (known as “Justification” in the legal world) is an “affirmative defense” that first must be demonstrated by the defender before the State is burdened with having to disprove the defense beyond a reasonable doubt. |

Recent violence in schools, the death of innocents at the hands of murderous teens and young adults, has once again induced statists to enlist the gullible and beguiled in mass movements aimed at overthrowing gun ownership in America and even in calling for outright repeal of the Second Amendment.
Writing in the New York Times, columnist Bret Stephens has repeatedly called for the repeal of the Second Amendment, most recently on February 16, 2018 in the wake of the shootings at Marjory Stoneman Douglas High School in Miami, Florida. In that column, he referenced his earlier call for repeal following the terrorist shooting in Las Vegas. |

Next week, the gun control fight in Trenton moves to the Senate, and NRA members need to make their voice heard loudly.
A package of seven bills are scheduled to be heard in the Senate Law and Public Safety committee on Monday, April 16 at 10:30 a.m. Six of these bills were passed in the Assembly on March 26. When these bills were adopted in an Assembly Committee, gun owners made a strong showing of opposition, and it is essential that happens again. |

Actress and comedienne Amy Schumer exclaimed that the National Rifle Association and the politicians who work with it are “digging the graves” of their own supporters as she headlined the Los Angels “March for Our Lives” on Saturday.
Schumer unleashed a wave of hate and invective against anyone who disagrees with her strict anti-Second Amendment position calling those who support the Constitution a bunch of child murderers and insisting that politicians who work with the NRA think campaign donations are more important than the lives of children. |

The 2nd Amendment doesn’t grant the right to have a gun. Rather, it does two things: It guarantees the preexisting right of the people to “keep and bear arms,” as well as the preexisting rights of the states to keep their militias, as in colonial times. Therefore, the right of the “people to keep and bear arms” also has double protection.
First, Congress was granted no general power of gun control. Second, the 2nd Amendment guarantees and codifies the preexisting right of Americans to “keep and bear arms.”
In D.C. v. Heller, 2008, Heller admittedly conceded that the 2nd Amendment preexisting right, like the First Amendment preexisting right of free speech, was not unlimited. |

You might need an assault rifle for self-defense, but that would be defense against your own fantasies; you won’t be attacked by a horde of lawless intruders. Otherwise, it’s more likely that someone in your family will commit suicide with it, kill someone accidentally, or, in the case of Sandy Hook Elementary, kill a whole classroom of first-graders. Did anyone ever imagine that a retired justice of the U.S. Supreme Court would one day advocate for the repeal of one of the 10 provisions in the Bill of Rights to the U.S. Constitution?
Yet in the wake of shootings and deaths at Marjory Stoneman Douglas High School in February, it has come to that: After students and others protested throughout the nation to demand restrictions on firearms, retired Justice John Paul Stevens wrote that protesters should go further and seek to repeal the Second Amendment, which protects the right to bear arms. |

Annual operations to curb overabundant white-tailed deer at several national parks in Maryland and Washington, D.C. has netted more than 14,000 pounds of venison.
WTOP-FM reported Monday that the deer culling took place at Rock Creek Park in the district as well as Antietam National Battle Field, Catoctin Mountain Park and Monocacy National Battlefield in Maryland. |

Mayor Bob Buckhorn announced Thursday he is seeking to shed companies that manufacture weapons or ammunition from the city's nearly $1 billion employee pension portfolio.
The request will be made formally at a Tuesday meeting of the pension board. It comes after a staff review Buckhorn ordered found that these manufacturers account for about $300,000 of Tampa's approximately $800 million general employees retirement fund, said mayor's spokeswoman Ashley Bauman. |

The National Rifle Association Institute for Legislative Action (NRA-ILA) announced its support on Thursday for a lawsuit filed in the United States District Court for the District of Maryland that challenges the state’s restrictions on carrying a handgun outside the home.
“Denying the majority of law-abiding citizens the right to carry a firearm outside of the home is unconstitutional,” said Chris W. Cox, executive director, NRA-ILA. “The government cannot require citizens to prove a special need in order to exercise their fundamental rights.” |

This is what the Second Amendment says: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” There are a lot of poorly informed folks who think that we should ignore the first 13 words of the amendment and pay attention to only the last 14 words. They would have us believe that the framers intended those 13 words to have no meaning, a legal nullity, without meaning and purpose. They imagine it to read: “To ensure the freedom of individuals against the government, the right of the people to keep and bear arms shall not be infringed.” That’s not the Second Amendment. |

As a high school senior in Carlsbad, N.M., who supports gun rights, I am disgusted by how these students and their adult handlers are trying to define my generation. My generation is not anti-Second Amendment. My generation does not agree with retired Justice John Paul Stevens that the Second Amendment should be repealed.
In fact, millennials are more pro-gun than our parents are. It’s time the media starts hearing from the millions of young Americans who respect the Constitution and recognize that the Second Amendment is fundamental to our protection and safety, as both individuals, and as a nation. |

Because more guns equals less violence, according to some. Sure, that’s been disproven (more guns lead to more homicide), but don’t tell that to any NRA member.
In February, President Trump proposed solving the mass shooting problem currently plaguing our country by arming “gun adept” teachers who have “military or special training experience.” His reasoning seems to be that if a possible school shooter knew that any given teacher may have secret gunslinger skills, he or she would think twice before opening fire. |
