The majority of justices found that such magazines aren’t “arms,” instead viewing them as a modifier or an attachment to a weapon.

The Washington state Supreme Court has upheld a state law that bans the sale or transfer of gun ammunition magazines that hold more than 10 rounds.

In a 7-2 ruling issued Thursday, the court found that the law does not violate the state or federal constitutional right to bear arms. The court found that the magazines are not classified as arms, and that the right to purchase the magazines is not “an ancillary right necessary to the realization of the core right to possess a firearm in self-defense.”

A recent controversy over a billboard in Oakland, California, has brought to light the city’s troubling firearm and ammunition advertising restrictions. The billboard advertised Turkish firearm manufacturer Canik’s Mete MC9 pistol.

Local media reported that many Oakland residents expressed “shock and outrage” over the billboard, which featured a photo of the handgun with the innocuous message: “Mete MC9 Canik Comes to California.” The billboard promoted the pistol’s introduction to the California market, as the Mete MC9 is compliant with California’s strict gun laws and was earlier this year added by the California Department of Justice to its roster of handguns approved for sale in the state.

At a Jacksonville BBQ restaurant on Friday, Gov. Ron DeSantis put Jacksonville’s just-terminated illegal gun registry on a spit.

“Having a gun registry is unlawful and it is a violation of people’s Second Amendment rights; there needs to be consequences for it,” DeSantis said, regarding the list of people carrying guns into government buildings maintained by Mayor Donna Deegan’s administration from July 2023 until just a few weeks ago.

“And I was surprised to see that that would happen, but our laws in Florida are very clear, our Constitution is very clear. Doing these secret gun registries is completely unacceptable,” DeSantis added.

A jury was unable to reach a unanimous verdict in the murder trial of David Grejtak, leading to his release.

Grejtak, 56, was accused of fatally shooting his neighbor, Lydia Morales, 44, at the Forest Ridge Apartments on Chambers Road on September 12, 2023.

The two reportedly had an ongoing dispute that escalated into violence. Grejtak claimed he acted in self-defense. Morales was transported to a hospital, where she later died.

We are happy to learn from the office of state Rep. Joe Hamm, R-Hepburn Township, that the legislator recently attended our region’s National Rifle Association banquet in Hughesville.

The state representative discussed his efforts in the legislature to secure concealed-carry rights in Pennsylvania and to prevent municipalities from overstepping their authority and attempting unconstitutional limits on the Second Amendment.

“I will always strongly support our right to own firearms,” Hamm said in an email newsletter detailing his attendance at the banquet.

His efforts on “Preemption,” or legislation curtailing efforts by municipal governments to place undue and unconstitutional burdens on gun owners, deserve particular praise.

The Washington Supreme Court on Thursday upheld the state’s ban on the sale of gun ammunition magazines that hold more than 10 rounds.

The law, passed in 2022, faced a challenge from a Kelso gun shop that argued the ban on selling the magazines violates the state constitution, which protects “the right of the individual citizen to bear arms in defense of himself, or the state.”

Gator’s Custom Guns also said the law ran afoul of the Second Amendment of the U.S. Constitution.

In a 7-2 ruling, state Supreme Court justices disagreed.

Washington state successfully defended its ban on the sale and purchase of large-capacity gun magazines after the state Supreme Court ruled Thursday that the law doesn’t violate the right to bear arms.

Critical to the Supreme Court’s decision was the finding that large-capacity magazines — those that can hold more than 10 rounds of ammunition — are not “arms” within either the state or United States constitutional provision.

“[Large-capacity magazines] are not weapons — they are attachments to weapons, or accessories,” Associate Chief Justice Charles Johnson wrote on behalf of the majority.

Mac Marquette, 25, is charged with murder in the fatal shooting of Steve Perkins shortly before 2 a.m. in September 2023. Marquette and two other officers were accompanying a tow-truck driver to repossess Perkins’ pickup truck at his home in Decatur. When Perkins emerged from his house with a gun, Marquette fired 18 bullets less than two seconds after identifying himself as law enforcement, according to body camera footage.

Court documents filed on Thursday said the judge erroneously ruled against Marquette based on his assessment that Marquette didn’t sufficiently prove he had a right to be on Perkins’ property. Alabama allows judges to determine if someone acted in self defense before a case goes to trial.

By a 7-2 vote, the totally-left-of-center Washington state Supreme Court has ruled that so-called large-capacity magazines” (LCMs) are not “arms” protected by the constitution, and therefore the state ban on such magazines is legal.

The case is known as State v. Gator’s Custom Guns.

The ruling was cheered by anti-gunners, but on the side of the Second Amendment and Article I, Section 24 of the State Constitution, there is anger and frustration. Comments by readers at the Seattle Times and Seattle’s KOMO—the local ABC affiliate—are sometimes blistering.

The Supreme Court has now relisted Snope v. Brown—the Maryland “assault weapons” ban challenge—13 times. That’s not just some bureaucratic delay. It’s a signal. It means the nine justices are circling this case, taking it seriously, and possibly gearing up to act.

In fact, as Mark Smith of the Four Boxes Diner points out, the Dobbs case that overturned Roe v. Wade was relisted 12 times before the Court granted review. Snope just passed that.

For pro-gun Americans who’ve had enough of being treated like second-class citizens when it comes to constitutional rights, this might be the moment we’ve been waiting for.

“Trump administration says machine guns aren’t protected by Second Amendment,” The Washington Times reported two weeks ago.

“Machine guns are not the kind of arms protected by the Second Amendment,” Assistant United States Attorney Jennifer Case argued in the Fifth Circuit Court of Appeals. “Machine guns are not typically possessed by law-abiding citizens for lawful purposes. Instead, they are uniformly restricted, highly lethal and well suited to criminal purposes.”

A U.S. appeals court on Friday upheld a federal law preventing felons from possessing firearms, rejecting a challenge by a California man who said the ban should not apply to non-violent felons like himself.

The 9th U.S. Circuit Court of Appeals in Pasadena, California said the government showed the "permanent and categorical disarmament" of felons was consistent with the country's historical tradition of firearms regulation, and with the 2nd Amendment of the U.S. Constitution.

Texas House lawmakers debated gun rights and voter protections Wednesday afternoon related to a bill that would allow election judges to carry a weapon inside a polling place at any time.

House Bill 1128, by Rep. Carrie Isaac, R-Dripping Springs, allows an election judge, early voting clerk, or deputy early voting clerk who is serving as an election judge to carry a concealed handgun at an early voting or Election Day polling place as a means of protection for themselves and others. The bill passed 89 to 53 in the House and will now go to the Senate for approval.

California Attorney General Rob Bonta today joined 18 attorneys general in filing an amicus brief supporting the constitutionality of New York’s restrictions against carrying firearms in public parks in the case, Christian v. James. In the brief, the attorneys general urge the Second Circuit to uphold the district court’s decision that New York’s prohibition on carrying firearms in public parks does not violate the Second Amendment. The brief argues that the law is in line with a long tradition of constitutionally acceptable regulations designed to meet states’ responsibility to protect their residents from gun violence and intimidation.

William described AB 1078 as “flying through at lightning speed,” with its most recent move sending it from committee to the Assembly Appropriations Committee with barely any opposition. “It’s like they were voting on bottled water,” he said, stunned by how casually lawmakers treated a bill that restricts a constitutional right. Only a few Assembly Members, including Alanis and Lackey, voted against it.

Gun access appeared as a leading issue

After a brief debate, the GOP-led House passed a bill that creates lifetime concealed handgun permits and eases training requirements for some people renewing expired permits with fixed durations.

Democratic Rep. Marcia Morey warned that having renewals safeguards the public, because a lifetime permit wouldn't account for changing circumstances like addiction or mental illnesses.
