A federal judge in Virginia on Wednesday ruled that laws barring federally licensed firearms dealers from selling handguns to 18-to-20-year olds are unconstitutional.
Driving the news: "Because the statutes and regulations in question are not consistent with our Nation’s history and tradition, they, therefore, cannot stand," U.S. District Judge Robert E. Payne wrote in a 71-page opinion. |

A Polo man was found not guilty in the murder of a 37-year-old Oregon man Thursday. The Oregon man man was shot an killed in Rochelle in October of 2020.
Shaw Local Media reports a judge ruled Cody Neuschwanger, 26, acted in self defense when he shot Devin Bailey in the 1100 of 1st Avenue. This is Rochelle’s first homicide case since 2003.
Closing arguments were made Thursday morning at the Ogle County Courthouse. The defense argued that Neuschwanger was trying to defend his mother from an abusive relationship, and that he shot Bailey after he charged at Neuschwanger with a knife. |

On Friday, May 5th, the Vermont House passed H230, a “kitchen-sink” gun control bill that greatly infringes on your Second Amendment rights. This dangerous anti-gun bill violates Vermont citizens’ Second Amendment rights by implementing a slew of anti-gun laws. This bill includes a laundry list of gun control measures, including mandatory 72-hour waiting periods, increased Red Flag laws, and “negligent storage” laws.
This bill now goes to Governor Phil Scott’s desk. NRA members and Second Amendment supporters are urged to contact Gov. Scott and request that he oppose all anti-gun measures. Please contact Gov. The State of New York Office of the Attorney General has issued a letter to the Second Circuit Court of Appeals in an attempt to moot some of the challenges to the infringements on Second Amendment rights. Those challenges are now before the Second Circuit.
When the Supreme Court published the seminal Second Amendment case in Bruen, re-enforcing the Heller opinion from 2008, in 2022, some states rebelled and defied the Supreme Court. One of these was New York. In New York, Governor Hochel, convened a special emergency session to create new law to infringe on the rights protected by the Second Amendment. The new law made it nearly impossible for an ordinary person to carry a firearm for self defense in public. |

A fatal shooting occurred near Harry Reid International Airport in Las Vegas on Wednesday afternoon, involving an individual who had engaged in graffiti activity, attempted to evade the police, and tried to carjack someone. The Las Vegas Metro police provided details of the incident.

A single justice of the U.S. Supreme Court is now weighing whether to block Illinois’ assault weapons ban from being enforced while the case is being heard in the Seventh Circuit Court of Appeals.
Justice Amy Coney Barrett, who hears applications from the Seventh Circuit, could decide on her own whether to issue an emergency injunction or she could refer the question to the full court for consideration.
The case involves both the state’s ban on assault weapons and large capacity magazines as well as a local ordinance in the city of Naperville. |

Donald Trump is back at the top of the news this week after appearing on a CNN town hall. A man who kept a chokehold around the neck of an agitated fellow passenger on a New York City subway, leading to the other rider’s death, turned himself in to authorities Friday on a manslaughter charge that could send him to prison for 15 years.
Manhattan prosecutors announced Thursday they would bring the criminal charge against Daniel Penny, 24, a U.S. Marine Corps veteran, in the May 1 death of 30-year-old Jordan Neely.

A homeowner in Jarrell shot and killed a man who had broken into a house on Thursday, according to the Williamson County sheriff's office.
Investigators identified the man who died as 29-year-old Juan Sanchez-Palafox, according to a sheriff's news release. No one has been charged in the shooting. There was no information about where Sanchez-Palafox was from, said Gracie Perez, a sheriff's spokeswoman. |

Tennessee Gov. Bill Lee, a Republican, is sticking by his plan to call a special legislative session on gun control. Lee had asked lawmakers to pass a bill allowing judges to take away guns from people who the judge thinks pose an imminent threat to themselves or others. Lee shies away from calling his plan a red flag law, which he calls a “toxic political label.”
And two Republicans in a Texas legislative committee broke ranks to advance a bill that would raise the purchase age for semi-automatic rifles from 18 to 21.
“We cannot assume that gun safety is not possible in states led by Republicans,” said Allison Anderman, who tracks state legislation for the Giffords Law Center to Prevent Gun Violence, which favors more restrictions. |

The second phrase is, “the right of the people to keep and bear Arms, shall not be infringed.” Now this is a complete sentence. It could, in fact, stand on its own, without the prefatory clause, meaning, the prefatory clause is irrelevant to the overall meaning of our Second Amendment. It is this second phrase which very clearly enunciates the right of we the people to keep and bear arms (whether certain people today agree with that right, or not). |

Or, perhaps the Miller decision, which was written in 1939, was referring to firearms in common use then (although it did not say “in common use at ‘this’ time”). AR-15s and similar weapons like the AK-47 did not exist when the Miller decision was written 84 years ago. Even in 2008, when the Heller decision was written, AR-15s and similar weapons were not nearly as popular as they have become in recent years. It appears that the phrase “in common use of the time” could be interpreted in different ways. |

“This country needs common sense gun policies,” Fort Worth Mayor Mattie Parker said during an interview on Capital Tonight. “It would simply create parity of how we treat 21 years old in the state. You can’t buy alcohol or tobacco until you’re 21, but you can walk in and buy an AR-15. I don’t think it makes sense. Additionally, I really feel strongly that those of us who do support Second Amendment rights, in order to protect the Second Amendment, you need common sense gun policies.”
