On Monday, the U.S. Court of Appeals for the 9th Circuit ruled that the right to bear arms has historically also included the right to acquire firearms.
The case, Teixeira v. County of Alameda, is based on Alameda County, Calif., zoning rules for incorporated areas...
Plaintiff John Teixeira had contended that the “500-foot rule” was tantamount to a backdoor ban on gun stores.
Writing in the majority opinion, 9th Circuit Judge Diarmuid O’Scannlain emphasized, “Our forefathers recognized that the prohibition of commerce in firearms worked to undermine the right to keep and to bear arms.” |

As of December 2015, nearly 99 percent of names listed on the “mental defective” category within the federal gun background check system were from the Department of Veterans Affairs (VA). Grassley’s amendment requires that before the VA reports names to the Department of Justice for eventual placement on the gun ban list, the VA must first find, by judicial order, that a veteran is a danger to himself, herself, or others – a standard which is not currently employed by the VA. |

I know this column will be wildly unpopular with many readers.
Honestly, I don’t want to write it. I have received all of the emails on this subject that I care to.
However, to do my part as an honest person seeking to use his voice to advance reasonable conversations on important topics, I have to address this issue again.
The lobbyist driven, legislator endorsed gun culture that conservative politics is espousing as the highest expression of liberty has to be stopped before we don’t recognize America anymore.

The state’s highest court said Wednesday that a North Charleston woman legally used deadly force in 2012 when she fatally stabbed her boyfriend at their home, a ruling that helps clarify how South Carolina’s “stand your ground” law applies to domestic violence.
A trial judge in Charleston had dismissed the murder charge against 26-year-old Whitlee Jones, who claimed immunity from prosecution under the S.C. Protection of Persons and Property Act. The law allows people in certain situations to use force when faced with serious injury. |

A federal judge ruled on Tuesday that a key provision of Washington DC’s concealed carry law was unconstitutional, and ordered DC police to stop requiring residents to prove they have a “good reason” to be issued a concealed carry permit.
The plaintiff, Matthew Grace, is a district gun owner and member of The Pink Pistols, a shooting group that “honors diversity and is open to all shooters regardless of sexual orientation,” with dozens of chapters nationwide.
“We teach queers to shoot. Then we teach others that we have done so,” their website states. |

The co-sponsor of the NRA’s upcoming leadership forum routinely attacks African-American youths killed in controversial shootings, and he has more than once smeared the mothers of two deceased Florida teenagers as liars motivated by money in their opposition to Stand Your Ground laws.
On May 20, Donald Trump and other Republican politicians will speak at the National Rifle Association's annual Institute for Legislative Action leadership forum. The event is being held at the NRA’s annual meeting in Louisville, KY, which runs from May 19-22.

A District of Columbia law that requires applicants for concealed carry permits to provide "a good reason" for needing one violates the Second Amendment, a federal judge ruled Tuesday.
Responding to a U.S. Supreme Court decision in 2008 striking down the city's ban on handguns, Washington, D.C., enacted strict new gun control measures last June that banned the open carry of guns in the city and put in place a set of age, criminal and personal history, mental health and physical requirements for people who wished to carry a concealed weapon. |

Mesquite, TX investigators said according to witnesses, an incident that started with a harmless traffic maneuver, ended with a man being shot and killed in self defense this Sunday.
Officers responded to a report of gunfire in the area of Rodeo Center Drive and Military Parkway about 10:15 p.m. where they discovered the body of Armando Macias Jr., 25, who died from apparent gunshot wounds.
When Macias and two family members witnessed a car turning around in their driveway, they began to yell and curse at the people in the vehicle. The driver of the car, who was unfamiliar with the area and mistakenly pulled into the driveway, backed out and drove off. |

Down in the Golden State, KFSN in Fresno reported yesterday that local law enforcement leaders are mounting a strong opposition to a gun control measure being pushed by anti-gun Lt. Gov. Gavin Newsom. This initiative would require anyone buying ammunition to pass a background check, and that retailers report all ammunition sales to the state.
KFSN quoted Fresno County Sheriff Margaret Mims, who observed, “Voters should be concerned about passing any additional gun control laws. These laws will not be obeyed by terrorists, gang members, robbers or home invaders.” |

The Nevada Republican Party made it official, they opposed to Question 1 on the ballot, the “Universal background check.” A delegate and member of Nevadans for State Gun Rights advocated for the inclusion of the resolution, which declares Question 1 to be “A dishonest, deceptive, and unacceptable infringement on the individual right to keep and bear arms.”

According to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), gun store burglaries are on the rise -- a 28 percent increase from 2013 to 2015, with more than 1,100 federally licensed gun dealers victimized and more than 12,000 handguns, shotguns and rifles stolen.
Thieves have been using any means necessary to get their hands on valuable firearms, breaking through walls, ceilings and even using blow torches to try to get to the guns.
In one case, the suspects used a big-rig truck cab to smash through the front of a gun store in Ventura, California last March and steal about 15 guns. |

The civil trial pitting two wounded Milwaukee police officers against a local gun shop was temporarily derailed Wednesday, as the judge in the case dismissed prospective jurors just before a final jury was expected to be picked.
Milwaukee County Circuit Judge John DiMotto told the jurors there was nothing they did to lead to their dismissal and attributed the unusual move to "issues beyond our control."
The case brought by Officer Jose Lopez and former Officer Alejandro Arce against Badger Guns and its owners is now set to begin jury selection anew on Monday.

The Smithfield Town Council, in a divided vote, has opposed pending legislation that would ban concealed weapons in schools except if carried by law enforcement officials.
The legislation has support from 23 school committees, including the Smithfield School Committee, and nine city and town councils as of Monday afternoon.
Councilors were asked on May 3 to consider a resolution, put forth by the nonprofit group Rhode Island Coalition Against Gun Violence, that supports pending General Assembly companion bills, H-7243 and S-2761. The bills seek to “disallow non-law enforcement to carry concealed firearms onto school grounds.” |
