Louisiana, Mississippi, and Utah join Texas in the lawsuit that asserts that the rule change would subject “hundreds of thousands of law-abiding gun owners to presumptions of criminal guilt for all manner of activities relating to the innocuous, statutorily authorized, and constitutionally protected private sale of firearms.”

The lawsuit argues that the ATF’s new restrictions surpass the authority granted to the agency by Congress.

Another day, and another act of breaking the law by the Biden administration.

Texas Attorney General Ken Paxton is leading a multistate coalition including Louisiana, Missouri, and Utah to sue the Bureau of Alcohol, Tobacco, Firearms and Explosives (“ATF”) of the U.S. Department of Justice for unlawfully attempting to abridge Americans’ constitutional right to privately buy and sell firearms.

The ATF’s regulatory restrictions go beyond the authority granted to the agency by Congress. The new Final Rule is arbitrary and capricious and is a flagrant violation of the Second Amendment.

A more recent addition to this list is “ghost gun,” which refers to an unserialized firearm made by someone other than a federal firearm licensee that is therefore said to be “untraceable.” Last week, the U.S. Supreme Court agreed to hear an appeal from the Biden Justice Department that asks the high court to lift a stay on an ATF rule supposedly meant to crack down on “ghost guns.” But the bigger, and oft-ignored, issue in the case is ATF’s attempt to massively expand its authority by reinterpreting the meaning of “firearm” itself.

Mainers will be required to wait at least three days to buy a firearm under a Democratic proposal approved by Gov. Janet Mills over the objections of Second Amendment groups, who plan to sue to block the requirements.

The proposal, which was approved by the Legislature in a party-line vote, sets a 72-hour waiting period for most gun purchases that was sought by gun control advocates in response to the Lewiston mass shooting.

Investigators said the 45-year-old was arriving at his home with his family and got out of his car to move their trash can blocking the driveway.

As his wife was parking the vehicle, the homeowner was approached by a 29-year-old man described to be angry and behaving aggressively, according to HPD.

The two men began physically fighting, the homeowner shot the suspect, and he called the police.

"Apparently they both live on this street. We're trying to figure that out. The homeowner said the male attacked him in his driveway (and) he shot him in self-defense," HPD Lt. Larry Crowson said.

New York City will now provide FDNY emergency medical services (EMS) personnel with body armor and self-defense training every three years after Mayor Eric Adams signed two pieces of legislation Wednesday.

Both sponsored by City Councilman Joseph Borelli (R-South Shore), the pieces of legislation require the FDNY to provide body armor, along with self-defense and de-escalation training every three years to all members working in the EMS bureau.

Indeed, that's not a misprint, parody, or a bad joke (although I wish it were the latter). Powanda was arrested and charged with criminal trespass and burglary, along with other related offenses, for executing the botched raid a little before 2:00 a.m. in February 2023 at Yakaitis' property in Port Carbon, Pennsylvania. The government charged Yakaitis, who is in his mid-70s, with using a firearm without a license after he shot Powanda, despite that it appears prosecutors agree Yakaitis justifiably used that same firearm in self-defense.

The Bureau of Alcohol, Tobacco, Firearms and Explosives published the rule on April 10, greatly expanding the reach of background checks in firearms sales. Paxton announced the litigation by Texas, other states and Gun Owners of America (GOA) in a Wednesday afternoon post on X, while Kobach filed a separate suit, with each attorney general saying their state sought to protect Second Amendment-protected activities with its suit.

In Idaho, a sword attack would be met with the lead of bullets fired from several firearms. The Gem State is one of the country's most Second Amendment-friendly states. You can carry a gun, seen or unseen, without a permit. The state does offer an enhanced concealed carry permit if one wants more extensive training that is recognized by other states. In other words, if you want to be protected from being disarmed in different states, get the training and certification from Idaho.

Kansas Attorney General Kris Kobach filed a lawsuit on behalf of 21 states opposing an ATF rule that would prevent law-abiding Americans from privately selling firearms.

“Biden’s latest attempt to strip away the Second Amendment rights of Americans through ATF regulations will make many law-abiding gun owners felons if they sell a firearm or two to family or friends,” Kobach said. “This rule is blatantly unconstitutional. We are suing to defend the Second Amendment rights of all Americans.”

The Alabama House of Representatives passed a bill Tuesday to ban trigger activators, such as “Glock switches.”

HB 36, sponsored by Rep. Phillip Ensler, D-Montgomery, would ban the possession of any part or combination of parts designed or intended to convert a firearm into a machine gun. It would make possession a Class C felony, punishable by up to 10 years in prison.

The bill passed 60-38.

Texas Attorney General Ken Paxton and Kansas Attorney General Kris Kobach announced Wednesday they are leading two separate multi-state lawsuits against a new rule from the Bureau of Alcohol, Tobacco, Firearms and Explosives that would criminalize private firearm sales.

The attorneys general argue the rule, published April 19, is illegal and unconstitutional. They claim it dramatically expands the definition of a firearm dealer and could make hundreds of thousands of law-abiding gun owners presumed guilty of a crime for private sales and trades of firearms.

Twenty-six states sued the Bureau of Alcohol, Tobacco, Firearms and Explosives on Wednesday arguing a new federal rule it’s implementing targets lawful gun owners and is unconstitutional and illegal.

Texas and Kansas led two multi-state coalitions; Florida filed its own lawsuit.

Texas Attorney General Ken Paxton and Kansas Attorney General Kris Kobach announced their multi-state coalitions at a joint press conference in Frisco, Texas, on Wednesday. The announcement was the first time Paxton has held a press conference about official state business since he was impeached last year.

Bravo, to Governor Mills for her act to limit law abiding citizens of their second amendment rights. This so called 72 hr waiting period to protect the masses is just another vailed attempt to chip away at the second amendment rights of the law abiding citizens. I would like the governor to give the statistics of the percentage of people that have purchased a firearm to immediately assault, murder or commit suicide.

What about the citizen that already owns numerous firearms and would like to purchase another firearm on an impulse buy. That same person already has access to firearms, they have committed no crimes but their second amendment right is suspended for 72 hours.

Cases challenging gun and magazine bans, including several lawsuits from Illinois, have been distributed for an upcoming conference of the U.S. Supreme Court.

After Illinois banned more than 170 semi-automatic firearms and magazines over certain capacities in January 2023, federal lawsuits were filed. Appeals of separate preliminary actions against the law were shot down by the Seventh Circuit U.S. Court of Appeals last year. Plaintiffs in February asked the U.S. Supreme Court to intervene.

On Tuesday, the U.S. Supreme Court moved several Illinois cases, and one challenging Maryland’s ban, to conference for May 16, 2024.

Republican Tennessee Rep. Mark Green introduced a bill Wednesday to block the implementation of a new Bureau of Industry and Security (BIS) rule that would impose greater restrictions on firearm exports.

The BIS rule released April 30 would make a number of changes to licensing policies that firearm manufacturers, sellers and trade groups say will harm businesses. Green’s Stop the Bureaucratic Ineptitude Shuttering Respectable and Upstanding Lawful Exporters Act (Stop the BIS RULE Act) bill, co-sponsored by 11 other Republican representatives, prohibits the use of federal funds “to finalize, implement, or enforce” the rule.

NSSF, The Firearm Industry Trade Association, is deeply critical of the Interim Final Rule published today by Commerce Department’s Bureau of Industry and Security (BIS) that cements the supposed 90-day firearm export “pause” into permanent policy and creates additional regulatory burdens.

The Biden administration has demonstrated again their deepening contempt toward the firearm industry. This rule entrenches their “whole of government” attack and is intended to hobble the firearm industry’s ability to compete in the international market under the false pretense of advancing U.S. national security.

An ordinance passed in April in Pima County that requires gun owners to report when their weapons are stolen or lost is being challenged in a new lawsuit.

Under the rule, gun owners must report a missing or stolen firearm within 48 hours. Failing to report a weapon you know or should have known was missing could result in a $1,000 fine. County officials say the move will help keep track of missing guns and fraudulent gun purchases, known as straw sales.

Joe Setyon is a senior communications manager at the Goldwater Institute — the group behind the suit. He says the new ordinance is illegal.

Nearly 15 million people living in or entering the country illegally are on an FBI list prohibiting purchase of firearms.

However, the National Instant Criminal Background Check system isn’t required to let immigration authorities know if one of those 14.8 million is an applicant and in America. Legislation is proposed to change it.

“It is already against the law for an illegal immigrant to purchase a firearm, and this legislation would notify the appropriate authorities when an illegal immigrant tries to break the law,” said U.S. Sen. Thom Tillis, R-N.C., who co-sponsored the bill.
