CA: The Septuagenarian Speaks: A ‘Catch-22’ and Second Amendment rights

I started writing this column seven months ago, while listening to the Senate Judiciary Committee’s U.S. Supreme Court confirmation hearing for Amy Coney Barrett. I focused on Democrat Illinois Senator Durbin questioning her about District of Columbia vs. Heller, the landmark 2008 US Supreme Court decision holding that the Second Amendment protects an individual’s right to keep and bear arms for traditional lawful purposes, such as self-defense within the home. At about the same time a friend told me how she had lost her Second Amendment right. She had been caught up in a Catch-22, a draconian California law that should be changed.

Texas is on the verge of becoming the most-populous state in the nation to allow permit-less carry of handguns, meaning any adult who can legally obtain a gun can take it to town, without any training or certification. It’s the firearms equivalent of abandoning drivers licenses. The governor, Greg Abbott, is a big fan of what gun advocates term “constitutional carry,” and has signaled he’s eager to sign the bill into law.

VA: Glenn Youngkin, GOP nominee for Virginia governor, goes mum on guns and abortion

Like his new tack on Biden’s legitimacy, Youngkin’s post-convention reticence on abortion and guns has the potential to dampen enthusiasm among some conservatives. It could raise doubts, particularly for a first-time candidate with no voting record, about Youngkin’s commitment to those causes, said Philip Van Cleave, president of Virginia Citizens Defense League, which advocates for gun rights.

“I think he should be coming out strongly, speaking about guns and giving exact positions on guns,” Van Cleave said. “That way, you can really stir up the gun owners. If you don’t talk about it, you leave people wondering.”

“These provisions effectively state to all law enforcement agencies and political subdivisions, that to be a law enforcement officer, you must not violate the fundamental principles that undergird the legitimacy of Missouri law in relation to the Second Amendment Preservation Act itself,” Schrimpf explained. “Those who choose to flout the legislature on this issue will become effectively unemployable as Missouri law enforcement officers. It is impossible to overstate the importance of these provisions in the bill, as they provide powerful legal tools that nearly ensure the enforcement of the policy.”

The attacks on the National Rifle Association by the Cuomo-James regime are an existential threat to every pro-Second Amendment organization out there. That being said, Wayne LaPierre made serious errors of omission, particularly with regards to the warning signs of what was coming from New York’s state government.

However, we also should not forget the real accomplishments LaPierre can rightly point to, as Dean Weingarten has outlined. Duane Liptak’s observations on NRA staff match with my experiences working there. We have come a long way from the times when the Second Amendment was in doubt in the early 1990s, especially with Texas passing constitutional carry.

A quiet bipartisan effort on gun background checks may have a path to a deal

After years of failed attempts to pass a firearms background check bill, two senators think they have a path to agreement — at least on one key component of a deal.

Sens. Chris Murphy, D-Conn., and John Cornyn, R-Texas, have been quietly negotiating a way to bolster background check rules by making a small but consequential tweak to current law, which they say would close an unintended loophole in the system that has led to preventable mass shootings.

A 38-year-old woman has been cleared of deliberate homicide and had her case dismissed.

MTN News spoke with Rachel Bellesen’s defense attorney about what this means for Bellesen, and those supporting her.

Sanders County prosecutors charged Bellesen with deliberate homicide after she shot and killed her ex-husband last October.

She was arrested in Hot Springs after calling the police to tell them what happened.

She told officers her former husband tried to rape her that afternoon while they were meeting to discuss their son.

The share of Americans who favor stricter gun laws has declined since September 2019. Past data from the Pew Research Center shows 6 in 10 Americans wanted to get tougher on gun control in 2019. In March 2017, past data also shows, 52% of adults supported stricter gun laws, 30% said they were about right, and 18% said they should be less strict.

“Blacks, Hispanics, and Asians are more likely to be Democrat, so they're more likely to be liberals,” said Eugene Volokh, Professor of Law at UCLA School of Law. “Generally speaking, it's liberals and Democrats that most support gun control and conservative Republicans most oppose it."

Ohio lawmakers want to be sure when the next pandemic or emergency rolls around, government will not be able to restrict gun rights.

Rep. Scott Wiggam, R-Wayne County, and Sen. Tim Schaffer, R-Lancaster, announced legislation Tuesday that has drawn support from gun-rights groups and would not allow state and local governments from limiting gun rights during emergencies.

"Our legislation is simple and straightforward," Wiggam said. "The bills prevent state or local authorities from restricting legal firearms possession, transportation, carrying, training, concealed handgun license processing, shooting range access and hunting and fishing during a declared emergency."

When it comes to gun ownership, Aqil Qadir knows exactly what he’s talking about.

He’s a former New York police officer, an NRA-certified firearms instructor and heads his own self-defense training company.

But despite taking pride in being able to take people through Tennessee’s handgun carry permit course, he’s not upset to see the classroom requirement eliminated.

“The handgun permit class was never adequate training anyway,” he says. “And anybody who does this for a living will tell you that.”

On Wednesday, the U.S. Senate Judiciary Committee held a confirmation hearing for several Biden administration nominees, including professional gun control activist David Chipman for director of the federal agency that enforces the nation’s gun control laws (commonly referred to as ATF). Chipman’s evasive, contradictory, and dishonest testimony disqualified him from further consideration for the position.

AR-15s are modular, hence the AR 15 Conversion Kits.

Push out the takedown and pivot pins and remove the upper – it contains the barrel and the matching bolt carrier group, the charging handle, and the gas system.

If you’ve zeroed an optic or scope, it comes with the upper, too. Replace the original upper assembly with a different one; push the two pins back into place, and voila! You’ve got a different gun.

Tennessee Gov. Bill Lee signed a bill Wednesday that makes the state a Second Amendment sanctuary.

Senate Bill 1335 prevents any “law, treaty, executive order, rule, or regulation of the United States government” that violates the Tennessee Constitution or the Second Amendment of the U.S. Constitution from being enforced in the state.

That violation would have to be determined by either the Tennessee or U.S. Supreme Court. The stipulation was added during debate of the bill in the Tennessee House, and the Senate concurred.

On Tuesday, Pennsylvania’s effort to join 21 other states with Constitutional Carry officially launched as the House Judiciary Committee voted to report House Bill 659, by Rep. Aaron Bernstine, to the House floor for consideration. This legislation removes the requirement for law-abiding individuals to obtain a concealed handgun permit before being allowed to carry concealed for self-defense.

HB 659 ensures that citizens are able to exercise their right to self-defense without government red tape or delays. The bill does not affect previously issued carry permits and allows citizens who still wish to obtain a permit in order to carry in other states recognizing Pennsylvania permits, to do so.

The Wisconsin Assembly’s Committee on State Affairs on Tuesday heard testimony on a proposal that would stop the federal government from seizing guns in the state and would limit how new federal gun laws could be enforced.

But while the bill has significant support from lawmakers in the Republican-controlled Legislature, it’s seen as unlikely to gain the signature of Democratic Gov. Tony Evers.

Chipman’s nomination has been praised by gun control advocates – he was an ATF special agent for 25 years and currently serves as senior policy adviser to gun violence prevention group Giffords.

WY: Committee revives controversial gun bill in surprise vote

The Joint Agriculture Committee Tuesday revived a controversial gun rights bill on a split-second, unannounced vote moments before the committee adjourned in a move lambasted by critics for its lack of transparency.

The bill, last session’s Senate File 81 – Second Amendment Preservation Act, would prevent agents of the state from enforcing any federal law or regulation that restricts a citizen’s right to carry firearms. A heavily amended version of the legislation passed the Senate by an overwhelming margin in March, but died without a hearing in the House when it failed to meet a key procedural deadline.

Tuesday’s measure passed on a 7-4 vote.
