“Trump administration says machine guns aren’t protected by Second Amendment,” The Washington Times reports. “The Trump administration is taking heat from gun rights advocates after the Justice Department argued in court that machine guns fall outside the scope of firearms guaranteed by the Second Amendment.”

The story quotes Assistant U.S. Attorney Jennifer Case, who, in arguing a brief in the Fifth Circuit Court of Appeals to overturn a lower court ruling, asserted “Machine guns are not the kind of arms protected by the Second Amendment.”

The Second Amendment right to carry a gun applies in places where security isn’t provided by the government, the Fourth Circuit was told by gun rights advocates Wednesday in a case challenging Maryland restrictions.

But, in a second case argued before the same panel of the appeals court, a local Virginia government said that interpretation of the right isn’t supported by the historical record, because US Supreme Court Second Amendment precedent allows gun regulation in places where there isn’t any government security.

Someone charged with a crime under this new law would lose their ability to hunt, carry for self defense or other protected Second Amendment activities. Concerns that were expressed during the first week of the legislative session when the bill was brought before the Senate Judiciary Committee.

Birmingham lawyer James "Jim" Porter, a former president of National Rifle Association and current board member, told 1819 News at the time, "The thought that you would take away a person's constitutional rights of self-defense due to allegations of having committed a felony or misdemeanor will not pass constitutional (US or Alabama) muster."

Fort Dodge police say a shooting that occurred earlier this week was an act of self-defense.

According to authorities, the individual who fired the shot, now considered the victim, acted after another person began swinging a hacksaw at him multiple times on Sunday afternoon. The suspect, identified as 48-year-old Christopher Kockorsky, was struck in the arm and is now facing a charge of assault with a deadly weapon.

A fatal encounter unfolded in Waukegan this past weekend when an attempted robbery turned deadly. Two individuals arrived in the neighborhood late Sunday, intending to purchase a motorcycle they found online, as reported by ABC7 Chicago.

The would-be buyers were directed to a residence on Harrison Avenue to finalize the sale, as per the Chicago Sun-Times. The pair decided to leave after discovering the actual home residents were not involved in the transaction. That's when Adam Hoth, 42, of Grayslake, along with an accomplice, reportedly confronted the buyers with the intent to rob them. A brick was hurled, breaking the window of their vehicle, which escalated the tension into a physical struggle, leading to Hoth's stabbing.

The 17-year-old who Greece police say was shot during an attempted robbery is facing charges.

The teen, a Rochester resident, is charged with the attempted robbery of Henry’s Convenience Store on Denise Road on Tuesday. He’s also charged with a robbery at the same store that happened on April 26.

Police say the store owner shot the suspect in self-defense after the suspect went into the store wearing a mask and pointing a gun. The teen underwent surgery for a gunshot wound to his leg and remains hospitalized under the watch of the Monroe County Sheriff’s Office.

In the early hours of Sunday morning, Las Vegas Metropolitan Police responded to a reported home invasion at a residence in the exclusive Canyon Gate Country Club. Upon arrival, officers discovered 46-year-old Gary Havens suffering from multiple gunshot wounds. He was pronounced dead at the scene.

According to police reports, the incident occurred just after 5 a.m. on the 2300 block of Bay Hill Drive. Preliminary investigations suggest that Havens was an alleged intruder who was fatally shot during the suspected break-in. No other injuries were reported. Homicide detectives are handling the case, and findings will be submitted to the Clark County District Attorney’s Office for a self-defense review.

Deputies in Dorchester County are investigating an apparent home invasion that resulted in the death of a suspected intruder early Wednesday morning.

Around 1 a.m., officers with the Dorchester County Sheriff’s Office responded to reports of an ongoing break-in in the 100 block of Hope Drive, a quiet residential area in Summerville. Upon arrival, deputies discovered a man who had sustained a fatal gunshot wound. He was pronounced dead at the scene.

he North Carolina Court of Appeals has upheld the state law banning felons from possessing guns. A man convicted under the law had argued that recent US Supreme Court decisions made North Carolina’s restrictions unconstitutional.

A Buncombe County jury found Eric James Ducker guilty in August 2023 of possession of a firearm by a felon. He had been convicted in 2009 of a felony charge of attempted fleeing to elude arrest. He also had been convicted in 2018 of misdemeanor violation of a domestic violence protective order.

Florida GOP Chairman Evan Power slammed Jacksonville Mayor Donna Deegan on Wednesday after a State Attorney investigation and subpoenas to Jacksonville leaders revealed that Deegan's office was allegedly keeping an illegal registry of gun owners carrying firearms into city buildings.

“It should be no surprise to anyone that liberal Donna Deegan is now under investigation for trampling the Second Amendment,” Power said. “I join with Florida Attorney General James Uthmeier, former Mayor Lenny Curry, and others in calling out this direct assault on the rights of law-abiding citizens."

The firearms industry’s trade group has taken an early lead over its peers and foes alike in attempting to shape gun policy with the current government.

The National Shooting Sports Foundation (NSSF) spent $1,850,000 on federal lobbying efforts between the first of the year and March 31, according to first-quarter Lobbying Disclosure Act reports. Other gun-rights interests, including the National Rifle Association (NRA), Firearms Policy Coalition (FPC), and Citizens Committee for the Right to Keep and Bear Arms (CCRKBA), spent an additional $626,904 on lobbying over the first quarter. By contrast, Everytown, Giffords, and Brady collectively spent just $400,000 on gun control lobbying over the same period.

Colorado's second-highest court ruled for the first time last week that a domestic violence conviction under a municipal ordinance will bar a person from purchasing a firearm, thanks to a recent revision in federal law.

The question required a three-judge Court of Appeals panel to answer whether a Denver man's local domestic violence charge, while not officially labeled a misdemeanor, nonetheless fell under the category of "misdemeanor crime of domestic violence." The panel believed it did.

On April 30, Sen. Adam Schiff (D-California) introduced the so-called “Assault Weapons Ban of 2025.” Picking up where his predecessor Dianne Feinstein left off, Schiff’s legislation would ban commonly owned semi-automatic firearms, such as the AR-15.

A week earlier, Illinois state Sen. Celina Villanueva, also a Democrat, filed SB2652, the so-called “Responsible Gun Manufacturing Act.” A companion House bill, HB4045 was filed a few days later. These bills would ban the ubiquitous Glock semi-automatic handguns.

Machine guns are atypical weapons not protected by the Second Amendment because a reasonable person would not expect them to be used in militia service, the federal government argued Wednesday before an appeals panel.

The government defended federal statute 18 U.S.C. 992(o), which criminalizes possession of a machine gun, as it sought to uphold a conviction against Jaquan Bridges, who pleaded guilty to the offense after a 2023 shootout with police on a Tennessee interstate highway.

Cleanup crews in the area have recovered over 500 firearms from the ashes, and as one might imagine, those guns have seen better days. Reports state that most of the rifles and handguns found in the debris appear heavily damaged, citing burnt away stocks and other furniture, along with metal receivers and parts cooked to a copper colored finish. LAPD officials have not commented on how many of the recovered firearms, if any, remain functional.

“Despite the condition of these recovered weapons, the Department remains committed to ensuring that these items are properly processed, identified, and, when appropriate, returned to their rightful owners,” says Hamilton.

In a move that’s raising serious alarms among gun owners and defenders of the Second Amendment, the Connecticut House of Representatives passed a controversial bill Wednesday that could dramatically expand lawsuits against the firearms industry and make it harder for residents to get pistol permits.

House Bill 7042 passed on a 100–46 vote, mostly along party lines. Five Republicans joined Democrats in support, while five moderate Democrats broke ranks and voted no. The bill now moves to the state Senate for consideration.

The Fourth Circuit heard arguments on the constitutionality of gun control laws in Maryland and Virginia as judges nationwide continue to grapple with a landmark ruling from the U.S. Supreme Court that broadly expanded the right to bear arms in public.

Virginia gun owners argued Wednesday that a Fairfax County ban on firearms in public parks and near permitted gatherings was overly broad. They leaned on the Supreme Court’s 2022 decision in New York State Rifle & Pistol Association Inc. v. Bruen, which overturned New York’s concealed carry law on the basis that gun control must be rooted in the “historical tradition of firearm regulation.”

Republican Governor Bill Lee officially made it harder to sue gun makers in the Volunteer State this week.

On Monday, he signed SB1360 into law after it passed the House by a vote of 72 to 20 and the Senate 26 to 6. That bill explicitly forbids liability lawsuits against industry members where there isn’t a viable claim the company’s actions directly caused the claimed harms. It also requires anyone who tries to enforce an out-of-state judgment against a Tennessee company based on claims the state doesn’t allow to pay the company three times the judgment, as well as refund its legal fees.
