Will Supreme Court Incorporate Second Amendment?

... "An opinion piece by Will Haun at National Review Online speculates hopefully:"

"Depending on what the Supreme Court does, it could make originalism ... the accepted standard for interpreting the Bill of Rights, rather than the whims of a handful of justices."

"Similar hope is offered in a Chicago Tribune editorial, Referring back to the SCOTUS individual rights ruling in the Heller case, we're told:"

"Now that it has recognized a right to gun ownership, it's hard to see any reason the court would not require states to respect that right."

"Let us hope this optimism is fulfilled. Not that a 'good' ruling will mean the battle is over." ...

"Nobody wants to encourage or invite another campus killing spree like the one in 2007 at Virginia Tech University, in which 32 people died and 17 were wounded."

"But does that reasonable concern extend to prohibiting a rally or a flyer that promotes the idea of allowing students to carry firearms on campus in self-defense?"

"You and I may consider the idea of armed undergraduates as either inspired or wacky - but that’s not the First Amendment point, which seems to be lost on at least a few college administrators."

"In Pennsylvania, the Associated Press reported, Community College of Allegheny County officials stopped distribution of promotional material for the group Students for Concealed Carry on Campus ..." ...

"I'm going to echo and add to the observations of my friend and colleague David Codrea who wrote Apathy enables gun control. David mentions Citizens Of America and Utah Gun Owners Alliance."

"He's right. As an activist myself, I can say with personal experience that many Americans who complain about our present social conditions, whatever that complaint may be – banking scandal, voter fraud --- are not even registered to vote. As I mentioned in my last piece, the Left in America will raise the dead to get out the vote: what do Americans do? Nothing, if anything." ...

"Last week, NRA filed a petition for certiorari to the U.S. Supreme Court in the case of NRA v. Chicago. The NRA strongly disagrees with the decision issued by a three-judge panel of the U.S. Court of Appeals for the Seventh Circuit, holding that the Second Amendment does not apply to state and local governments."

"'The Seventh Circuit got it wrong. As the Supreme Court said in last year's landmark Heller decision, the Second Amendment is an individual right that 'belongs to all Americans'. Therefore, we are taking our case to the highest court in the land,' said NRA-ILA Executive Director, Chris W. Cox. 'The Seventh Circuit claimed it was bound by precedent from previous decisions. ...'" ...

"After the Great Kansas Martian Hog Farm Shootout, Identity adherent Morris Wilson lost his leadership position in the KUCM. Immediately after the Oklahoma City bombing, Wilson and the other Kansas Identity folks seemed to disappear like smoke. The 2nd Amendment core of the militia unit soldiered on for a while, but eventually disbanded, still mystified about what Wilson and the 'militant bunch' had really been up to. All of which begs the question: what part did Scott Roeder play in 'the militant bunch?'"

"Let's (go back) to the early months of 1995. The place is an old missle silo outside Wamego in Pottawatomie County, Kansas. The 'militant bunch' is having a meeting. The host is this man. Meet Ronald Griesacker, aka Ronald Laycock." ...

"Wayne Hare's opinion piece (Herald, June 7) is amazing for his apparent ignorance of just what is and has been going on for some time. It is staggering that there are so many gun owners who are uneducated on the all-out assault on the Second Amendment."

"Hare obviously is not a member of the [NRA] or any other gun-rights organization. ... The last time I checked state gun laws ... Vermont was one of the least-restrictive states and (at that time) was the fourth lowest in crime rates."

"Please carefully read the first 13 words of the Second Amendment:"

"'A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.'"

"All persons carrying loaded weapons into our National Parks shall immediately report to the forest ranger for their duty assignment. We must have a well-regulated organization of people bearing arms to help protect innocent visitors from violent crimes and danger."

"I once read an article on the psychology of gun ownership. It said people who own guns firstly see themselves as the good guys who feel a need to protect themselves. Over time that need expands to one's immediate family and then others around them. They start to become paranoid and see danger everywhere."

"They read of a bear spotted in an urban area and assume extremely dangerous bears are everywhere. Of course, other people are suspect and potentially bad guys that everyone needs protection from. Of course, it is the bad guys who are trying to take the guns away from the good guys. Unfortunately, the pro-gun letters I have read all fit in nicely to this idea and I have to laugh when I read these brilliant letters." ...

"The U.S. Customs and Border Protection Agency is proposing a new definition that could be used to eliminate 8 of 10 legal pocketknives in the United States right now, according to activists who are gearing up to fight the plan."

"The federal bureaucracy is accepting comments – written only – that must be received by June 21 before its planned changes could become final, but Doug Ritter of KnifeRights.org, said the implications of the decision would be far-reaching, since many state and federal agencies depend on the agency's definitions to determine what is legal in the United States." ...

... "But the 2008 crime statistics released by the FBI have put a somewhat more rosy face on what is really not a great situation. Crime is down in big cities, but it's up in small towns."

"On the surface, it might look like the urban governments are getting things under control. Actually, that's the furthest thing from the truth. Fact of the matter, urban crime has spread to small town America because the cities are basically not worth the trouble anymore. Anyone with the means to leave many of the most dangerous areas already has left."

Unfortunately, this false assumption has permeated its way into the Utah media's editorials, political cartoons and news stories."

A non-binding resolution supporting one of America's basic rights won the approval of the Kane County Board Tuesday morning.

In a 19-4 vote, with one member voting present, the measure reaffirmed Kane County's support of the Second Amendment. The issue was brought forward by the Illinois Pro 2A group, which is seeking to get similar resolutions approved around the state.

Kane's version takes a more mellow tone compared to Pro 2A's version, which is strongly opposed to any legislation that limits the gun rights of citizens.

 QUOTES TO REMEMBER
Those, who have the command of the arms in a country are masters of the state, and have it in their power to make what revolutions they please. [Thus,] there is no end to observations on the difference between the measures likely to be pursued by a minister backed by a standing army, and those of a court awed by the fear of an armed people. — Aristotle, as quoted by John Trenchard and Water Moyle, An Argument Shewing, That a Standing Army Is Inconsistent with a Free Government, and Absolutely Destructive to the Constitution of the English Monarchy [London, 1697].
