MN: Prosecutors: Driver acted in self-defense in April 2022 fatal Maple Grove shooting

No charges will be filed against a driver who shot and killed another man in April 2022 near Interstate 94 and Maple Grove Parkway in Maple Grove, as prosecutors say the shooter was acting in self-defense.

According to a news release, the Hennepin County Attorney’s Office declined to file charges in the April 17, 2022, shooting that killed 61-year-old William Floyd Haire of Buffalo, Minn.

As 5 EYEWITNESS NEWS previously reported, the shooting occurred just before 3 p.m. near County Road 30 and Garland Lane North. Both vehicles left the scene, and police found Haire in his car on a ramp onto I-94.

The man who police say was shot over the weekend in the parking lot of a Publix in West Ashley is now facing charges.

Ned Robinson, 75, was arrested on Thursday on two counts of pointing and presenting firearms at a person.

Last month, the University of Southern California’s Hollywood, Health & Society Program published “Trigger Warning: Gun Guidelines for Media,” a series of recommendations for the entertainment industry on how it should portray firearms.

Although some of these guidelines offer helpful suggestions, particularly about how the media should deal with the topic of suicide, the publication is aimed largely at motivating Hollywood to stigmatize lawful gun ownership.

The U.S. Court of Appeals for the Third Circuit held this week in Range v. Garland that the government cannot disarm people convicted of minor, nonviolent offenses. In doing so, it handed down perhaps the most significant Second Amendment victory since the Supreme Court’s landmark decision last year, where it held that Americans have a constitutional right to carry handguns in public for self-defense.

The Third Circuit’s decision in Range is noteworthy for several reasons and likely sets up one of the next major Second Amendment battles at the Supreme Court. So, what, exactly, was this case about, and what can we expect next?

Police say they are still investigating to determine what happened, but that initial details provide the belief that there was self-defense.

"Well if you're- it's three in the morning and you're at home and you're sleeping or whatever and somebody breaks into your house, well you have to protect yourself," said the woman whose daughter lives in the neighborhood. "So, I can understand if that was the case and he was protecting himself, yes."

A program at Hunter’s Home on Saturday, June 17, will focus on historic firearms.

Seth Goff, historical interpreter at Hunter’s Home, will present a selection of reproduction and original firearms that were used for self-defense, hunting or recreational shooting during the 1840s and 1850s.

The program will take place from 9-10:30 a.m. and is free with paid admission. For more information, call 918-456-2751.

The Ascension Parish incident started when Serigny allegedly tried to break into a car in the driveway. The car alarm alerted the homeowners, and their security cameras captured Serigny’s erratic behavior, which included eating grass and beating his chest. The homeowner acted decisively when Serigny began to punch holes in the glass door of the house, firing several shots throughout the encounter.

We found major anti-gun bias when we tested the new so-called “artificial intelligence” (AI) writing tool from WordPress, the website builder used by almost half the world’s websites.

--The software at first refused to execute our instruction to write about the benefits of gun ownership.
--It agreed immediately to write about its harms.
--We also saw different responses with the same or similar instructions, known as “prompts.“

WordPress began offering users the free Jetpack AI Assistant two days ago, labeling it an “experimental” AI assistant.

A group of more than 1,000 gathered at the Colorado Capitol to demand the governor ban motor vehicles and buy back the machines that killed nearly 43,000 people around the country last year.

Maybe I got that wrong.

They demanded Gov. Jared Polis ban fast food and buy back the French fries that killed nearly 280,000 obese people. Or was it the couches and large-screen televisions that caused them to not exercise?

Actually, the activists wanted to ban syringes that killed 106,000 people from overdoses. Or was it the bottles of alcohol that killed 104,000 people? The tobacco plants that killed nearly half a million?

On June 6, 2023, an en banc panel of the United States Court of Appeals for the Third Circuit ruled that 18 U.S.C. §922(g)(1), the “felon in possession of a firearm” statute, is unconstitutional as applied to one individual, Bryan Range. While the decision purports to be “a narrow one[,]” the rationale that underpins the decision calls into question whether statutes prohibiting those convicted of crimes punishable by more than one year in prison continue to pass constitutional muster.

As police continue to investigate the case of a man who tracked down his stolen vehicle and got into a fatal shootout with armed occupants, it is likely any criminal or civil case will not have much success, according to a legal expert.

9NEWS obtained police body-camera footage that shows the frustrated car owner telling officers multiple times he will confront thieves himself if police don’t act fast enough.

The footage was recorded Feb. 5 at the Northfield shopping center about 30 minutes before the car owner traced his stolen car with GPS and fatally shot 12-year-old Elias Armstrong, who was among the armed occupants of the vehicle.

After proposing an amendment to the U.S. Constitution to harden federal gun laws, Gov. Gavin Newsom sparred on social media with prominent Republicans who unloaded on his idea.

Newsom, a fierce advocate of gun control, said his proposed 28th Amendment has four prongs: It would institute what he called a "reasonable" waiting period for all gun purchases, ban so-called assault rifles throughout the country, require universal background checks and raise the minimum age to buy a firearm to 21.

The United States has petitioned the Supreme Court to reverse a lower court’s invalidation of a law prohibiting firearms possession by individuals subject to a domestic-violence restraining order. The Fifth Circuit Court of Appeals held the law violated the Second Amendment right to bear arms.

The appeal stems from the conviction of Zackey Rahimi for possession of a firearm in his home. A family court judge in Texas had previously issued a protective order against Rahimi after giving him notice and an opportunity for a hearing. The order included a finding “Rahimi had ‘committed family violence’ and such violence was ‘likely to occur again in the future.'”

A U.S. appeals court ruled Tuesday that nonviolent offenders should not be subject to lifetime gun bans, the latest fallout from a recent Supreme Court decision that instructs judges to look to history and tradition to weigh the constitutionality of gun control laws.

In an 11-4 vote, the 3rd U.S. Circuit Court of Appeals sided with a man who had pleaded guilty to misstating his income to receive about $2,500 in food stamps for his family in 1995.

The constitutional carry bill, HB 131, did not reach its intended outcome. The bill was voluntarily deferred in the Senate due to the committee's attempt to introduce problematic amendments that would have compromised the bill's purpose. While we are disappointed, our fight for constitutional carry is far from over. We will continue working tirelessly to advance this vital legislation.

While President Joe Biden (D) continues to call for “universal” background checks for firearm sales, his son’s attorneys are reportedly preparing to argue that Hunter Biden shouldn’t be charged with lying on a federal background check form because last year’s New York State Pistol & Rifle Association v. In 2021, the City of Rochester commissioned a comprehensive look at 11 years of gun data. City leaders say it’s key in the continued push to get illegal guns off our streets.

The partially redacted report by bipartisan organization Brady shows the city’s overall crime rate is below the national average. But, homicides, especially involving guns, rose between 2019 and 2022 and at a higher rate than many larger cities. The Delaware House of Representatives has approved a proposal to tighten gun control laws by prohibiting firearms in churches, polling stations, in other "safe" locations.

The proposal, sponsored by House Speaker Pete Schwartzkopf, D-Rehoboth Beach, would make possessing a firearm in a school or recreational safe zone a felony. It passed on a 35-4 vote, with Republicans opposing the plan.

Law enforcement officers, constables and other select officials acting in their official capacity within the zone would be exempt under the proposed new rules.

With the consolidated gun ban challenge being briefed and soon heard in the Seventh Circuit U.S. Court of Appeal, an Illinois attorney is asking a federal district judge for partial judgment.

Gov. J.B. Pritzker enacted the ban on more than 170 semi-automatic firearms. The number of banned firearms increases depending on the different types of banned attachments. The law also bans the sale and possession of magazines over certain capacities.
