As we talked about on Dominick In The Morning today, a federal appeals court has overturned the conviction of a Montana man, who shot and killed a protected grizzly bear, ruling that he should have been able to claim that he acted in self-defense.
The three-judge panel of the 9th Circuit Court of Appeals ordered Brian Charette's case back to U.S. District Court, where he had been convicted of unlawfully taking a threatened species under the federal Endangered Species Act. |

Some new laws take effect in Idaho on July 1. One of them could change the way you protect yourself.
The "Stand Your Ground" law gives Idahoans more protections when they defend themselves with force. It's a change in law that didn't come without opponents, some suggesting it goes beyond protection and instead gives bad actors an excuse to shoot people or harm individuals, but police are hopeful that won't be the case.
"What the 'stand your ground' law does is it really does not change the 'self-defense' defense, it just puts things into effect statutorily," said Meridian Deputy Police Chief Tracy Basterrechea. "(Those who use it) still have to be able to justify why they did what they did." |

With lower courts split on the issue, the Florida Supreme Court said it will take up a question about whether a 2017 change to the state’s “stand your ground” self-defense law should apply to older cases.
The controversial 2017 change shifted a key burden of proof in “stand your ground” cases, a shift that can play a role in determining whether people claiming self-defense should be shielded from prosecution. But two appellate courts have split about whether the change should apply to defendants who were arrested before the 2017 law took effect but whose cases were pending. |

This is the latest test case of Iowa's 'Stand Your Ground' law and another chance for a judge to provide some guidance on its application. Many in the legal community have criticized the law for its lack of clarity on procedural issues. A judge in a previous case labeled the law “void for vagueness”. Lawyers on both sides of the Iowa vs. Hodges case said many questions remain.
"There's very little indication from the Legislature how we're supposed to do this," Johnston said. "As to who had the burden of proof in this hearing, what the rules of evidence were going to be...all of those things we had to talk about," he said. |

“Let’s be thankful [Democrats] are pandering to emotion instead of logic when they do try to advance anti-gun legislation,” Massie told The Daily Caller News Foundation at a banquet celebrating ten years since the U.S. Supreme Court came down with its landmark decision in District of Columbia vs. Heller.
“Honestly, I’m glad they’re not [knowledgeable] because their gun bans would be more detrimental to our right to keep and bear arms,” he continued. “For instance, when they passed the 1994 so-called Assault Weapons Ban, they banned them based on cosmetics and not functionality or lethality and I’m thankful for that.” |

Some 39% of Italians surveyed want gun ownership for reasons of self-defense to become easier, a sharp rise on the 26% seen in 2015. The CENSIS and Federsicurezza report on personal security found that those less educated were the most fervent supporters, with 51% of those having only a middle school education wanting fewer gun restrictions, and 41% of those over age 65. |

A while ago I saw a video testing out the R.I.P. ammunition by G2 Research. The video seems to talk about how the ammo doesn't penetrate as well as other ammunition. Although the creator is sure of his conclusions, I wasn't so sure. It seemed like he forgot about the physics of energy transference.
The G2 Research R.I.P. ammunition is frangible round that is referred to as advanced energy transference (AET) ammunition. Frangible rounds have several advantages over a standard hollow point or full metal jacket round. Just how much of an advantage has been at the center of a lot of debates between gun guys. |

With mass shootings on the increase, the firearms industry is being scrutinized on all sides. Lawmakers are forced to deal with a heavy hand with regulations.
What use is the Second Amendment if the gun industry is dealt a heavy hand asks legal counsel Michael Hammond, from the Gun Owners of America?
AR-style guns are not able to get financial support from Bank of America, while Corporate America has taken a firm hand against the industry as a whole. Payment processing issues are faced while making transactions. Problems that the firearms industry was facing have galvanized into a heavy threat to the industry. Walmart will not be providing firearms or similar weapons to people under the age of 21. The list against firearms goes on. |

In Dover, a gun control measure was signed into law on Wednesday.
Governor John Carney signed a 'red flag' bill that would give family members and law enforcement the chance to get a protective order against someone they believe poses a threat to themselves or others.
The order requires the person to give up their guns and allows police to search for and seize the firearms. |

Today, the Oregon Supreme Court unanimously sided with NRA and other petitioners on the legal challenge to the proposed ballot title for Initiative Petition 43, which seeks to ban commonly owned semi-automatic firearms and standard capacity magazines. Particularly, the court rejected the use of arbitrary terms such as “assault weapons” and “large capacity magazines" and noted these terms were misleading to voters since the initiative would ban most semi-automatic firearms. Previously on June 8th, the NRA, along with the Oregon Hunters Association, filed a legal challenge contesting the misleading and inadequate ballot title as prepared by the state Attorney General. |

The shooters often acted during bouts of confusion, paranoia, delusion or aggression — common symptoms of dementia. They killed people closest to them — their caretaker, wife, son or daughter. You may have noticed that at the same time the left has triggered its hypnotized "bots" to scream about immigration, there is something of a renewal of rhetoric on gun control. David Hogg, the trained activist who bravely survived shots not aimed anywhere near him, has re-emerged from his bedroom to pretend to relevance again. Michael Bloomberg got some recent press attention by pledging to flush $80 million more on gun control in the midterm elections. A week ago, Mrs. Clinton termed gun control a "political necessity" in order to "take back" the country, apparently from its own citizens. |

Some argue that enacting a red flag law could go against the second amendment, the right to bear arms. Ed Scruggs of Texas Gun Sense explains that a red flag law would not only provide public safety but protect the second amendment.
Scruggs assures that with red flag laws in place, law enforcement will not be able to seize guns from just anyone without reason. For a red flag law to take action, it would require a full due process. The person under scrutiny would be fully examined for any alarming mental health factors before their rights would be jeopardized. |

"It was a ridiculous law and it only hurt the voters of North Carolina," NC Constitution Party Chairman Al Pisano said. The law has been changed and now requires fewer signatures.
"It was crucial for us to get in 2018 so the voters know there is another option out there," Pisano said.
Party members hold conservative beliefs — pro-life, pro-Second Amendment and traditional family values to name a few.

This 5-4 vote became a landmark for Second Amendment defenders. Ultimately the decision nixed a Washington, D.C., law that banned handguns after a police officer’s application to obtain a one-year license for one was denied. The court found the law violated the Second Amendment, and Kennedy joined the other more conservative judges: Roberts, the late Antonin Scalia, Clarence Thomas and Samuel Alito. |
