Does the Second Amendment work?

After reporting about Patrick Burris, one reader left this comment:

"The second amendment has been around for 200 hundred years and it was useless to prevent this man from killing five people."

While superficially true, it highlights the commenter’s lack of reading breadth. There are as many anecdotal stories to prove the Second Amendment’s effectiveness as there are those that ostensibly support the need for gun control.

Fighting the law-abiding doesn't fight crime

"You don't fight crime after the fact nearly as well as you fight crime during the fact. After the fact, when crime has come and gone, you have the score of Crime 1 and the People 0. You certainly do not fight crime by fighting the electorate over more laws criminals ignore anyway, and all gun control does nothing but fight the electorate and ignore criminals."

"I am speaking of California Assembly Bill 962. You can read it all here."

"Fundamentally, it restricts a citizen’s ammunition acquisition and transfer of ammunition to fifty rounds per month. A student goes through more than that in a two hour class. Police officers go through more than that in qualifying when they need to qualify for their weapons. ..." ...

"California gun owners are facing another in a long line of threats. NRA-ILA warns us of Assembly Bill 962. Among other things:"
"This bill would require that commencing July 1, 2010, unless specifically excluded, no person shall sell or transfer more than 50 rounds of handgun ammunition in any month unless he or she is registered as a handgun ammunition vendor..."
"Yes, gun owners--anti-gun politicians really do hate you, plus this distracts attention from their utter incompetence at anything other than causing problems instead of providing solutions. It's not like a sane person would present this as an effective crime-fighting measure. The name of the game is political opportunism." ...

"As a result of the Supreme Court's Heller decision, many cities are being forced to dismantle their anti-gun laws. Chicago still wiggles and twists, trying to keep the rules unchanged in the face of the decision, but smaller cities are simply changing their laws. One of the first in the nation to ban handguns altogether was Morton Grove, Illinois. 27 years ago they banned all guns from their village and made no provision for legal ownership. Today, that law is rescinded. What I find interesting is that at the hearing by the town council concerning removing the ban, the reaction was pretty small. ..." ...

"Since Judge Sonia Sotomayor was nominated for the Supreme Court ... she has received fierce criticism for a number of her public statements and court opinions that reveal a troubling judicial philosophy. ..."

"In addition to concerns about her judicial philosophy, serious questions have been raised about Sotomayor's respect for judicial procedure. She has displayed a tendency to completely ignore or bury arguments she disfavors, treating unsettled statutory and constitutional questions as frivolous legal claims that merit no serious discussion. Equally troubling is her approach to constitutional rights: In several cases she has denied rights that are specifically protected by the Constitution while giving little or no justification thereof." ...

England and Austrailia, just to name a few, learned the lesson the hard way. "Several weeks ago, DefenseReview had an interesting conversation with Ralph Lermayer, Editor of AR Guns & Hunting and Predator Xtreme magazines about the relationship and crossover between the tactical shooting and hunting communities, particularly as they relate to the Second Amendment ... and legislation. During that conversation, I talked about how you shouldn't need more than one gun in each caliber for both uses, provided your ... tactical rifle/carbine or sniper rifle ... is accurate enough for hunting use. If you can use one gun for both tactical and hunting applications, it's going to be much easier on your pocket book. Let's face it, quality firearms are expensive, particularly if they’re custom built." ...

"The Brady Campaign to Prevent Gun Violence is alerting activists across the country that a potential amendment to a Department of Defense authorization bill scheduled for action in the U.S. Senate as early as next week would eviscerate limitations in many U.S. states on who can carry a loaded, hidden handgun in public in their state."

"'We believe that, at the urging of the extremist gun lobby, some Senators want to adopt Federal legislation that would undercut state law limits on carrying hidden handguns,' said Paul Helmke ... 'This will endanger public safety and make it more difficult for our police officers to do their jobs.'" ...

... "The intent of the framers of our laws was to require citizens to serve in defense of our new nation. The stress of rebellion as well as the need to protect outlying communities obligated all able-bodied men to come to the aid of their country. The right to keep and bear arms was vital to our nation's continued existence."

"The war for independence is over. We have local police, state police and numerous national law enforcement agencies. We have a professional military. We no longer need militias. It is no longer necessary for private citizens to keep and bear arms in defense of our communities or our country. It is reasonable to restrict the type of weapons permitted to be owned by private citizens and time to revisit the Second Amendment."

"Getting a statewide bill passed that allows citizens to carry firearms into parks became one of the most drawn out and messiest battles of the 2009 Tennessee General Assembly."

"Gov. Phil Bredesen ultimately vetoed the bill, the legislature swiftly overrode it and the law will take effect Sept. 1."

"But Tennessee lawmakers left an opening for localities to decide for themselves, which begs the question: Why did they spend all those weeks fighting and wrangling?"

"On Tuesday, the Bristol Tennessee City Council took advantage of that loophole. On a 3-2 vote, council members said bring the picnic basket when you enter a city-owned park, but leave the gun at home." ...

We support the council's decision, not because we believe guns belong in our parks, but because federal and state laws are clear on the matter. With no compelling evidence that responsible, licensed gun owners represent a danger to park patrons, the Second Amendment, the Tennessee Constitution and a host of laws and court rulings should be allowed to govern the issue." ...
