No charges will be filed against a Berwick man for a fatal shooting in May because it has been ruled an act of self defense, according to police.
Maine State Police announced Tuesday that 25-year-old Christopher Utt will not be prosecuted for the death of fellow Berwick resident Edward Badeau at Utt’s 321 School Street residence on May 13.
That morning, the Berwick Police Department received a report of a shooting at the home, where officers found the two men injured with gunshot wounds in a bedroom. |

Seconds after allegedly shooting a YouTube prankster at the Dulles Town Center Mall in Sterling on April 2, Alan Walter Colie called a gun rights group that provides legal advice for people who shoot in self-defense.
If Colie stands trial, his attorneys don’t want jurors knowing the Leesburg man called the United States Concealed Carry Association after the shooting of Tanner Cook who’d been attempting to play a prank on Colie. At a June 6 pre-trial hearing in Loudoun Circuit Court, Adam C. Pouilliard, a Loudoun County deputy public defender, argued allowing jurors to know Colie immediately sought legal assistance after the shooting might make them think he’s guilty. |

The N.C. Supreme Court made the right decision regarding felon voting rights by determining that the citizen convicted of a felony must have their rights restored, in a manner determined by the General Assembly, before exercising that right. In the case of voting, this simply means that all conditions of the sentence have been met — in colloquial terms, that the “debt has been paid.”
It is interesting to note that until 1970 that was the standard for all felony disenfranchisement in N.C., including exercising the Second Amendment right to self defense. |

A coalition of 20 attorneys general is requesting the U.S. Court of Appeals reverse a district court decision upholding Delaware's ban on "assault weapons" and certain magazines.
Republican Montana Attorney General Austin Knudsen led the group in filing an amicus brief in support of the Delaware State Sportsmen’s Association, Inc., in their case against the Delaware Department of Safety and Homeland Security. They argue two Delaware bills violate the Second Amendment. |

This rule has actually been around for more than 100 years and apparently there’s no record of it ever being enforced. That’s part of why the judge tossed out the case, though the fight is potentially not over.
In the lawsuit filed against the Department of Energy and Environmental Protection commissioner, David Nastri argued the ban prevented him from carrying a gun for self defense.
His lawyer says they will appeal and wrote in part:
“We are profoundly disappointed in the district court’s ruling, which we believe is significantly at odds with U.S. Supreme Court precedent and is based on an unprecedented legal fiction.” |

A 50-year-old Orange County man was acquitted Tuesday of attempted murder in the shooting of a neighbor he sparred with over trash cans and parking.
Jose Luisvallad Trujillo, who has been in custody since his arrest in January 2018, was acquitted of attempted murder and a lesser charge jurors considered, attempted voluntary manslaughter. He was also facing sentencing enhancements for the personal use of a firearm, inflicting great bodily injury and discharge of a firearm causing great bodily injury.
Trujillo is a handyman in Laguna Beach, and his clients in the city pitched in to cover his defense, according to his attorney Michael Molfetta said. |

Glock, Glock, Glock, the conversation about the Austrian-made, polymer frame, striker pistol never ends. You either hate them or love them. What you can’t deny is that they work exceptionally well. They dominate the handgun conversation for a reason, and they’ve completely changed the market. What do you think they’ll do about Rahimi? Agree with the lower court that the founding fathers would have let him keep the gun? Make another scary ruling that will give Clarence Thomas a chance to add his own interpretation that’s even scarier? Or take the opportunity to calm the worried public with a We’re Weird But Not Crazy message?
No reason to be optimistic. But on a happier note, a lot of states have been passing or working on passing or thinking about passing major gun reforms. Ten now largely ban assault weapons, those astonishing pieces of armament that work pretty much like easy-to-handle machine guns. (In Washington, Joe Biden has been pushing hard for a federal ban.) |

At the July 7 Pocahontas County Commission meeting, com- missioner John Rebinski took the lead in talking about passing a possible Second Amendment Sanctuary Ordinance. Rebinski said that if an ordinance is passed here, Pocahontas County would join 24 other West Virginia counties who have passed such an ordinance. He said the effect of passing this ordinance would be to send a message that the county stands behind its residents’ Second Amendment rights, and would not support local enforcement of any federal or state laws that may come up which would infringe on the right of the people to possess firearms. |

n June 30, the US Supreme Court agreed to decide whether a 1994 federal law that prohibits people under domestic violence restraining orders from possessing firearms is in violation of the Constitution’s Second Amendment.
The 1994 law currently in dispute prohibits a person subject to a domestic violence restraining order from possessing a firearm. It initially made the crime punishable by up to 10 years in prison and this term has since been raised to 15 years. |

Jan Garrett, a Warren resident, is not worried about Burham coming to his home and even though he knows law enforcement is advising residents to not approach Burham, he says he is using his right to ensure that he and his family remain safe.
"Until he is captured, I will be sitting here, armed because I have the right to bear arms and my wife and I both have permits," Garrett said.
"Residents feel safe because of many reasons, one of the reasons is because people do exercise their Second Amendment rights," Peterson said. |

The National Rifle Association is calling for legislation, Haile said, that will "take care of the individual, take them out of the equation, not take everybody else's gun out of the equation that's not involved in this, and that's protecting the Second Amendment."
Haile said he isn't working directly with the NRA but is discussing the matter with the organization and "listening to their requests" or public comments.
The Associated Press reported Lee's office accused the NRA of trying to invoke involuntary commitment laws "to round up mentally ill people and deprive them of other liberties," based on documents obtained in a public records request. |

“About a third have purchased home security cameras (34%) or security lights with motion sensors (32%),” the SCRI poll revealed. “A quarter have hired a professionally monitored home security system. One out of every six New Yorkers has taken a self-defense class and 12% have purchased a firearm for self-defense.”
The poll also reveals data about the number of people who claim they have been around a crime or were a victim of a crime; 9% of people claim they have been assaulted in the last year and another 9% claim to have been the victim of a burglary, according to the SCRI. Nearly 40% say they have witnessed violent or threatening behavior in a public setting. |

Attorney General William Tong released the following statement praising U.S. District Judge Janet Bond Arterton’s dismissal of plaintiff’s Second Amendment challenge to Connecticut’s commonsense prohibition on unauthorized carrying of firearms in State parks and forests.
“Judge Arterton was right to dismiss this speculative complaint for lack of standing. Connecticut’s commonsense gun laws are live-saving and constitutional-- they strike the right balance between respecting Second Amendment rights while also protecting public safety. This decision protects our ability to safely enjoy our State parks and forests. |

The Marjory Stoneman Douglas High School Public Safety Act (CS/SB 7026) also created Florida's "red flag laws," which established when and under what circumstances law enforcement could confiscate weapons from someone who was deemed a threat and prevent them from buying more. The bill passed both chambers of the Florida Legislature on largely bipartisan votes.
Now these and similar laws across the country may be in danger.

Over the coming months, you can expect to hear a great deal about United States v. Rahimi, the most important Second Amendment case that the Supreme Court will hear in its next term. And what you will hear is that this is a case about whether we take domestic violence seriously.
It isn’t. It is a case about whether we take due process seriously.
Sometimes, it is easier to understand disputes about the Second Amendment if you pretend that they are disputes about the First Amendment. The fact is that many of our progressive friends do not think the Second Amendment should be in the Bill of Rights and do not consider Second Amendment rights true and legitimate civil rights. |
