The ruling came after a two-day trial in May, according to Attorney Cameron Atkinson who represented David Nastri in the lawsuit.
"We are profoundly disappointed in the district court's ruling, which we believe is significantly at odds with US Supreme Court precedent and is based on an unprecedented legal fiction," attorney Cameron Atkinson said in a statement posted on Twitter. "We will immediately appeal the district court's decision, and we remain committed to removing every barrier to law-abiding citizens exercising their Second Amendment right to bear arms to protect themselves." |

New Yorkers are turning to firearms to protect themselves from crime, even as the state has ramped up restrictions on carrying them for self-defense.
A new Siena College Research Institute (SCRI) poll released Wednesday found that 87 percent of New Yorkers say crime is a serious problem in the state today, and 61 percent are either very or somewhat concerned that they might be a victim of a crime. In response, roughly one in eight respondents said they purchased a firearm for self-defense in the past 12 months, including more than one in six respondents living in New York City. |

The nation’s highest court is set to decide a new Second Amendment case, but how the justices might come down is murky at best.
A collection of experts from across the ideological spectrum who have spent decades studying the Second Amendment and American gun laws told The Reload United States v. Rahimi presents a unique challenge for the Court that will likely flush out its new test for gun cases. But they were less confident about the direction the justices might take or the conclusion they might arrive at.
“It is still too early to tell what the Supreme Court will do in Rahimi,” George Mason University professor Robert Leider, who writes about the Second Amendment and teaches at the Antonin Scalia Law School, said. |

In a blog post on Wednesday, Nastri’s lawyer, Cameron Atkinson, said he was appealing Arterton’s ruling. Atkinson said the dismissal ignored existing court precedence in order to avoid ruling on Second Amendment issues.
“We have already filed our notice of appeal, and we will seek speedy review from the U.S. Court of Appeals for the Second Circuit. If the Second Circuit forces us to go to the U.S. Supreme Court, we will,” Atkinson wrote. “We view the district court’s decision as legally and logically unsustainable, and, at times, it opens fire on its own reasoning.”

New Jersey is moving to implement a controversial two-decades-old law requiring the sale of so-called "smart" guns in the state.
On Thursday, the state Attorney General's office announced that the Personalized Handgun Authorization Commission has approved “performance standards and qualifying criteria” for personalized handguns to be sold in the state, which officials described as a key step to implementing the long-delayed law.
Under the new criteria, manufacturers seeking to be added to the state’s personalized handgun roster must demonstrate the handguns have reliable personalization technology, features to avoid accidental discharge or damage and comply with state and federal law, the AG's office said. |

The bill stretches across a wide range of firearm-related issues, including where guns can be carried, the licensing process, the state’s existing ban on assault weapons, rising numbers of untraceable “ghost guns,” and training for gun owners.
Day filed the sweeping legislation on June 26, just more than a year after the U.S. Supreme Court’s Bruen decision that forced a change to Massachusetts right-to-carry laws.
Fulfilling an assignment from Mariano, Day crafted his legislation based on input gathered in 11 listening sessions across the state and from officials such as Attorney General Andrea Campbell.
The proposal has already drawn intense criticism from gun ownership and Second Amendment groups. |

Attorneys representing the Second Amendment Foundation and its allies in a federal challenge of Maryland’s restrictive concealed carry statute today filed their reply to the state’s arguments against an earlier motion for a preliminary injunction in the case known as Novotny v. Moore.
The response brief was filed in U.S. District Court for the District of Maryland.
SAF is joined in the case by Maryland Shall Issue, the Firearms Policy Coalition and three private citizens, all of whom possess “wear and carry permits,” including Susan Burke of Reisterstown, Esther Rossberg of Baltimore, and Katherine Novotny of Aberdeen, for whom the lawsuit is named. |

The ‘stand your ground’ state law doesn’t apply retroactively, according to the South Dakota Supreme Court.
The court publicly released the decision Thursday, declaring that a convicted killer couldn’t use the law to go free.
Ramon Smith shot one man to death and wounded two others on June 8, 2019. A Minnehaha County jury found Smith guilty of second-degree murder and three counts of aggravated assault. Circuit Judge Bradley Zell sentenced him to life in prison, as well as three 25-year terms. |

The Nashville shooter, whose writings Leatherwood and other parents are asking a court to keep private, used three guns in the attack, including an AR-15-style rifle. It was one of at least four mass killings in the first half of 2023 involving such a weapon, according to the database.
Nearly all of the mass killings in the first half of this year, 27 of 28, involved guns. The other was a fire that killed four people in a home in Monroe, Louisiana. A 37-year-old man was arrested on arson and murder charges in connection with the March 31 deaths. |

On June 30, 2022, just a week after the Supreme Court decided the Bruen case, Delaware Governor John Carney signed into law a ban on "assault weapons" and standard-capacity magazines, effective immediately. Apparently he didn't get the memo that a ban on firearms in common use is off the table constitutionally.
Delaware plagiarized California's 1989 findings that it was imperative to ban any gun that is not a "sports or recreational firearm." The state ignored the Delaware Bill of Rights guarantee of the right to bear arms "for the defense of self, family, home and State," and disregarded Heller's admonition that self-defense is "the central component of the right itself." |

Reagan Strickland fired a pistol down range.
Her instructor, Judi Phelps, gave her some words of encouragement. Strickland fired another shot and Phelps congratulated her again.
Strickland was attending a summer camp at On Guard Defense for teenagers interested in using a firearm for self defense.
She said guns used to make her nervous, but they don’t anymore.
“I can confidently look at a gun and say that is not dangerous right now because it is unloaded or unarmed,” Strickland said.
That’s what Judi Phelps is hoping for. |

Suppose a criminal commits a crime a gun. Go a step further and suppose he does something truly awful and shoots several people in the process. If you’re an anti-gun politician, the obvious conclusion is it’s now time to disarm your gun-owning neighbors.
Do elected anti-gun zealots care that implementing their bigoted disarmament fantasies not only infringe on human rights, but also leave us with even more dead victims? I doubt it, since what’s out of sight is usually also out of mind.
There’s plenty of blame to go around, but the killers who sit in city hall are never arrested or even charged…until now. |

Any time the media’s favorite former “gun guy”-turned-gun control advocate gets invited to speak about gun control, hold on. It’s going to be a wild ride.
Ryan Busse, Senior Advisor for Giffords gun control group, was invited to MSNBC’s “Reidout” to speak with host Joy Reid as she bemoaned that she was allegedly afraid to leave her home on Independence Day for celebrations because “America’s awash in guns” and is insane.
Busse jumped right in with all the standard gun control talking points regardless of whether they are actually true, the better to feed Reid’s fears and scare her viewer(s). The conversation went down a road of hairpin turns, over through and around the truth, then straight off the edge into outright falsehoods. |

Larry Pickens, 29, accused of murdering renowned hand surgeon Dr. Benjamin Mauck at a Tennessee clinic, is now in custody with a $1.2 million bail. One thing we’ve learned from mass shootings is that no community, no matter how idyllic, is immune from gun violence. From the manicured lawns of Newtown, Connecticut to the ocean breezes of California, this epidemic does not discriminate. We raise our kids, teach them from right and wrong, help with their homework, celebrate accomplishments and birthdays, and send them to school. Every parent’s worst nightmare is burying their child. Gov. Kathy Hochul expressed concern the state’s burgeoning “Red Flag Law” could be upended by the U.S. Supreme Court, an issue she framed as a threat to survivors of domestic violence as thousands of New Yorkers have been temporarily barred from possessing a firearm over the last year .
“The Supreme Court has a choice: It can lean into the dangerous Fifth Circuit theory that guns cannot be regulated for the purpose of protecting survivors of domestic violence, or it can uphold federal law that keeps guns out of the hands of dangerous individuals,” Hochul wrote in a New York Times op-ed published Tuesday. |
