Gunmaker to feds: Make my day!

"A gun expert who alleges the U.S. government is retaliating against him for his testimony on behalf of a man sentenced to prison after his gun malfunctioned now has challenged the feds to go ahead and confiscate one of his own products."

"'Your suggestion for forfeiture of company property is an excellent solution to this most unfortunate controversy. The initiation of forfeiture proceedings by ATF against the firearm serial number V1, will afford the opportunity for both parties to be heard and will provide a fair and equitable determination of the issues while preserving all processes that are due for both parties,' Len Savage, owner of Historic Arms LLC, wrote in a document prepared for the [BATFE]."

... "In other words, if he took them up on their 'offer' and tried to re-register it as a machinegun without a guarantee of immunity, they would technically be able to come after him for committing 'unlawful acts'. His options are to risk losing an expensive piece of property to forfeiture proceedings, or to risk his livelihood and freedom defending himself from stepping into the trap of essentially being coerced into signing a confession."

"Those of you who have been watching things here and in other cases we've talked about, and slogging through the myriad documents, will see what's going on--this is another significant piece of evidence as to the true nature of this agency, and another significant glimpse into the hearts and minds that run it." ...

"He will turn 60 in December, and some people will tell you that the older they get, the less they care about what other people think."

"But Ted Nugent has never really cared what anybody thinks about him, and for nearly 40 years he has been as known for his brash, sometimes crude outspokenness as he has for his unbridled live shows. In the last 10 years or so, he has become an uncensored spokesman for the National Rifle Association and for other conservative causes. He has also been a staunch supporter of President Bush, the Republican Party and the Iraq war." ...

The Constitution, literally?

"The 'strict constructionists"" on the U.S. Supreme Court have now reconstructed the Second Amendment by deleting the clause about militias. Interesting how we pay such homage to the wisdom of the writers of the Constitution that we must obey what they had in mind, but can just decide that that one clause was just a stupid mistake in an otherwise perfect document."

"Since the document was penned in the latter part of the 18th century, it is only reasonable to assume, as strict constructionists, that the arms referred to were the arms available at that time. So the founders only really meant to protect the right to own and to bear single-shot muzzle loaders." ...

"GEORGIA'S gun problem is not really about where one can carry a concealed weapon but rather about who is doing the carrying."

"The current uproar about trying to expand gun-carry rights into Hartsfield-Jackson International Airport simply further emits a smokescreen hiding the real concern." ...

"... Georgia has some of the weakest checks on gun-toters around ... and now has some of the broadest ability to brandish what one may not know how to use.

"That's a prescription for unending disasters and constant bad publicity about gun rights ..." ...

"The St. Petersburg Times recently reported the U.S. Supreme Court's landmark decision that the Second Amendment to the U.S. Constitution grants private citizens the right to nonmilitia private gun ownership. That same week, a 3-year-old playing with a gun in his family's living room accidently shot himself in the head and died. A 4-year-old pulled a gun from her grandmother's purse, shot herself and died. And a 6-year-old was killed when playing with a gun that his friend brought into his house."

"Tragic stories of accidental shootings from the careless storage of guns at home are all too common. ..." ...

Submitter's Note: Accidental shootings among children 14 and under averaged 71.5 a year from 1999 - 2005. Accidental drownings in that age range and period averaged over 845 per year. Which one should we try to fix first?

"No more arguing over the meaning of commas or engaging in semantic minutiae over the definition of militia."

"The June 26 Supreme Court decision to strike down the Washington D.C. handgun ban ... clearly established the right to bear arms as an individual right guaranteed by the Constitution’s Second Amendment." ...

"Despite clarifying the definition of the amendment and defeating D.C.'s handgun prohibition, the five to four decision left lingering questions in states where handgun violence is a serious problem – sparking new debate over the ability of state and local governments to enact restrictions on federally guaranteed rights and raising fears of unintended consequences for law enforcement." ...

"Gun-rights supporters are going to have to come down from their post-Heller high a little earlier than they'd hoped. There's already a considerable amount of legal maneuvering taking place, and for much of it, a bullseye is uncertain."

"Most promising are challenges to gun bans nationwide. Since the Supreme Court struck down the capital's ban, it's almost a no-brainer to predict the Court will strike down those in places like Chicago and its suburbs as well."

"There's a slight wrinkle when it comes to 'incorporation' -- D.C. is a federal enclave, so in Heller the Court didn't have to decide whether the Second Amendment applies to state and local laws as well. ..." ...

"The U.S. Supreme Court may have ruled that the Second Amendment protects an individual citizen's right to own and possess a firearm, but that doesn't mean the District of Columbia won't do everything possible to discourage law-abiding citizens from arming themselves for self-defense."

"... Larry Pratt of Gun Owners of America is convinced that liberal, gun-hating politicians in the District have no intention of allowing law-abiding citizens to defend themselves from violent criminals."

She berates the Supreme Court's affirmation of the 'individual right' of the people to arm themselves as the demise of public safety, but retires to the most heavily armed state in the union, which also ranks at the top of the safest states in the union. I don't see the difference between Maine and Washington, D.C.. Regardless of where we live, we have a right to protect ourselves from the scum that lies just below the surface everywhere.
