This week we heard a future Supreme Court justice refuse to affirm that the Second Amendment is the fundamental right to keep and bear arms. And when challenged on the application of the 14th Amendment affirming that right, she danced around the question. So something as black and white as the Second amendment is not fundamental; however, the Fourth Amendment, that makes no mention of abortion, provides a woman the right to terminate the heart beat of a living being.
This woman – who claims she can make a better decision being a Hispanic female – is going to be confirmed regardless of her inconstancies and bigotries. Why? Because Mr. Obama wants her. How many times this week were you reminded, "elections have consequences"? |
South Africa: South African ATMs Now Practice Self-Defense

In many African countries, ATMs are a constant target for criminals. In South Africa, the problem has recently esclated as criminals use explosives to blow up the machines and steal the cash. Nearly 500 ATMs were blown up in 2008. To combat robberies, Absa Bank is piloting new ATMs at eleven locations that shoot pepper spray at potential thieves.
The technology uses cameras to detect people tampering with the card slots. Another machine then ejects pepper spray to stun the culprit while police response teams race to the scene.
Ed.: Seems to me that any crook that can buy, steal, or make explosives to blow open an ATM, can also buy a gas mask to counter the pepper spray. |

Coburn wondered how courts cannot see the explicitly stated Second Amendment "right to keep and bear arms" as fundamental, yet can hold as fundamental the unexpressed right to privacy. Sotomayor answered: "Is there a constitutional right to self-defense? And I can't think of one. I could be wrong, but I can't think of one."
For eight years, Democrats attacked the Bush administration for giving short shrift to personal liberties. Now the Obama pick for the Supreme Court can't think of a right to defend yourself. That is arguably extraordinary. |

A growing movement by the NRA and Second Amendment gun rights advocates, support legislation allowing concealed weapons in bars and restaurants.
The state of Tennessee recently joined 37 other states allowing guns in bars, with its new legislation taking effect just recently on July 14.
The guns in bars legislation was spearheaded by state Sen. Doug Jackson. The State senators overrode Democratic Gov. Phil Bredesen’s veto of the bill in a commanding vote of 21-9. |

Other states are stepping up to the plate and asserting their state's sovereign right under the second amendment - a right that guarantees the right of the people to keep and bear arms.
On July 6, Florida introduced the Firearms Freedom Act which seeks to provide "that specified firearms, firearm accessories, and ammunition for personal use manufactured in state are not subject to federal law or regulation" in the State of Florida. Increasingly, the representatives 'we the people' have elected to preserve and protect our rights, are ignoring the clear, unequivocal language of the Constitution. Our politicians seem unaware of the fact that the Constitution does not include congressional power to override state laws. |

For years, state Rep. George N. Peterson, R-Grafton, has not been able to comprehend why Massachusetts, unlike the vast majority of states in the country, makes its residents get a Firearm Identification Card to carry Mace and pepper spray.
So, for years, Mr. Peterson has signed onto a bill that would eliminate this requirement. This year, he and 10 other Republicans are trying again. |

I listened to the Sotomayor hearings, and I came away with conflicting impressions.
For example, she said unequivocally that the right to keep and bear arms is an individual right, something her perhaps-future liberal colleagues denied in their dissent of DC v. Heller. This is something that she could not easily go back on later, so that's a good thing. However, she also seemed a bit weak on questions about the finer points of incorporation doctrine (saying she wasn't sure what Presser v. Illinois said). On the other hand, I don't really care about her decision that the Second Amendment is not incorporated, since that's something I believe current doctrine says only the Supreme Court can do ... |

The passage of the Tennessee Firearms Freedom Act, H.B. 1796, 106th Leg. (Tenn. 2009) 1796 (”Act”), effective June 19, 2009, has generated questions from industry members as to how this State law may affect them while engaged in a firearms business activity. The Act purports to exempt personal firearms, firearms accessories, and ammunition manufactured in the State, and which remain in the State, from most Federal firearms laws and regulations. However, because the Act conflicts with Federal firearms laws and regulations, Federal law supersedes the Act, and all provisions of the Gun Control Act and the National Firearms Act, and their corresponding regulations, continue to apply. |

When Supreme-Court nominee judge Sotomayor was asked whether there is a right to self-defense, she did not say “yes.” Her answer was that it would depend on state law.
Moreover, when asked her judicial philosophy, her answer was, “fidelity to the law.” She could have said “fidelity to the Constitution.” Perhaps by “the law” she includes Constitutional law, but it is not clear.
The specific words “self-defense” are not in the Constitution. They are implied in the right to bear arms, but more fundamentally, the right to self-defense is a natural and common-law right recognized by the Ninth Amendment to the US Constitution. |

Furthermore, had he been convicted of sexual assault, he would have been forced to register as a sex offender for the rest of his life, and California laws on sex offenses are especially draconian. Instead, he is convicted of a “civil rights violation” and almost surely will be incarcerated in a minimum-security federal prison. (Now, the prison camps are not “country clubs,” no matter what journalists might tell you. However, they are much better than the hellish maximum-security prisons in the California system.) |

Home is the one place where most of us feel safe and protected. Even those who have a keen sense of self-defense feel free to let their guard down at home. And, sadly, most people do not possess a keen sense of self-defense. Most people have the deluded opinion that law enforcement will protect them. But even law enforcement professionals will tell you it is not their job to protect citizens; it is their job to apprehend and bring those who have committed crimes to justice. In other words, after you are dead, the cops will try to catch the guys who killed you. |

A California blue-uniformed tax feeder (to quote Will Grigg) has pleaded guilty in a case where he forced a woman to perform oral sex on him after he pulled her over on a traffic stop. However, the case was heard in federal court, yet it clearly was a case of sexual assault, which normally would be a state offense. My question is why this was done. |

Several outraged reactions have been posted thus far to this piece discussing political action by freedom-lovers against government workers, but this statement has angered even more folks:
- All current and former oathtakers since 1916 have thus far failed in their duty to defend the Constitution from domestic enemies such as every President other than Eisenhower, along with the respective Congresses from 1916 forward; and
- Those oathtakers are well overdue in actually doing something (other than talking) about reversing that abysmal 93-year record of failure in actual, effective oath-keeping.

"Dionta RaShad Cochran was killed by his own gun after it accidentally discharged in the 19-year-old's pocket, authorities said Friday.
"Tests confirmed that the fatal round was fired from the .32-caliber pistol Cochran kept in the back pocket of his low-hanging pants...
"He was a very outgoing young man; he was very sweet," Brown said. "He was a part of our youth ministry. Always wanted to do the right thing. Yes, he had some trouble in the past, but when he came out, he had his head on right."
"Cochran spent 10 months in prison after a conviction for strong-arm robbery. He was released in April.
On June 5, he was arrested and accused of shooting a firearm in West Ashley. "

National Rifle Association firearms instructor Lee Merriman says a lot of people fear the criminal elements around them.
That is keeping Merriman busy these days as he trains people from all walks of life to use a firearm safely.
“I have a lot of older people who live in bad areas of Peoria who are scared,” said Merriman.
“Most people are here because the crime rate is so high.
In recent weeks the city of Peoria volunteered to be a test city for a concealed carry law. Bartonville promptly followed suit, requesting to be a part of any pilot program agreed to by the state.

I never wanted to put myself at the mercy of your unconstitutional, bully-boy agency whose malfeasances, misfeasances, perjuries and deadly misadventures are legendary. I have observed first hand your agency's ability to cow FFL holders into not fighting you in court when you violate your own rules. Your agents often push the line of what constitutes statutory compliance with the threat that they will come back with a raid party if the FFL holder doesn't knuckle under. Having my business, my livelihood, my family's safety and my life at the whim of brutal thuggery such as exemplified by "Waco Jim" Cavanaugh at the time of the Trader's Gun Shop raid here in Birmingham, or Jody Keeku's railroading of David Olofson, never interested me. |

On Friday, we saw the letter ATF sent to FFL dealers in Tennessee telling them the Bureau was overriding the state's Firearms Freedom Act, and would continue to impose federal requirements in disregard of state law.
They've done the same thing to Montanans. |

PEORIA — Talk of bringing concealed-carry legislation to Illinois gives many residents a fear of the unknown.
Several local police chiefs and other personnel said putting fear into the minds of criminals on the streets is also one of the best arguments for allowing concealed carry.
"We're supporting the sheriff's association with mandated regulations if the Legislature decides to enact concealed- carry in the state," Bartonville Police Chief Brian Fengel said. "They're already out on the streets. The gangbangers already have guns. This would allow law-abiding citizens to have them with mandatory training and background checks."
