MN: Challenges to State's handgun law spreading
Submitted by: Michael Lomker

Post Comments | Read Comments

"From the heart of the Iron Range to the hometown of the chief legislative sponsor of Minnesota's new handgun law, local officials are challenging its provisions barring them from keeping guns off public property."

"And gun-rights advocates are gearing up for counterchallenges in court, but on their own unhurried timetable."

-------
This story paints a picture of county and city governments as being "wronged" and valiantly defending their "right" to have local ordinances. Local law firms say they will file suits based upon property-rights arguments. Landlords think they are entitled to write firearm bans into their leases.

We wouldn't want anyone but the landed gentry to be able to defend themselves, would we?

PA: Pennsylvania Legislators Conspire to Confiscate Your Handguns

"On July 1, 2003, three days before Pennsylvanians were to begin celebrating our Independence from tyrannical British rule, 13 members of the Pennsylvania House of Representatives introduced a bill that would give law enforcement the authority to confiscate all handguns in private possession, unless they are approved by a newly created Handgun Standard Commission. The catch 22 is that no handgun currently manufactured today will be able to comply with the standards outlined in the legislation that this Commission must use to approve handgun sales. These standard(s) will require that the only handguns that will be permitted to be owned will be of the so-called personalized-smart guns design, and no existing handgun will be permitted to be modified."

"Months before Sen. Orrin G. Hatch (R-Utah) introduced legislation to repeal the District's 27-year-old handgun ban, two gun rights groups were trying to get the law struck down in U.S. District Court."

"Last week's proposal by Hatch, chairman of the Senate Judiciary Committee, has once again put them at odds, with the Cato Institute accusing the senator and NRA officials of conspiring to spoil its lawsuit."

"The truth is, Modern Liberalism does not oppose moral law; rather it haughtily believes that it has a fresher, higher, smarter moral perspective than that contrived by the rough and puerile rabble. Thus, the advocates of this creed feel compelled to share it, to order it, to mandate it—and with the power of the state behind them, they have met with great success in decreeing their religion throughout the land." ...

"Disarmed residents of the nation's capital, which is also the nation's murder capital, seem to have attracted a powerful ally in Sen. Orrin Hatch (R-Utah). The D.C. Personal Protection Act, introduced by Hatch on July 15, would repeal the District's 27-year ban on handguns and lift prohibitions on carrying weapons in homes and businesses."

"Yes, Congress has been through this before. For the first time, however, someone with the heft of Orrin Hatch is leading the charge. Why Hatch? And why his sudden preoccupation with D.C. after 27 years? As Council member Kathy Patterson (D-Ward 3) put it: 'I can't believe a senator of his stature would waste time on something like that.' Of course, defenseless Washingtonians, at the mercy of the local drug gangs, may have a different view of what constitutes wasted time. Still, that doesn't explain Hatch's sudden emergence as a crusader for repeal." ...

... "Spurred by Attorney General John Ashcroft's endorsement of an individual right to bear arms, public defenders across the country are invoking the Second Amendment as a defense to prosecution. How long before the high court gets one of those cases, with a crack dealer as the Second Amendment's poster child?"

"Despite that risk, the NRA seems determined to derail our case." ...

"Passing a law... gosh, it always makes us feel so proactive, and it may help in some situations. But we can't just rely on laws, and the wisdom of the state on things that are so important. We have to continue to take personal responsibility, even when life is uncomfortable. I believe no action of the state can relieve us from our moral imperative to pay attention and have icky conversations, for the sake of 50 bloody bodies in that California market."

"Tiahrt's eight-point amendment, which targets the Bureau of Alcohol, Tobacco and Firearms and was drafted with the NRA's help, would prohibit the use of federal funds for several bureau activities. "Burbank began as two Spanish land grants that became a sheep ranch. Today it is an incorporated city of 100,000 with a total size of just more than 17 square miles. The studios, Griffith Park Zoo, and many other attractions and homes are located in the lovely downtown area, but on the northeast side of the city are the Verdugo Mountains, which rise up to 1,000 feet. Over seven miles long and three miles wide (at their widest), the Verdugos are part of the San Gabriel Mountains, and home to some 500 deer, as well as numerous rabbits, quail, and coyotes. Until this spring, these animals have been legal game for archers."

"Last fall, however, some hikers complained about seeing bowhunters in the Verdugos. Their concerns led the Burbank city council to forbid anyone 'but a peace officer or animal control officer' acting in the line of duty from shooting arrows in the city limits — except at archery ranges, although there are none."
