CA: California ‘private citizens’ involved in 40% of state’s justifiable homicides in 2020

However, statistics published Thursday by the State of California reveals that citizens used deadly force in 40% of the state’s justifiable homicide cases last year. Much to the chagrin of cop-haters, this is a sobering reality of criminal violence—good people (private citizens and police) are sometimes forced to take a life in order to preserve life.
“In 2020, there were 143 justifiable homicides reported. Of these, 85 were committed by a peace officer and 58 were committed by a private citizen,” according to the California Department of Justice report. |

Supporters of Second Amendment Sanctuary were back before the Jefferson County Commissioners Thursday asking them to take action to preserve the right to own firearms in Jefferson County even if federal and state laws would seek to limit gun ownership.
Richard Carter said he was asking the Commissioners “to pass a law guaranteeing Jefferson County, Indiana, will be a Sanctuary Second Amendment county, and no one in this county will assist the feds in enforcing unconstitutional firearms laws.” Carter also sought adoption of an ordinance imposing “a heavy fine and jail time for anyone who breaks it.” |

Next term already has some exciting cases. In N.Y. State Rifle & Pistol Association v. Corlett, the Court will consider whether the Second Amendment requires the granting of concealed‐carry permits for self‐defense purposes. In Dobbs v. Jackson Women’s Health, the Court takes up the contentious question of whether all pre‐viability abortion restrictions are unconstitutional (my prediction: the Roe v. Wade right is under no threat, but Planned Parenthood v. Casey’s inscrutable “undue burden” standard isn’t long for this world). |

Even ignoring that there is no constitutional provision guaranteeing a right to own and drive a car, my response to this is: “Gun owners would mostly love that.”
As they fall back a step, I explain that I do not need to have license plates on my car on private property, nor do I need a driver’s license to operate it there. There is no background check to buy a car. I do not even need a driver’s license to buy a car. I can sell a car to anyone that wants to buy it. I do not need to go to a licensed car dealer. My driver’s license is recognized in every state and even in Canadian provinces. If I want to buy a car from a dealer in Chicago, I can fly there, buy the car and drive home. |

Attorney General Ken Paxton joined a multistate amicus brief demanding that the U.S. Supreme Court uphold Hawaiians’ Second Amendment rights to bear arms outside their homes. In a 2020 decision, the Ninth Circuit Court of Appeals upheld the State of Hawaii’s refusal to allow its citizens the right to carry firearms outside of their homes. But the Second Amendment protects both the rights to keep and to bear arms, not just the right to keep them. The amicus brief also asks the Supreme Court to resolve a split among the federal circuit courts of appeals, several of which have resisted the Court’s clear and ringing affirmation of Americans’ Second Amendment rights in its landmark 2008 decision in District of Columbia v. Heller. |

Would carrying a gun make you feel safer?
Robert Nash and Brandon Koch thought so. But the state of New York denied them gun permits, saying they hadn't demonstrated a "special need."
Why did they have to prove such a "need"? The Supreme Court ruled more than 10 years ago all Americans have a right to keep and bear arms, no matter where they live. |

“The whole proposal is completely disingenuous. It fails to provide any proven solutions. It is blatantly unconstitutional,” said San Jose resident Dave Truslow, a National Rifle Association firearm instructor. “In the meantime, (Mayor Sam Liccardo) is hoping to bask in the sunlight.”
On Tuesday, the San Jose City Council unanimously passed measures that will require all gun owners in the city to carry insurance and pay an annual fee to cover taxpayer costs related to gun violence or risk having their weapons confiscated. The city attorney’s office will return to the council in the fall with an ordinance for final approval. |

“Let’s take this constitutional carry, this Second Amendment thing, one step further and push back at the ridiculousness of gun-free zones,” said Walters during a June 23 meeting.
A former Troy chief of police, Walters made the argument that restrictions on where residents may carry firearms only affect law-abiding citizens. He urged commissioners to pass a resolution that expands constitutional carry across the county.
Commissioner Jerry Bennett (D-2) noted that House Bill 102, signed into law by Gov. Greg Gianforte in February, covered most if not all of Walters’ requests. |

Boone County Sheriff’s investigators talked with their lawyers and tried to figure out how the new law impacts their relationship with federal agencies including the Bureau of Alcohol, Tobacco, Firearms and Explosives. The Boone County Sheriff’s Department is part of an ATF Task Force that cracks down on criminals using illegal guns. Some Missouri law enforcement agencies are pulling officers off federal task forces while they get more familiar with the new law. Missouri officers who knowingly enforce any federal gun laws could be sued and fined $50,000 per violating officer. |

Georgia courts have interpreted state law as protecting a broad right of self-defense that appears to permit private citizens to detain individuals for police custody in any situation where defensive force is justified. They may also use or threaten the use of deadly force to stop forcible felonies and apparently have a limited ability to pursue criminals in the immediate aftermath of forcible felonies. |

In 2020, Americans battled a pandemic, social injustice and a contested election — conflicts that led many people to become gun owners.
And, consistent with a slow trend over the past decade, more of those gun owners are women.

Yesterday, both Kansas and out-of-state law-abiding gun owners will be able to take advantage of pro-gun legislation that was passed into law during the Legislative Session, House Bill 2058.
Proposed by Kansas Attorney General Derek Schmidt, House Bill 2058 does the following:
Recognizes all out-of-state concealed carry permits, and allows those who have been licensed to carry a firearm for self-defense, to do so lawfully in Kansas. This legislation recognizes that visitors to Kansas should not be left defenseless simply by crossing a state line. |

Russian President Vladimir Putin signed a law that establishes stricter state control over arm circulation, the official legal information portal published on Friday.
According to the document, some amendments were carried out in the legislations over weapons and the basic aspects for the protection of citizens' health in the Russian Federation.
The law also establishes the bases for depriving a citizen of the right to keep and bear arms, taking into account the investigation.
By law, gun owners must undergo these medical examinations at least once every five years.

Did you know you can own a firearm regardless of political affiliation? Of course you did. So, if pretty much everyone, regardless of politics, can own and have owned firearms, why is “the gun” today considered only a tool of the Right?
Too bad that answer isn’t simple. However, there’s plenty of blame to go around. Some may reference the National Rifle Association — see Ackerman McQueen — for what was a successful campaign to unite its current membership base using identity politics. Through their “I am the NRA” campaign, they united people from all walks of life, economic status, races, genders, and sexual orientations through the common need for self-defense. |
