In this AP report, we note the negativity of both Eugene Volokh and NRA attorney Stephen Halbrook. Let's take a look at their statements.
Eugene Volokh
Volokh is quoted as saying that "odds are against the justices taking the case." The timing of his statement suggests that it is highly doubtful he even read the Certiorari Petition, which was crafted with the extensive input from an attorney who has won unanimous cases in the Supreme Court and has been victorious in 11 of 12 federal Circuit courts.
In our view, negative predictions by prominent Constitutional lawyers such as Mr. Volokh are inappropriate -- even irresponsible -- because they may subtly influence the court's decision to hear the case. In this instance, it is especially important for the Court to hear the lawsuit -- decades of abuse of gun owners must come to an end. And the preparation for this appeal is already far beyond anything the Court has been presented with thus far on the Second Amendment. All we need are four (4) Justices to agree to hear the case.
NRA Attorney Stephen Halbrook
NRA attorney Stephen Halbrook's statement is far more egregious. He's quoted by the Associated Press as saying, "the case is complicated because it involves questions about state authority to undercut gun rights and whether the challengers had standing to sue the state."
First, the Second Amendment is a right of the people, period. That means states shall not infringe upon it. That is the plain and simple truth, and we are doing something about it. One must wonder why Mr. Halbrook's client -- the National Rifle Association -- has been in existence since 1871 yet has never taken a successful Second Amendment case to the U.S. Supreme Court.
Would Mr. Halbrook comment on a lawsuit challenging a state's ability to ban the First Amendment by saying it was "complicated," too? Does a "complicated" case mean it shouldn't be heard? History is full of complicated lawsuits -- but that doesn't mean they should be given a negative slant by a supposed ally the day they are filed at our nation's Highest Court.
Then there's Halbrook's strange suggestion that the Silveira plaintiffs might not have standing to even file this lawsuit. Perhaps he is covering for NRA/CRPA attorney Chuck Michel. Michel tried to kill this valid Second Amendment case by saying the Silveira plaintiffs didn't have standing to file this lawsuit. Longtime KABA Advisor and ally Brian Puckett wiped the floor with this absurd assertion months ago.
Someone ought to ask NRA attorney Stephen Halbrook the following questions:If the Silveira plaintiffs don't have standing, why is it that the liberal 9th Circuit used the Silveira case to throw out the section of California's so-called 'assault weapons' ban that gives exemption to retired law enforcement officers?
Why did the 9th Circuit even hear the case at all, let alone rule on it -- if there's no standing? And why did the 9th Circuit's consideration of the case for an en banc rehearing result in six dissenting opinions on our side?
Why are you suggesting nationally, through hundreds of syndicated Associated Press reports, that the Silveira case has a standing issue when it their standing has already been not only validated but built upon with a partial victory? Has Mr. Halbrook been asleep all these months? Shouldn't he know about the history of the case before interjecting negativity? Good luck getting a straight answer. But none of this is surprising -- especially considering the way he tried to force himself, unwanted, into the D.C. gun ban lawsuit. |

In January, we reported on the plight of drivers for Quality Cab Co., Mansfield's only cab company. After two armed robberies in one week, the cab company considered halting services in part of the city.
Obviously, no business enjoys being forced to deny service to a segment of it's customer base, and this move would have reduced revenues for the company.
Fast-forward six months: The Mansfield News Journal is now reporting that Quality Cabs has ceased operations. |

The state of Utah has a mandate allowing teachers to carry concealed weapons on school grounds. Does it make students safer or endanger them?

FULL TEXT BELOW... ------- Missouri Governor Bob Holden traveled to Webster Groves Thursday to veto the bill that would have allowed Missourians to carry concealed weapons.
At Blackburn Park Holden said 70 percent of St. Louis County residents who voted in 1999 said "no" to a similar proposal.
"You and I clearly agree that putting more guns in peoples hands does not reduce crime," Holden said. "Research to the contrary has all been repudiated by respected criminal justice scholars." [Respected by whom, you lying thug?]

Cano testified two cars of officers went to the park and met a sheriff's deputy who already was there. He said they saw Zamora with a pipe and that he asked him repeatedly to put it down.
Cano said he then took out his can of pepper spray, hoping the sight of it would convince Zamora to drop the pipe. Zamora still refused, so Cano sprayed him twice, the officer said.
"I feared for my safety,' Cano said. "I drew out my weapon and fired two shots.' ... -------
