The Second Amendment Foundation (SAF) and Calguns Foundation (CGF) today filed a lawsuit in U.S. District Court for the Northern District of California on behalf of a Santa Clara County resident, challenging the city, its police department and one of its officers over the seizure of firearms under the state’s Welfare and Institutions code. |

A boyfriend gave Michele Crippen a snub-nosed revolver because he thought she should have a firearm.
But he wasn’t much of a teacher, and she didn’t become much of a shooter.
About 15 years later, a childhood friend awakened to an intruder kicking in the door to her home and then the one to her bedroom.
“My friend had to use deadly force,” Crippen said. “She had the right frame of mind and knew how to use a handgun. That .38 revolver truly did save her life.”

The investigation into Smith’s death is on-going, but at this time no charges have been filed against Melendez, and the tone of the article suggests that the reporter interviewing the police didn’t seem to think charges were likely.
Melendez was fortunate that he had a gun accessible to him near his front door. The article does not state whether or not he had his gun in a fast-opening gun safe (keypad-opening gun safes can be had quite inexpensively) or if he simply had his firearm stashed nearby. |

For the second time in less than two months, a lawyer representing opponents of the SAFE Act gun control law has prevailed over the Cuomo administration in efforts to get at records and documents pertaining to the law.
The governor's office is likely to appeal the latest ruling, which focuses on the planning before a rally against the SAFE Act at the Empire State Plaza.
Acting state Supreme Court Justice Michael Melkonian, in a ruling last month, said the administration should provide correspondence among government officials prior to the April 1, 2014, rally during which police confiscated two protest signs that looked like weapons. |

After a visit to a local shooting range where she learned about gun safety and shooting, Colleen Rafatti began to think about buying a gun for home protection.
But in order to properly purchase one, to know what to look for and to learn how to handle a firearm safely, Rafatti decided to get help from the pros. So she signed up for the South Florida State College (SFSC) Criminal Justice Academy’s Concealed Weapons Permit Course.

Two state and national gun rights organizations sued Santa Clara County police and city officials on Thursday over the seizure of firearms after it was learned a gun owner underwent psychiatric treatment.

A grand jury has declined to indict a Salem woman who was accused of shooting a man in the forehead July 22, according to Marion County Deputy District Attorney Jennifer Gardiner, who said she filed paperwork Thursday morning.
The paperwork, known as a not-true bill, dismisses charges against a defendant when a grand jury does not find enough evidence to charge them.

In terms of deterrence, a recent study found that states with higher levels of household gun ownership have higher levels of firearm crime and do not have lower levels of other types of crime.
Another study, in 2003, found that counties with higher levels of household gun ownership have higher rates of household burglary, not lower. Burglars like to steal not only cash and jewelry but also guns. A homeowner with a collection of firearms may not want to advertise that fact. As for thwarting crime, gun advocates claim that guns are commonly used in self-defense, and that without a firearm, one is essentially at the mercy of a criminal. Yet, again, that is not what the data show.

Florida doctors intent on prying into their patients’ gun ownership habits, and those anti-gunners who support such activities, have recently been handed another huge loss—marking another major victory for Sunshine State gun owners.
In the latest action in a long, back-and-forth battle, the 11th U.S. Circuit Court of Appeals in Atlanta lifted an injunction that had blocked enforcement of Florida’s Firearm Owners’ Privacy Act, which barred doctors from asking patients about gun ownership, or keeping records on patients’ gun ownership, unless medically necessary. This is the second time the Act has been upheld by the courts. |

When the Department of Veterans Affairs determines a veteran unable to take care of his financial affairs, it reports the assessment to the FBI’s National Instant Criminal Background Check System (NICS).
Once NICS gets the report, it labels the veteran “incapacitated,” which means that he along with his family members who live in the same household are barred by law from buying or owning firearms.
On July 30, 2015, Navy Veteran John Arnold of Priest River, Idaho, received a letter from the VA informing him that he is no longer allowed to purchase or own guns, and that “an inspector from an Idaho office of Veteran’s Affairs would be coming to his home in Priest River on August 6th to confiscate his firearms.” |
