WA: Court Rules Against WA Gun Control Initiative

A Thurston County Superior Court judge has issued a writ of mandamus against a Washington State gun control initiative because it was improperly presented to voters by not following guidelines set down in state election law.

Alan Gottlieb, founder and executive vice president of the Second Amendment Foundation, said Judge James Dixon ruled properly and he is hopeful the state Supreme Court will uphold the decision.

Americans have a constitutional right to openly carry firearms, a federal appeals court ruled.

A decision by the three-judge panel of the U.S. Court of Appeals for the 9th Circuit over-ruled a decision in Hawaii, and affirmed that carrying a gun in the public sphere is a “core Second Amendment right.”

Steven Kelley, 46, was found dead by deputies who responded Aug. 8 to a call about a shooting at the house in the North Carolina foothills west of Charlotte, authorities said. He was shot twice and killed by his girlfriend’s 15-year-old daughter after he attacked the woman and threatened to kill her and her three children in the home they all shared, the Rutherford County Sheriff’s Office said.

The children’s late father had taught the girl and her siblings how to shoot and safely handle guns, allowing her to effectively use the single-action Colt .45-caliber revolver that had to be cocked between shots, said District Attorney Ted Bell.

Presumably, such “vehement, caustic, and sometimes unpleasantly sharp attacks” on public officials would include, inter alia, showing a film critical of Hillary Rodham Clinton while she was seeking the presidency, publishing material critical of the Obama administration’s climate policies, or advocating the protection of the right enshrined in the Second Amendment. But, of course, the people who are patting themselves on the back today for their championing of the First Amendment are the same people who have celebrated the suppression of such “uninhibited, robust, and wide-open” public discourse, often with the New York Times cheering them on.

Organizers behind gun control Initiative 1639 did not comply with state signature gathering rules, according to a Thurston County superior court judge who ruled in favor of the NRA Friday. I-1639 will now be removed from the November ballot.

“The National Rifle Association is glad to see the court today recognized how negligent, if not worse, gun control advocates were in their signature-gathering for this ill-advised ballot initiative,” said Chris W. Cox, executive director, NRA-ILA.

Online retail site has joined the likes of Facebook and Twitter in terms of blocking the free exchange of ideas—or in this case merchandise—with which it doesn’t agree. What started as a way to target Cody Wilson, that’s hoping to keep the code for 3-D guns off the internet, has now turned into a full-fledged attack on the sale of guns and accessories.

Shopify sent Wilson an email advising him that his Shopify store, defdist.myshopaphi.com, had been closed. A day or so later, it issued a widespread policy essentially shutting down the sale of all guns and accessories on its platform.

Here’s some bad news or good news, depending upon one’s perspective about guns, crime and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The ATF recently released its gun trace data for 2017, which revealed that the National Tracing Center traced more than 400,000 firearms. That’s a lot of hardware, and included in the report was this number: 322,078. That’s the number of firearms recovered and traced by law enforcement in the U.S. and its territories.

That figure amounts to 32,855 more guns than were traced and recovered in 2016. That’s an 11.3 percent rise from one year to the other.

Long ago, I adhered to the philosophy of one of the movie heroes when he said, “A man ought to know his limitations.” Although it pains me to admit it, I have found that I am not any part of a gunsmith, and my attempts to work on guns usually has very negative results. In addition, I have found that the most highly modified firearm available will still not make me shoot like Jerry Miculek. Those facts have made me take a very hard and realistic look at this business of modifying a firearm, especially one designated for personal defense.

On Thursday, over 300 media outlets joined in a coordinated effort to push back against President Donald Trump. That will hardly come as a shock to many Americans, as it seems mainstream news organizations have done little else throughout his tenure in the White House. Indeed, the stunt was perhaps the most vivid and explicit demonstration to date of the mass groupthink, negative Trump obsession, and narrative of victimhood that characterize the modern media landscape.

If there is one constant in the Liberty grabber universe, it’s that half of them are incessantly calling for gun confiscation while the rest deny they are calling for gun confiscation. They also love to parrot the line that it would be impossible to round-up everyone’s guns as a way of deflecting the issue. Except that those on the Pro-liberty side thought the same thing in the UK and Australia. Their Liberty grabber nightmare began with gun registration, under the solemn promise that it wouldn’t lead to gun confiscation. [Sound familiar?] Then of course at the next occasion of a serious crisis, this registration data was used for gun confiscation.

To say that free speech has received much attention of late is a tremendous understatement. The New York Times, for instance, recently published an article entitled “How Conservatives Weaponized the First Amendment.” The gist of the piece, whose title comes from a recent dissent by Supreme Court Justice Elena Kagan, is that free speech has become a tool used by the Right to justify an anti-progressive agenda. However, the article doesn’t address why free speech might have been “weaponized” by conservatives. Perhaps this is a new strategy to discount the Left and sneakily advance a conservative agenda in the courts, or perhaps it is in response to an actual increase in attacks on conservative speech or ideas.

A Thurston County Superior Court judge sided with the NRA and Second Amendment Foundation against a gun-control ballot initiative in the state of Washington.

On July 3, Breitbart News reported that the initiative, I-1639, was being presented as a simple attempt to raise the legal age for long gun purchases from 18 to 21. Although an attempt to disqualify 18- to 20-year-olds from exercising their Second Amendments is troubling enough, the reality of the matter is that I-1639 would have put in place a new system of background checks and myriad other guns controls as well.

Louisiana is using the bond market to stick up for the Second Amendment.

The state’s bond commission voted 7 to 6 Thursday to ban Bank of America Corp. and Citigroup Inc. from working on its upcoming debt sale because of the banks’ "restrictive gun policies," the state treasury said in a statement. Bank of America and Citigroup are the two top-ranked underwriters of long-term municipal debt, according to data compiled by Bloomberg.

A federal appeals court has rejected three University of Texas professors’ claims that the state’s campus carry law and its implementation by the university violate their constitutional rights.

Jennifer Lynn Glass, Lisa Moore and Mia Carter argued that their First Amendment right to academic freedom has been violated because free speech is chilled in classrooms out of concern that someone might be carrying a concealed handgun.

Gov. Bruce Rauner Friday signed legislation that gives gun owners a 60-day grace period to keep their Firearms Owners Identification Card active while their renewal application is being processed, even if the processing period extends beyond the card’s expiration date. Previously, FOID cards were deemed invalid if they expired during the renewal process.

“We shouldn’t punish gun owners who make every effort to get their renewal applications in on time,” Rauner said. “This grace period will ensure there is no interruption in their rights to keep their firearms.”
