A violent domestic incident in Cape Coral has been ruled an act of self-defense after a teenage boy fatally shot his mother’s boyfriend to protect his uncle from a brutal attack. The Cape Coral Police Department has confirmed that no charges will be filed against the minor involved.
The incident unfolded on Tuesday night when 55-year-old Norbert Mess Jr. got into a heated argument with his girlfriend at their home near Northwest 25th Place. Fearing for her safety, the woman called her brother for help. Upon arriving, the brother was confronted by Mess, who was armed with a solid wooden rod and brass knuckles. |

There used to be a prohibition against using excessive force, the court's Republican-majority states in the ruling, which divided the court along party lines. But the GOP majority wrote that they believe North Carolina's Republican-led legislature meant to largely get rid of that prohibition on excessive force when lawmakers rewrote the state's Castle Doctrine rules in 2011. |

A federal judge has dismissed charges against a Kansas man for possessing a machine gun, saying prosecutors failed to establish that a federal ban on owning such weapons is constitutional.
The decision by U.S. District Judge John Broomes in Wichita on Wednesday appeared to mark the first time a court has held that banning machine guns is unconstitutional after the conservative-majority U.S. Supreme Court in 2022 issued a landmark ruling that expanded gun rights.
In that ruling, New York State Rifle & Pistol Association v. Bruen, the Supreme Court established a new test for assessing firearms laws, saying restrictions must be “consistent with this nation’s historical tradition of firearm regulation.” |

But a recent poll conducted by Marquette University Law School in Milwaukee, WI, revealed at least one area of broad agreement: A supermajority in the U.S. supports a right to carry firearms in public for self-defense. The poll questioned 1,005 adults nationwide from July 24 to Aug. 1, 2024, and has a margin of error of +/- 4 percentage points. |

A federal judge ruled in favor of a Kansas man Friday who possessed a machine gun, dismissing the defendant’s charges and deeming them unconstitutional.
Prosecutors charged the defendant, Tamori Morgan, with two counts of illegally possessing a machine gun, according to court documents. The law – 18 U.S.C. § 922(o) – says, “it shall be unlawful for any person to transfer or possess a machinegun.” |

A federal appeals court upheld Maryland’s decade-old handgun licensing law Friday, saying that since it requires that the government issue a license to any law-abiding person, it does not infringe on the Second Amendment.
The majority of the full 4th U.S. Circuit Court of Appeals rejected arguments from gun-rights groups that the state’s handgun qualification license law, or HQL statute, infringes on the Second Amendment because it delays a person’s right to get a gun.
“We reject the plaintiffs’ argument that any delay resulting from compliance with the HQL statute qualifies as ‘infringement,’” Judge Barbara Milano Keenan wrote in the majority opinion for the 14-2 court. |

Judge John W. Broomes, a 2018 Trump appointee, agreed with a motion from the Federal Public Defender Office in Wichita to dismiss a two-count indictment against a local man for possession of a pair of unregistered Post-86 machine guns, arguing the charges went against the "history and tradition of the Second Amendment of the United States Constitution by imposing a blanket prohibition on machineguns," and is thus unconstitutional as applied to the defendant.
Broomes wrote plainly in his 10-page order granting the dismissal of the charges that, "The court finds that the Second Amendment applies to the weapons charged because they are 'bearable arms' within the original meaning of the amendment." |

Days after a two-year-old boy got his hands on a man's unsecured gun and shot him in back, Chesterfield Police are urging residents to make sure their firearms are safely stored.
"Little ones find things, so it’s important to keep things locked up, keep things secured,” Chesterfield Police Corporal Craig Eckrich said.
According to Chesterfield Police, the gun used in Monday’s shooting was left on a chair when the child grabbed it and shot his mother’s boyfriend once in the back. The man was flown to the hospital for treatment. At this time police have made have no updates in the investigation or the condition of the man. |
