EAST BRUNSWICK TWP., Pa. -
An investigation into a deadly shooting in Schuylkill County is now in the hands of the district attorney.

An 18-year-old is dead, and a couple is shaken up after a home invasion in East Brunswick Township turned deadly Saturday evening.

State police say Curt Stein and Melissa Booth came home around 5:30 p.m., and something seemed off.

"The inside of the house looked different," explained State Police Trooper David Boehm, "As if somebody may have been in the house."

"They end up getting into a physical altercation," described Boehm. "The homeowner then shoots the young man."

"It would appear that the rear door in the basement area was kicked in or forced open," Boehm added.

Constructive comment about the conduct or outcome of a criminal trial begins with an accurate recitation of the evidence and the applicable standard of law. Speculation and a misapplied legal standard make no useful contribution. A recent Longboat Key News guest columnist made a heroic effort to characterize Trayvon Martin as an innocent bystander and George Zimmerman as the instigator concerning a tragic event. But neither the trial evidence nor the applicable law support such a characterization.

The city of Ypsilanti has joined its neighbor Ann Arbor urging the legislature to repeal Michigan's "Stand Your Ground" self-defense law.

At its Aug. 20 meeting, the City Council approved 6-1 a resolution calling on the Michigan Legislature to repeal the Michigan Self Defense Act of 2006 and the Firearms and Ammunition Act of 1990. The resolution asks that the state adopt common-sense gun regulations such as improved background checks, strengthened gun-free zones and limits on the sale high-capacity magazines.

The victim, a man in his ’20s, was found with multiple stab wounds in his arms and back wandering outside an apartment complex in Sugar House near 1700 South and 1100 East.

Officers said the victim is in serious condition, but once he’s out of the hospital he’ll likely be going to jail.

Sgt. Robin Heiden, Salt Lake City Police Department, said it appears the victim started the confrontation that ended in a stabbing when he broke into an apartment.

“It does appear that he did force entry in, and that’s when he was stabbed,” she said.

A would-be robber is dead after he attempted to rob a Domino’s Pizza delivery driver in West Melbourne, Florida. Little did he know that the driver was armed with a handgun and was not about to hand over his money.

It was just before midnight Friday night when the driver, 54-year-old Bryon Park, had just delivered pizzas to a room at a Days Inn hotel. He was sitting in his car counting money when he was approached by 32-year-old Fredrick Lorenza Kelly Jr. Armed with a large knife, Kelly demanded money from Park and declared that he would kill Park if he did not hand over the cash.

A man wearing a tea party T-shirt told U.S. Sen. Pat Toomey, R-Pa., at a town hall meeting here Monday that he's "naive" for working with Democrats on gun control.

Wearing a yellow "Don't Tread on Me" shirt, Charlie Horvath, 60, a retired science teacher, cushioned his criticism first, assuring Toomey he largely supports the senator. And Horvath said he doesn't mind the idea of expanding gun background checks but worried it would "[open] the door to further restrictions and violations of our rights" because the Obama administration can't be trusted.

It's supporters said the bill would protect Floridians in the event that an executive order is issued or a federal law is passed that targets specific firearms, ammunition or magazines.

However, after nearly three years of litigation, which probably won't end here, the United States Court of Appeals for the 9th Circuit has just ruled in the Montana "Firearms Freedom Act" case.

The Court invalidated the Montana law.

Gun rights advocates trying to force a ruling to make Illinois' concealed-carry law take immediate effect will have to wait at least more than a month for the decision from a federal appeals court.

The 7th U.S. Circuit Court of Appeals has scheduled arguments on the issue for Oct. 3, though it's unclear how soon that Chicago-based court might then issue a ruling.

Mary Shepard and the Illinois State Rifle Association want the 7th Circuit to immediately allow residents to carry weapons in public, arguing that the months allowed for Illinois State Police to set up the permit process and then sort through applications is untenable and illegal.

A round of gun control bills working their way through the legislature could soon put California back in the lead for the strictest gun laws in the nation. The bills would address a range of issues from banning high-capacity magazines to banning guns from a home if any resident is not allowed to have them. One particularly controversial Senate bill would ban semi-automatic rifles with detachable magazines. Gun control supporters applaud the efforts and say it will cut down significantly on violent crime but gun rights supporters claim the new laws are chipping away at the second amendment.

The first-ever Colorado recall season is in full swing as two Democrats — Senate President John Morse of Colorado Springs and Sen. Angela Giron of Pueblo — defend themselves against an onslaught of political gunfire.

The two lawmakers face recall elections after supporting a package of gun control measures this year at the legislature, including banning high-capacity ammunition magazines of more than 15 rounds and requiring universal background checks and fees.

The recall elections are the first in Colorado history for sitting state lawmakers.

Milwaukee County Sheriff David A. Clarke Jr. told a gathering of about 100 people on Sunday that citizens who use their firearms in self-defense should have their guns returned to them within 48 hours of being cleared of criminal charges.

Clarke was a guest speaker at a free concealed-carry class held at Kochanski’s Concertina Beer Hall, located on the city’s south side, an establishment that made headlines last week after the owner of the tavern, Andy Kochanski, fatally shot a would-be robber.

The famously left-leaning 9th U.S. Circuit Court of Appeals has affirmed the dismissal of a lawsuit against the federal government over its gun restrictions, ruling the plaintiffs failed to state a claim.

The expected decision now clears the way for a battle that could end up in the U.S. Supreme Court over state sovereignty, alleged regulatory overreach, the right to self-defense and even the compact under which Montana became a state.

“This was about as good of a ruling as we could have expected from the Ninth Circuit. We must get to the U.S. Supreme Court to accomplish our goal of overturning 70 years of flawed Supreme Court rulings on the Interstate Commerce Clause,” said Gary Marbut of the Montana Shooting Sports Association.

For the second year in a row, Senate Democratic Leader Chris Smith will try to amend Florida's controversial Stand Your Ground law.

Smith's proposal, SB 122, would prevent individuals from initiating or "unreasonably escalating" a deadly conflict -- and then claiming immunity from prosecution under the self-defense law. Immunity would also be denied to individuals who left a place of safety or chased someone down.

More than 125 East Texans had signed up to participate in Open Carry Tyler’s march by Monday afternoon according to the event’s Facebook page, but organizers said they hoped several hundred more will join the rally.

The Labor Day Open Carry Celebration walk is scheduled to begin about 10 a.m. at the Gregg County Courthouse and organizers, like Matt Thiessen, are encouraging attendees to “join us in a public exercise of our God-given right to self-defense.”

George Zimmerman's tour of the Florida gun factory that manufactured the weapon he used to kill Trayvon Martin has drawn critical reactions from many, including his own lawyers.

Zimmerman visited the Kel-Tec plant in Cocoa, Fla., last week, the same facility that made the PF-9 pistol used in the shooting death of 17-year-old Martin, according to TMZ. The former neighborhood watchman also reportedly inquired about the legality of buying a shotgun during the tour.

This crime spree should not be used to breathe new life into the idea of expanding gun laws that have nothing to do with this incident — namely, allowing people to use deadly force against perceived aggressors in what are presented as “stand your ground” situations. One Iowa lawmaker has previously defended such laws and said “stand your ground” laws are needed to protect people from “frivolous prosecution” when they “choose to defend themselves.”
