Go here to read up on the latest. -------
Submitter's Note: The petition for rehearing and rehearing en banc were filed today. This petition addresses issues ignored, or totally misread by the Panel at the 8th Circuit. This petition seeks redress of that error by the panel. Failing that, a hearing by the entire circuit bench is requested. This case is significiant in that it addresses the issue of military grade, individually employed arms and their coverage under the Second Amendment. |

"The death of a child is horrible and painful, and any decent person would do whatever it takes to save that life. How could an organization called the Children's Defense Fund (CDF) possibly have an agenda that could result in more child fatalities?"
"A recent report by the CDF leads with: 'Firearm Deaths Among Children and Teens Increase for the First Time Since 1994: 3,006 in 2005.' Insisting this ties into the now-defunct Clinton 'assault weapons' ban, CDF says:""According to the most recent data from the Centers for Disease Control and Prevention [CDC], 3,006 children and teens were killed by firearms in 2005, the first increase ... since Congress allowed the Assault Weapons Ban to expire in 2004." ... |

"Advocates of freedom dodged a bullet recently when the U.S. Supreme Court ruled 5 to 4 that the right to keep and bear arms ... is an individual, not a collective, right. Opponents of gun ownership have long maintained that the amendment's reference to the militia indicates that the right does not apply to private persons." ...
"Scalia's opinion goes to the heart of the matter. The Second Amendment recognizes an inherent right that precedes government. It does not purport to create one."
"In his dissent, Justice John Paul Stevens said that since the explicit purpose of the Second Amendment does not include hunting and self-defense, those uses of firearms couldn't have been intended by the framers." ... |

"The Brady Campaign ... praised Senator Barack Obama for highlighting the need for common sense gun laws in his speech accepting the Democratic nomination, specifically addressing easy access to assault weapons:"
"'I was fortunate to be in Mile-High Stadium last night to watch and listen to Sen. Obama's historic speech as he accepted the Democratic nomination for President of the United States,' said Paul Helmke, President of the Brady Campaign ..."

"When it comes to conservation, all gun rights advocates are not created equal. And according to Pat Wray at High Country News, the National Rifle Association (NRA) is the worst of the worst."
"Wray, a life member of the NRA, is running for the organization's board of directors to try to change that. Wray is a hunter who wants his right to bear arms protected, but he also wants wildlife habitat protected, and at this the NRA is failing miserably, he says."
"'The NRA's ability to take money from hunters and use it in ways that will ultimately ruin hunting constitutes one of the most dishonest public relations campaigns ever perpetrated on the American people,' Wray writes." ... |

"Students in this tiny town of grain silos and ranch-style houses spent much of the first couple of days in school this week trying to guess which of their teachers were carrying pistols under their clothes."
"'We made fun of them,' said Eric Howard, a 16-year-old high school junior. 'Everybody knows everybody here. We will find out.'"
"The school board in this impoverished rural hamlet in North Texas has drawn national attention with its decision to let some teachers carry concealed weapons, a track no other school in the country has followed. The idea is to ward off a massacre along the lines of what happened at Columbine High School in Colorado in 1999." ... |

Any would-be shooter knows he will come to the point where he will have to deal with the police. "Sen. Barack Obama's campaign just won't let the gun issue rest. Mr. Obama and his campaign surrogates continue to assure gun owners that he is on their side, and it appears to be paying off. John McCain only leads Mr. Obama among hunters by 14 percentage points, just about half the 27-point lead that President Bush held over John Kerry in 2004. If Mr. McCain had a similar lead, he would be ahead in most polls, particularly in many battle ground states."

"The subject came up in the Democrat Convention, 2008."
"The Democrat view of banning guns will never touch crime, because it focuses on the iron and not the behavior of criminals. It profoundly ties the hands of victims to respond, and this results in scarring injuries numbering in the millions each year. Please visit www.FBI.gov for precise figures on crimes by type, by type of weapon used, and, of course, numbers of gun-related deaths."

"For Republican nominee John McCain, there are a numerous potential political downsides and upsides to choosing a relative unknown for VP. But stepping outside the horserace aspects of 2008, Palin is the most libertarian Republican that's been on a major ticket for a long time.
