This petition seeks redress of that error by the panel. Failing that, a hearing by the entire circuit bench is requested. This case is significiant in that it addresses the issue of military grade, individually employed arms and their coverage under the Second Amendment.

"The death of a child is horrible and painful, and any decent person would do whatever it takes to save that life. How could an organization called the Children's Defense Fund (CDF) possibly have an agenda that could result in more child fatalities?"

"A recent report by the CDF leads with: 'Firearm Deaths Among Children and Teens Increase for the First Time Since 1994: 3,006 in 2005.' Insisting this ties into the now-defunct Clinton 'assault weapons' ban, CDF says:""According to the most recent data from the Centers for Disease Control and Prevention [CDC], 3,006 children and teens were killed by firearms in 2005, the first increase ... since Congress allowed the Assault Weapons Ban to expire in 2004." ...

"Advocates of freedom dodged a bullet recently when the U.S. Supreme Court ruled 5 to 4 that the right to keep and bear arms ... is an individual, not a collective, right. Opponents of gun ownership have long maintained that the amendment's reference to the militia indicates that the right does not apply to private persons." ...

"Scalia's opinion goes to the heart of the matter. The Second Amendment recognizes an inherent right that precedes government. It does not purport to create one."

"In his dissent, Justice John Paul Stevens said that since the explicit purpose of the Second Amendment does not include hunting and self-defense, those uses of firearms couldn't have been intended by the framers." ...

"It is a sight to behold when a journalist is so enthralled by anti-self-defense fantasy that they would contradict themselves and publicly display ignorance of the facts, especially in a newspaper nicknaming itself The Facts."

"Michael Morris, assistant managing editor of the online version of the Brazosport Facts, is not happy with the Harrold school district's decision to allow trained staff carry concealed handguns on campus. ..." ...

"The Centers for Disease Control (CDC) reports that between 1995 and 2005 the accidental firearm death rate for children decreased 60.3%, outpacing the non-firearm drop of 23.1%. These decreases are consistent across categories. ..." ...

"The Brady Campaign ... praised Senator Barack Obama for highlighting the need for common sense gun laws in his speech accepting the Democratic nomination, specifically addressing easy access to assault weapons:"

"'I was fortunate to be in Mile-High Stadium last night to watch and listen to Sen. Obama's historic speech as he accepted the Democratic nomination for President of the United States,' said Paul Helmke, President of the Brady Campaign ..."

"'It was very significant that Sen. Obama directly addressed the gun violence issue in our country. He decided to strike a balance between rights and responsibilities, and showed how we can have common sense gun laws in America to protect our families and communities,' Helmke said." ...

"When it comes to conservation, all gun rights advocates are not created equal. And according to Pat Wray at High Country News, the National Rifle Association (NRA) is the worst of the worst."

"Wray, a life member of the NRA, is running for the organization's board of directors to try to change that. Wray is a hunter who wants his right to bear arms protected, but he also wants wildlife habitat protected, and at this the NRA is failing miserably, he says."

"'The NRA's ability to take money from hunters and use it in ways that will ultimately ruin hunting constitutes one of the most dishonest public relations campaigns ever perpetrated on the American people,' Wray writes." ...

"Five members of the Supreme Court, led by Scalia ... decided to make law rather than interpret the intent of our founders who wrote and approved the Constitution and its initial amendments."

"In this case it was the all-important Second Amendment. It is a single sentence, and is very clear in its meaning if you understand history! ..." ...

"This was written when the American colonies were fighting for their freedom from England and large numbers of English troops were stationed in Boston, and America of course, did not have an army. So how were they to defend themselves? They couldn't initially and thus there was the 'Boston Massacre' of 1770, when Americans protested being taxed without representation[sic]." ...

FULL TEXT ELOW:

Sure enough, Obama touched on guns during his convention address last night:

"… The reality of gun ownership may be different for hunters in rural Ohio than for those plagued by gang-violence in Cleveland, but don’t tell me we can’t uphold the Second Amendment while keeping AK-47s out of the hands of criminals …"

"Students in this tiny town of grain silos and ranch-style houses spent much of the first couple of days in school this week trying to guess which of their teachers were carrying pistols under their clothes."

"'We made fun of them,' said Eric Howard, a 16-year-old high school junior. 'Everybody knows everybody here. We will find out.'"

"The school board in this impoverished rural hamlet in North Texas has drawn national attention with its decision to let some teachers carry concealed weapons, a track no other school in the country has followed. The idea is to ward off a massacre along the lines of what happened at Columbine High School in Colorado in 1999." ...

"No one knows what goes through a person's head when he or she decides to indiscriminately start killing people, but ... although a person may be mentally unbalanced, it does not mean he or she is stupid. ... Any would-be shooter knows he will come to the point where he will have to deal with the police. However, the relevant issue is not whether the criminal will be stopped by the police, because, eventually, he will be. The issue is how many people will die or be injured before the police can stop him." ...

"Sen. Barack Obama's campaign just won't let the gun issue rest. Mr. Obama and his campaign surrogates continue to assure gun owners that he is on their side, and it appears to be paying off. John McCain only leads Mr. Obama among hunters by 14 percentage points, just about half the 27-point lead that President Bush held over John Kerry in 2004. If Mr. McCain had a similar lead, he would be ahead in most polls, particularly in many battle ground states."

"Yet, despite all the Democratic claims to the contrary, Mr. Obama is undoubtedly the most anti-gun candidate ever nominated by a major party for president." ...

"The subject came up in the Democrat Convention, 2008."

"The Democrat view of banning guns will never touch crime, because it focuses on the iron and not the behavior of criminals. It profoundly ties the hands of victims to respond, and this results in scarring injuries numbering in the millions each year. Please visit www.FBI.gov for precise figures on crimes by type, by type of weapon used, and, of course, numbers of gun-related deaths."

"At the Democrat Convention, and in the discussion of automatic weapons, Senator Patrick Kennedy remarked that 30,000 people die from gun violence."

"Mr. Kennedy, America does not see 30,000 gun deaths every year, much less by fully automatic weapons. ..." ...

"As a long-time resident and elected official of Chicago, Barack Obama has seen the impact of fully automatic weapons in the hands of criminals. Thus, Senator Obama supports making permanent the expired federal Assault Weapon Ban. ..." ...

"… or, rather, as libertarian as you can hope for on a major ticket."

"For Republican nominee John McCain, there are a numerous potential political downsides and upsides to choosing a relative unknown for VP. But stepping outside the horserace aspects of 2008, Palin is the most libertarian Republican that's been on a major ticket for a long time. This ideological storyline should appeal to many Western voters." ...

"Wilkinson, jailed for life yesterday, said he was supplying them as props for a Bond movie.
