“Some states have what is known as a stand-your-ground situation, where if someone tries to break into your home, you could use force including deadly force to protect your home. Your home is seen as a castle,” he said.
But Virginia doesn’t have a stand-your-ground law.
“They do have self-defense. And self-defense says as long as you are not the aggressor, you can defend yourself, but you can’t defend property with deadly force,” he said. |

Each year, more than 8,000 people are convicted for unlawful possession of a firearm under 18 U.S.C. § 922(g). About 90% of those cases arose from gun possession by a felon. Firearm prosecutions are reportedly “the third most common federal offense.” Such prosecutions are even more common in some districts, including the Middle District of Tennessee where over 42% of cases involve § 922(g). Section 922(g) is the law that prohibits felons, and certain other groups, from possessing firearms. The Sixth Circuit has now taken a big step in defining the constitutionality of the law, holding that a person only loses his Second Amendment rights under § 922(g) by committing a crime that involves danger to others or the community. |

The Monroe County District Attorney’s Office has determined that a shooting in the Village of Scottsville that killed a 43-year-old was in self-defense.
The shooting happened the early morning of June 30 on Main Street. Sheriff’s deputies say a homeowner shot Scottsville resident Kevin DeFlavis after he broke into the home during a burglary. Deputies also say the homeowner had a no contact order of protection against DeFlavis.
The district attorney’s office reviewed the case and determined this month that the homeowner was justified in his actions. |

Further evidence the gun prohibition lobby is frustrated by federal court rulings upholding the Second Amendment came Wednesday when the Everytown for Gun Safety “Action Fund” joined forces with the Planned Parenthood Action Fund to support federal legislation to create term limits for Supreme Court justices.
The groups have thrown their support behind a bill introduced last year, H.R. 5566, known as the Supreme Court Tenure Establishment and Retirement Modernization Act of 2023. The bill, not surprisingly, has gone nowhere in the U.S. House, which is controlled by as narrow Republican majority. |

“Ghost guns,” which are 3D-printed firearms without serial numbers, will be prohibited across Oregon starting Sunday.
The unserialized guns are assembled at home and can be easily purchased online, but can’t be picked up in a metal detector. The ban comes after a federal judge denied a legal challenge that tried to block the prohibition.
In 2023, the Oregon Legislature passed House Bill 2005 banning ghost guns. Oregon Attorney General Ellen Rosenblum, a Democrat, pushed for years to get legislation banning ghost guns. |

“The frequency in which we are seeing these items among carry-on items is disappointing,” Bart R. Johnson, TSA’s Federal Security Director for 13 airports in Upstate New York, said in a news release. "...We come across these items daily and it slows down passengers who must stop and wait for our officers to remove the offending item and it backs up the line for the other travelers.”
The TSA explained that some of the weapons look more like dogs than cats, but "either way, they are intended to do harm." |

Mississippi’s’ Second Amendment Sales Tax holiday is underway this weekend through Sunday. During the holiday, sales tax will not be collected on purchases of firearms, ammunition, and some hunting supplies.
According to the Mississippi Department of Revenue, “hunting supplies” are the following items when used for hunting: archery equipment, firearm and archery cases, firearm and archery accessories, hearing protection, holsters, belts, and slings. The sale of general hunting supplies is not exempt. Hunting supplies do not include animals used for hunting. |

California Attorney General Rob Bonta today joined a multistate coalition of attorneys general encouraging the U.S. Court of Appeals for the Eleventh Circuit, sitting en banc, to affirm a 2021 district court decision rejecting a Second Amendment challenge to a Florida law that prohibits any person under the age of 21 from purchasing firearms and prohibits federally licensed firearms dealers from selling firearms to anyone younger than 21. The brief, filed in National Rifle Association v. Mecklenburg County Sheriff Garry McFadden has settled a lawsuit that accused him of infringing on Americans’ right to bear arms.
Seven plaintiffs — including Charlotte residents and national gun-rights groups — claimed McFadden’s requests for mental health records made him and his office unconstitutionally slow in processing concealed carry permits.
The requests were “irrelevant,” the 2022 lawsuit claimed, and McFadden took months to more than a year to do “what takes other North Carolina sheriffs days or weeks.” |
