“Some states have what is known as a stand-your-ground situation, where if someone tries to break into your home, you could use force including deadly force to protect your home. Your home is seen as a castle,” he said.

But Virginia doesn’t have a stand-your-ground law.

“They do have self-defense. And self-defense says as long as you are not the aggressor, you can defend yourself, but you can’t defend property with deadly force,” he said.

Each year, more than 8,000 people are convicted for unlawful possession of a firearm under 18 U.S.C. § 922(g). About 90% of those cases arose from gun possession by a felon. Firearm prosecutions are reportedly “the third most common federal offense.” Such prosecutions are even more common in some districts, including the Middle District of Tennessee where over 42% of cases involve § 922(g). Section 922(g) is the law that prohibits felons, and certain other groups, from possessing firearms. The Sixth Circuit has now taken a big step in defining the constitutionality of the law, holding that a person only loses his Second Amendment rights under § 922(g) by committing a crime that involves danger to others or the community.

But between concerns about his personal liability and ambivalence about the new law from local school leaders, he won’t be carrying his pocket-size gun to class this school year.

And because of the way Tennessee’s new law was written, he said, “I don’t expect anybody to take advantage of it.”

Indeed, for all the protests and discord over the legislation before it passed, there’s little talk among school districts or educators about using the option to arm teachers or staff as the new academic year begins. Not a single school system has indicated that it’s planning or working to train employees to carry a gun voluntarily under the new law, according to dozens of school and law enforcement officials contacted by Chalkbeat.

The Monroe County District Attorney’s Office has determined that a shooting in the Village of Scottsville that killed a 43-year-old was in self-defense.

The shooting happened the early morning of June 30 on Main Street. Sheriff’s deputies say a homeowner shot Scottsville resident Kevin DeFlavis after he broke into the home during a burglary. Deputies also say the homeowner had a no contact order of protection against DeFlavis.

The district attorney’s office reviewed the case and determined this month that the homeowner was justified in his actions.

Further evidence the gun prohibition lobby is frustrated by federal court rulings upholding the Second Amendment came Wednesday when the Everytown for Gun Safety “Action Fund” joined forces with the Planned Parenthood Action Fund to support federal legislation to create term limits for Supreme Court justices.

The groups have thrown their support behind a bill introduced last year, H.R. 5566, known as the Supreme Court Tenure Establishment and Retirement Modernization Act of 2023. The bill, not surprisingly, has gone nowhere in the U.S. House, which is controlled by as narrow Republican majority.

“Ghost guns,” which are 3D-printed firearms without serial numbers, will be prohibited across Oregon starting Sunday.

The unserialized guns are assembled at home and can be easily purchased online, but can’t be picked up in a metal detector. The ban comes after a federal judge denied a legal challenge that tried to block the prohibition.

In 2023, the Oregon Legislature passed House Bill 2005 banning ghost guns. Oregon Attorney General Ellen Rosenblum, a Democrat, pushed for years to get legislation banning ghost guns.

“The frequency in which we are seeing these items among carry-on items is disappointing,” Bart R. Johnson, TSA’s Federal Security Director for 13 airports in Upstate New York, said in a news release. "...We come across these items daily and it slows down passengers who must stop and wait for our officers to remove the offending item and it backs up the line for the other travelers.”

The TSA explained that some of the weapons look more like dogs than cats, but "either way, they are intended to do harm."

An Aug. 25 Facebook post (direct link, archive link) shows quotes purportedly from Vice President Kamala Harris and Minnesota Gov. Tim Walz about gun restrictions.

"'I will use an executive order to end the second amendment.' – Kamala Harris," one quote reads.

"'We will confiscate all weapons of war starting with AR15's.' – Tim Walz," reads the other.

The post includes photos of Harris and Walz, the Democratic nominees for president and vice president, set against the Venezuelan flag.

Mississippi’s’ Second Amendment Sales Tax holiday is underway this weekend through Sunday. During the holiday, sales tax will not be collected on purchases of firearms, ammunition, and some hunting supplies.

According to the Mississippi Department of Revenue, “hunting supplies” are the following items when used for hunting: archery equipment, firearm and archery cases, firearm and archery accessories, hearing protection, holsters, belts, and slings. The sale of general hunting supplies is not exempt. Hunting supplies do not include animals used for hunting.

California Attorney General Rob Bonta today joined a multistate coalition of attorneys general encouraging the U.S. Court of Appeals for the Eleventh Circuit, sitting en banc, to affirm a 2021 district court decision rejecting a Second Amendment challenge to a Florida law that prohibits any person under the age of 21 from purchasing firearms and prohibits federally licensed firearms dealers from selling firearms to anyone younger than 21. The brief, filed in National Rifle Association v. Commissioner, warns that an opinion of the full court striking down the Florida law could undermine efforts by states to protect their citizens through the application of similar age limitations laws.

A federal appeals court on Wednesday upheld a district court ruling that the prohibition on firearm possession by marijuana users is unconstitutional.

A three-judge panel of the 5th Circuit Court of Appeals in the case U.S. v. Connelly said the Texas woman involved in the action was a “non-violent, marijuana-smoking gun owner” whose Second Amendment right to keep and bear arms should not have been infringed.

One of the most popular booths at this year’s Minnesota State Fair bears a simple sign: “Never Walz.” The booth offers t-shirts and prizes for fairgoers – all emblazoned with the “Never Walz” logo. The line for the booth grows so long at times that it poses traffic problems for police officers patrolling the fairgrounds.

Mecklenburg County Sheriff Garry McFadden has settled a lawsuit that accused him of infringing on Americans’ right to bear arms.

Seven plaintiffs — including Charlotte residents and national gun-rights groups — claimed McFadden’s requests for mental health records made him and his office unconstitutionally slow in processing concealed carry permits.

The requests were “irrelevant,” the 2022 lawsuit claimed, and McFadden took months to more than a year to do “what takes other North Carolina sheriffs days or weeks.”

A disturbing video surfaced on Wednesday, showing a heavily-armed mob terrorising an apartment in Aurora, Colorado.

The footage show a man in a hoodie, carrying a high-powered rifle, pounding on a door, while several others with pistols follow, seizing the apartment number 301. The men can be seen knocking at the door the door and entering inside the apartment.
