Bruce and Donna Montague will finally have the opportunity to prove the Firearms Act is unconstitutional.
Preparations for the trial have been increasing in intensity since constitutional lawyer Doug Christie joined the case in April. |

Worryingly, one real fear is starting to emerge, hitherto whispered only in academic and extremist circles. If Dawkins et al insist with their zeal to promote evolutionary theory as an inherently atheistic doctrine -- which could be construed as a matter of faith -- he may well be handing a rope to the creationist brigades. The US Second Amendment forbids the teaching of faith in schools and it would be at least ironical if the creationists could use that to evict Darwin from the classroom Ed.: And you thought American anti-gunners twisted the meaning of the second amendment! |

A national pinch on ammunition supplies because of heavy military demand and metal shortages has become an administrative headache for some area police departments, which have reduced firearms training. Despite the lack of inventory, however, police say they're still ready and able to do their jobs. "It has slowed down our ability to acquire ammunition, all kinds of ammunition," said New York State Police spokesman Lt. Glenn Miner. "We haven't experienced any shortages, but we're adjusting our reorder schedules." For the 4,900-member State Police, the supply issues have not affected any operations or rifle range use, but orders are being placed further in advance, Miner said. |

According to the New York State Rifle and Pistol Association, the most widely used ammunition caliber in the world is the venerable .22-caliber. It's easy to understand why. Not only are .22-caliber rimfire rifles used to teach beginners the principles of marksmanship because of their light weight and virtually no recoil, this caliber size is affordable (2 to 3 cents a round) and versatile. Recreational "plinking" guns and highly technical firearms used in the Olympic Games competition are .22-caliber. |

Local gun store and pawn shop owners say they are selling more guns than usual. The Montgomery Police Department and a private self-defense teacher have seen an increase in the number of people wanting to learn how to use guns. Residents of the tri-county area say they are afraid. Montgomery Police Chief Arthur Baylor has said the public apprehension that crime is out of control in Montgomery is more perception than reality. Crime in general is down, he has said, but an unusually high homicide rate and the resulting media attention has created a false sense of insecurity. Nevertheless, people who sell guns say business is booming. |

"...This declaration of rights, I take it, is intended to secure the people against the mal-administration of the Government; if we could suppose that, in all cases, the rights of the people would be attended to, the occasion for guards of this kind would be removed. Now, I am apprehensive, sir, that this clause would give an opportunity to the people in power to destroy the constitution itself. They can declare who are those religiously scrupulous, and prevent them from bearing arms...."

WATERLOO — The steel targets 40 yards away started out as large as a sheet of legal notebook paper and got as small as an orange.
Squeezing my left eye shut, controlling my breathing, concentrating as if I were a diamond cutter, I focus the targets through the small scope mounted on the handsome Ruger 10/22 carbine I've been handed. I aim and slowly squeeze the trigger. Moving left to right, one by one, all 10 targets fall. |

There was a disappointing turnout today in a gun drop off program hosted by Rochester city churches. The "No Questions asked" drop-off is an effort to reduce violence. Last month, people turned in more than 100 illegal weapons. Today, only five were collected. Nicholas Gonzales, the pastor at First Pentecostal church, hosted one of the sites. "We want the guns off the street...so people are not getting hurt," he said. Like last time, Wegmans offered a $50 gift card to the first 100 people who turned in a gun. |

MIAMI - Patrol officers will have the option of carrying assault rifles as police try to combat the rise in the use of similar weapons by criminals, Miami's police chief said Sunday.
ADVERTISEMENT Police Chief John Timoney approved the new policy last week, before a Miami-Dade police officer was killed in a shootout with an assault rifle-wielding suspect on Thursday.
"This is something we do not do with any relish. We do this reluctantly," Timoney said.
The policy had been under review for about a year due to officers seeing an increase in the weapons, Timoney said.
Officers interested in the guns will have to undergo two days of training and be certified to use the weapons. The police department doesn't yet have |

Constitution Day commemorates the Sept. 17, 1787, signing of the U.S. Constitution. It is also Citizenship Day.
...
Opponents of the death penalty say it violates the Eighth Amendment's prohibition of "cruel and unusual punishments." An amendment making it an offense to burn the flag might violate the First Amendment's freedom of speech clause. Some argue that court decisions upholding federal gun control laws amend "the right of the people to keep and bear arms" clause in the Second Amendment. |

That same Constitution is the document setting up the system of checks and balances that enables the courts to temper the excesses of the legislative branch and equally gives legislators and the people of the nation the power to amend the document when they disagree with court interpretations. It is the Constitution that grants to our president great power but does not allow the chief executive to be a king, and that gives states great power but not to the point of making laws that override the basic tenets therein.
...
Through its Bill of Rights, the Constitution guarantees freedoms such as speech, religion and assembly, it mandates fair trials, it outlaws slavery and it allows citizens to bear arms. |

Whenever the debate about gun control comes up, I always hear the following arguments: "If someone is going to kill another person, they're going to do it whether they have a gun or not, so why put more restriction on guns?" "Even if you make it illegal to own guns, they're going to find one anyway." OK, I'm hearing you. I understand. Do you have any other points? |
