MI: Oakland County Board of Commissioners approve gun buyback program

As the state tries to combat the rise in gun violence, Oakland County joins the list of areas implementing a gun buyback program.
The Oakland County Board of Commissioners approved funding for the program with a 14 to 4 vote Thursday night.
This means going forward, police departments will host events where people can exchange unwanted firearms for money.
“We’ve gotten a lot of positive response from policing agencies and from community members. It’s been fantastic,” Oakland County Commissioner Charlie Cavell said.
Southfield, Royal Oak, Ferndale, and Bloomfield Hills are some of the areas that voted yes on the $45,000 going towards the pilot program. |

Most America’s 1st Freedom readers are well aware that anti-gun politicians, gun-ban advocates, and the so-called “mainstream” media tend to play fast and loose with the facts. One specific area where they tend to flat out lie is in the frequency of armed self-defense episodes by law-abiding Americans.

Most significantly, and in a blow to the law's future, the judge singled out a brief section of the CCIA, its so-called "good moral character" clause.
"No license shall be issued or renewed except for an applicant ... of good moral character," the clause reads. Such an applicant will use the weapon "only in a manner that does not endanger oneself or others," it reads.
The vague requirement of "good moral character" is fatally similar to the New York carry-permit application language the Supreme Court struck down as unconstitutional in June, Suddaby wrote.
And the insistence that a gun could only be used "in a manner that does not endanger oneself or others" ignores what guns are all about, the judge wrote. |

After a federal judge said New York could implement gun restrictions passed after the US supreme court struck down a century-old law, the state attorney general saluted “a victory in our efforts to protect New Yorkers”.
“Responsible gun control measures save lives and any attempts by the gun lobby to tear down New York’s sensible gun control laws will be met with fierce defense of the law,” Letitia James said on Wednesday night. |

Sheriff Nathan Harmon is a firearms instructor with the National Rifle Association and a staunch supporter of the Second Amendment. So when he first heard about the Biden administration’s rule cracking down on “ghost guns,” he was fairly apprehensive. But when asked about its recent implementation and the effect it might have on law enforcement, Harmon said the policy will enable him and the rest of the Berkeley County, W.Va., Sheriff’s Department to better address firearm-related crimes.
“Yeah, it will help,” Harmon told me. “I’m used to serialization, and I don’t mind it. It’s been a benefit in terms of solving crimes … so I do appreciate it on those levels.” |

The man then described smacking the gun away and drawing a sidearm from his holster before opening fire on the group. He told police he shot McKinzey, fired at Williams and then shot Ellis as the young man appeared to be “pointing a gun at him” from the ground, a detective wrote in court papers. After leaving the scene, the man said he drove to his Kansas City home and put two AR-15s from his vehicle on the living room table. He then had a friend drive him to the Kansas City police station.

Recent mass shootings with high death tolls have renewed the gun debate in New Jersey.
Whether to regulate military assault-style weapons, the type used in a spate of deadly mass shootings, has been the focus of congressional inquiries and a proposed ban that passed the House of Representatives.
The legislation would restore the 1994 Assault Weapons Ban that was allowed to expire in 2004, making it illegal to sell, manufacture, transfer, possess or import assault weapons or large-capacity ammunition feeding devices. It has been referred to the Senate, where 10 Republicans would have to join Democrats to overcome a filibuster. |

A man was found not guilty of assault with intent to murder and felony firearm after a trial determined there was ample evidence to believe he was acting in self-defense when he shot a female friend in his own home. The acquitted, Cody Nelson, was facing a life sentence.
In the years-long court battle, attorneys defending Nelson relied on the eyewitness testimony of others that Nelson shot Alyssa Martin because she was a former resident of the home with Nelson and knew where a gun was located in the home. Nelson claimed that he was fearful that Martin was going to use the gun against him. |

And that protection is not redundant of more property-focused protections. For instance, the Takings Clause allows seizures so long as the government pays “just compensation.” But the Second Amendment appears to forbid “disarm[ing] private citizens” even if the government compensates those citizens for their property. Cf. Heller, 554 U.S. at 591–92. The other guarantees do not prevent this one from applying too.
This is a strong ruling restoring Second Amendment rights. As a Circuit Court ruling, it is a precedential ruling which applies to the entire Third Circuit. The Third Circuit includes Pennsylvania, New Jersey, Delaware and the District of the Virgin Islands. |

So, the county’s resolution reaffirms it support for the Second Amendment to the US Constitution and says licensed persons may carry unless prohibited by statute or owner declaration.
And as far as the county buildings are concerned, the resolution states the county manager will have the authority to determine which county properties will permit licensed gun owners to possess and carry a firearm on those properties. |

A federal judge temporarily blocked Boulder County from enforcing its ban on some semi-automatic weapons and large capacity magazines, delivering a win to a Colorado gun-rights group in its pursuit to challenge gun restrictions in the wake of a recent U.S. Supreme Court decision.
U.S. District Court Judge Charlotte Sweeney issued the temporary restraining order on Tuesday, concluding that the plaintiffs, the Loveland-based group Rocky Mountain Gun Owners and its legal arm, the National Association for Gun Rights, have a “substantial likelihood of success on the merits” to challenge the constitutionality of the Boulder County ban. |

Chicago is one of the nation’s gun violence hotspots and a seemingly ideal place to employ Illinois’ “red flag” law that allows police to step in and take firearms away from people who threaten to kill. But amid more than 8,500 shootings resulting in 1,800 deaths since 2020, the law was used there just four times.
It’s a pattern that’s played out in New Mexico, with nearly 600 gun homicides during that period and a mere eight uses of its red flag law. And in Massachusetts, with nearly 300 shooting homicides and just 12 uses of its law. |

Late last night, the California Legislature adjourned sine die, ending the 2022 session. Fortunately, despite efforts by anti-gun politicians to push through more gun control, Assembly Bill 1227 (Excise Tax) and Senate Bill 918 (CCW Reform) failed to pass. This is a huge win for law-abiding gun owners not having additional costs, burdens, and restrictions that AB 1227 and SB 918 proposed. Thank you to everyone who contacted their legislators and the broad coalition of groups working to defeat these misguided anti-gun bills. |

Pasadena police are illustrating a story of survival involving a woman shooting and killing a stranger whom they say threatened her co-worker.
The armed woman, whom police did not identify, was also attacked by the suspicious man when she intervened just after 12:15 a.m. on Wednesday in the 1400 block of South Houston Road, near West Southmore. The address points to a complex that houses Nexeo Solutions and ST Labs.
According to police, the armed woman's co-worker left the business through an electric gate when she saw a man hitting a side window of her car with his fist. He then yelled at the co-worker. |

Faced with an area of law that is both fast-moving and of great concern for many Americans, many employers find themselves confronting whether they should implement a weapons-in-the-workplace policy and, if so, what that policy can or should look like.
Will the employer ban all weapons, whether held by customers or employees, from its premises? As noted above, no state law restricts an employer, in its capacity as a private entity, from prohibiting weapons in the workplace, so long as the employer operates within the confines of the parking lot and signage laws previously described. |

We may be the targets of illegal oppression, but we don’t have to be accomplices to it.
Beginning today, carrying handguns is prohibited almost everywhere in the state of New York. They can’t be carried on public property, and they can’t be carried on private property unless the owner or lessee posts a large sign declaring that they are welcome.
When you eliminate public property and private property, that’s all property, and the New York concealed carry permit becomes meaningless anywhere but in your home and in your car – unless it’s parked in a school, hospital or government parking lot, where it’s illegal. |

Democratic lawmakers in California failed to replace an existing gun control bill that the U.S. Supreme Court ruled unconstitutional Thursday, leaving the state's concealed carry regulations unenforceable.
The legislation failed to pass the California Assembly by a single vote early Thursday morning. California Attorney General Rob Bonta lamented that Californians currently have nearly unfettered access to concealed carry permits following the failed vote. |

But legal experts say that's incorrect — the Supreme Court has not yet had the final word on age restrictions for any type of weapon.
At least seven states — California, Florida, Hawaii, Illinois, New York, Vermont and Washington — have passed legislation raising the legal purchase age for sales of long guns, and several cases regarding those laws are winding their way through the courts.
“It’s an unsettled question whether states can restrict guns to people under 21,” said Adam Winkler, a UCLA law professor who studies gun policy. “There are court cases going both ways ... This is one of many issues the Supreme Court is going to have to take up in the coming years.” |

And that is indeed the case, according to Paula S. Fogarty, executive director of Savannah Jazz, the organization that stages the festival. She said that webpage – which has since been taken down – was outdated and should not have been accessible to the public anymore. And, she said, the festival has no gun policy, instead following all state and City rules. Carrying a firearm for self-defense is only part of the solution. An even bigger part of your defensive plan is knowing when to draw said firearm to protect life. Once the legal and moral requirements have been met, it is all about how you draw your firearm from the holster. The idea is to draw the firearm quickly enough to make a difference, but not so fast you worsen the situation. While there is no getting around practicing, you want to practice correctly, or what I call authentically. There is an old saying in the training community: “Be careful what you practice; you can get really good at practicing the wrong thing.” |

Rifles with a barrel length less than 16 inches and suppressors are heavily regulated by the federal government. With very rare exceptions, primarily for law enforcement and licensed dealers and manufacturers, they are effectively prohibited.
Regarding short-barreled rifles, Dorman’s suit states that prior to 1934 — when the National Firearms Act first regulated them — the rifles and handguns equipped with shoulder stocks were common. The suit states those arms are covered under the Second Amendment’s right to keep and bear arms. |
