While the bench trial for Illinois’ gun and magazine ban is over, the reverberations could impact a separate lawsuit against banning firearm silencers.

Litigants in the trial that wrapped up Thursday argued over the difference and similarities of now banned semi-automatic only firearms and military rifles that go full auto or burst. Plaintiffs worked to address the issues raised by the Seventh Circuit U.S. Court of Appeals that sided with the state on preliminary grounds last year, saying semi-automatic firearms are too similar to military firearms and can be banned.

Citing self-defense, prosecutors have declined to charge a Hawaii man who was arrested on suspicion of murder after shooting a neighbor who opened fire at a gathering, killing three women.

Prosecutors declined the case Wednesday “due to issues related to self-defense and defense of others,” Honolulu police said in a bulletin update.

The deadly Aug. 31 shooting stemmed from a neighborhood dispute in Waianae, a community about 30 miles (48 kilometers) west of downtown Honolulu.

No charges will be filed in connection with a deadly shooting in July at an apartment near the University of Denver.

According to Denver Police, a resident returned to an apartment inside One Observatory Park around 1 a.m. on July 21 and was startled by an intruder. The apartment building is on East Evans Avenue, just east of South University Boulevard.

The resident shot the intruder, who died at the scene, police said. The man, identified as 27-year-old Nelson Kimathi, died from multiple gunshot wounds, according to the coroner's office.

This week, Denver Police Department said it presented the findings of its investigation to the Denver District Attorney's Office. Prosecutors declined to file charges, authorities said.

In the wake of tragic school shootings like Apalachee High School in Georgia, our nation grapples with a critical question: How do we best protect our children?

Sadly, too often, the debate devolves quickly into partisan talking points. The Biden-Harris administration seized on this tragedy to call for more laws that would restrict Americans’ right to self-defense, but which would have done nothing to stop this shooting. In fact, at both the federal and state levels, it is already illegal for a 14-year-old to purchase and possess a firearm, but, neither those laws nor others, like the Gun-Free School Zones Act, deterred this evil.

"Let's say we want to commit an assassination," he said Thursday, scrolling through the site of an online gun vendor. "I need a rifle, so I press 'Rifle.' "

An assassin on deadline might not want to travel far, he said, so he filtered the results to only those in Florida. The list narrowed, but it still included reputable dealers — ones whose federal firearms licenses require them to perform a background check on potential buyers. He filtered those out, too.

With three clicks and in fewer than five minutes, Chipman procured a list of nearly 300 rifles for sale without paperwork to complete or proof of identification; ideal for the criminally inclined.

When Christopher Peterson of Inkster, Michigan, had to pull his firearm and shoot his mother’s ex-boyfriend on July 3, he likely had no idea he’d be charged with second-degree murder and have a court fight on his hands.

Thankfully for Peterson, two months after the incident, a district court judge ruled the shooting to be self-defense and dropped the charges against him.

A 2023 Pew Research Center poll on gun ownership and public safety in America indicated that the overwhelming majority of Democrat and Democratic-leaning adults (86%) felt the nation’s gun laws should be even more strict. The same poll asked whether gun ownership did more to increase public safety by allowing law-abiding citizens to protect themselves, or tended to reduce safety by giving too many people access to firearms and increasing misuse. More than three out of four Democrats/Democratic leaners (78%) responded that gun ownership did more to decrease safety. There is no correlation between firearm-related deaths (including homicide, suicide, unintentional, and law enforcement) and gun lobbying (for or against gun control). Essentially, feel-good legislation is ineffective but quite profitable.

Despite the hesitancy from lawmakers, firearm storage laws have been ruled constitutional. In the landmark 2008 case District of Columbia v. Heller, the U.S. Supreme Court ruled that an individual’s right to bear arms was not tied to service in a militia, while also clarifying that certain restrictions on ownership — including storage — did not violate the Second Amendment.

Opponents of a major new gun law say they have collected a bit less than half of the signatures they need by early next month to suspend the measure until voters would potentially get a chance to decide its fate in 2026.

A group of gun owners and Second Amendment supporters, who dubbed themselves The Civil Rights Coalition, said Thursday they are “very confident” about gathering enough voter signatures before an Oct. 9 deadline that marks the next hurdle en route to giving voters the final say on one of this legislative session’s most sweeping laws.

A significant legal battle is set to take place next month as the 11th U.S. Circuit Court of Appeals hears challenges against Florida's law limiting gun purchases for individuals under 21. Vice President Kamala Harris’ senior advisor, Keisha Lance Bottoms, repeatedly stated Friday on CNN the vice president’s comments about shooting intruders were “a joke,” claiming she knew it would be in the news cycle.

During a Thursday interview with Oprah Winfrey, Harris said she would shoot a home intruder before laughing and admitting she “probably shouldn’t have said that.” On “The Lead With Jake Tapper,” Bottoms emphasized how the vice president was joking and highlighted her support for “the Second Amendment” in response to Tapper’s push back about the comment.

Video footage of a press conference from 2007 showing then-San Francisco District Attorney Kamala Harris extolling the virtues of a law she helped draft provided a horrifying vision of the presidential hopeful threatening gun owners. If you’re looking for someone to blame for the gun violence that has left our schools, streets, and communities soaked in blood, don’t point just at the National Rifle Association and their lackeys in the Republican Party. Raise another finger, ideally your middle one, toward a Supreme Court that has enabled the unceasing rise of gun-related carnage in all its ever-more-obscene forms.

His girlfriend had asked him to teach her how to use the gun, according to an arrest affidavit obtained by WESH 2.

While demonstrating the use of a rifle, Boileau says he “accidentally” fired the loaded gun, killing the woman.

“I know this looks really bad," Boileau said, according to the arrest affidavit. “I told her I did not want this to happen...I did not want to train her in the (expletive) house like this.”

A search warrant was executed at the house and officers say physical evidence at the scene corroborates Boileau’s account of the events.

Boileau was arrested and charged with manslaughter.

On Thursday, the judge denied Paxton's request for an injunction to stop the firearms ban. Lawyers for Paxton's office declined to say whether they'd appeal. But attorneys for the State Fair say they are prepared.

"Obviously, this is still pending litigation," attorney Robert Smith said. "Obviously, we're very pleased with the judge's ruling. We think it's the right ruling. But we still have a ways to go. And this is going to continue."

But for now, "licensed to carry" doesn't include the State Fair of Texas.

A stunning video from 2007 featuring then San Francisco District Attorney Kamala Harris threatening to enter the locked homes of gun owners to determine whether their firearms were “safely” stored is facing heavy criticism from gun rights advocates.

Harris, flanked by then-San Francisco Mayor Gavin Newsom, told reporters during a press conference about gun control, “Just because you legally possess a gun in the sanctity of your locked home doesn’t mean that we’re not going to walk into that home and check to see if you’re being responsible and safe in the way you conduct your affairs.”

Which brings us to the other thing she said.

It is obviously true that if someone were to try to break into Harris’s house at this point, they would be shot. She’s the vice president! That fate wouldn’t be a function of Second Gentleman Doug Emhoff winging an intruder with his Glock; it would be multiple Secret Service agents letting their training kick in.

But research has shown that injuries to intruders are a relatively uncommon result of gunfire in homes.

It's this spike that prompted the Biden Administration to pass a rule, through the ATF, banning these kinds of firearms without serial numbers. Now the Supreme Court will decide the federal rule's legitimacy.

"The question in front of the Supreme Court is whether that rule is a valid exercise of the ATF's authority or whether they exceeded their authority," said Tirschwell.

If the Supreme Court overturns the federal ghost gun regulation the existing laws in states like Oregon will still stand, and Congress would have to weigh in on a federal rule.
