Vice President Kamala Harris backed a total ban on handguns in San Francisco, California, during her time as the city’s district attorney, according to a story published in the San Jose Mercury News in 2005.
Harris backed San Francisco Proposition H, which would have enacted a total ban on possessing a handgun in San Francisco with few exceptions, as well as the sale, possession, manufacturing and distribution of all firearms and ammunition in the city, according to San Jose Mercury News. Her past support for the measure stands in contrast to her recent insistence during her 2024 presidential campaign that she is “not taking anyone’s guns away” if elected. |

A significant point of legal debate is whether the weapons covered by the Illinois law have historical precedent dating back to the Constitution’s founding, a standard set by the Supreme Court in the 2022 case New York State Rifle & Pistol Association v. Bruen.
In closing arguments, plaintiffs’ attorney Andrew Lothson argued that the law is unconstitutional because all items included are useful for self-defense, while Illinois Attorney General’s office representative Kathryn Hunt Muse contended that the banned assault-style weapons share functional similarities with military rifles like the M4 and M16.

U.S. President Joe Biden will sign an executive order on Thursday to combat increasing threats from firearms and improve school-based active shooter drills, while setting tight deadlines for further action, the White House said.
Biden and Vice President Kamala Harris will announce the order at the White House, their first gun-related event together since Biden named Harris to oversee an office on gun violence prevention created one year ago, a White House official said.
The event will be attended by gun violence survivors, activists and long-time allies of Biden, who has worked to reduce gun violence for over three decades, the official said. |

While the federal lawsuit is still pending, it depends on how Maryland law defines “reasonable grounds” in the state’s ERPO law. The U.S. District Court has asked the Maryland Supreme Court to interpret the term before the federal case continues. The court is being asked to clarify two legal questions: What legal standard does “reasonable grounds” imply in Maryland’s red flag law, and can an ERPO be issued based on a standard less than probable cause?
“This case is about how so-called ‘red flag laws’ can be weaponized against private citizens,” said SAF founder Alan M. Gottlieb. “We’re asking the Maryland high court to define the meaning of ‘reasonable grounds’ in the state ERPO statute to help make our case in federal court.” |

During a White House event Thursday, Biden is expected to sign an executive order designed to address the trauma inflicted on children by active shooter drills in schools as well as tackle the threat of machine gun conversion devices, which are small devices that can be made with a 3D printer and turn a handgun into a fully automatic weapon. The actions are timed to this week’s one-year anniversary of Biden’s creation of the first-ever office of gun violence prevention — which he launched, in part, to identify additional ways to tackle gun violence from the executive branch without Congress. |

In a unanimous opinion, the Illinois Supreme Court says Illinois State Police can revoke a person’s Firearm Owners Identification card once they’ve been charged with a felony.
Capitol News Illinois reports the case involves a father and son who were charged with felony reckless discharge of a firearm for shooting their guns in the air over Fourth of July weekend in 2016.
Their FOID cards were revoked, but when the charges were downgraded to misdemeanors and they pleaded guilty, their FOID cards were re-issued. The pair then sued the state, claiming they were denied their Second Amendment rights to self-defense during the time they were facing felony charges. |

Too many federal courts engage in a quiet or open mutiny against SCOTUS authority. SCOTUS must correct one such rebellion by a panel of the Sixth Circuit Court of Appeals by granting certiorari in Oakland Tactical Supply v. Howell Township, a Michigan case.
In Oakland Tactical, the company was denied permission by Howell Township, using zoning regulations, to create and operate a 1,000-yard shooting range. Other circuits have examined this question and have determined that the Second Amendment protects ancillary items and activities related to the core and reserved constitutional right, including the right to practice and train with firearms.

The Ninth Circuit has once again shown its hand in dealing with Second Amendment matters. This time they went so far as to treat both the First Amendment and the Second Amendment with disdain in a combined case on banning gun shows in California.

On September 25th, U.S. Senator Jim Risch (R-Idaho) introduced the Modern Firearms Safety Act, a bill aimed at prohibiting states from enforcing handgun rosters. These rosters, which include lists of pre-approved handguns, often require manufacturers to incorporate features such as microstamping, loaded chamber indicators, and magazine disconnect mechanisms. According to Senator Risch, these requirements hinder the ability of law-abiding citizens to purchase firearms of their choice and pose unnecessary burdens on manufacturers. |

California governor Gavin Newsom signed an extensive slate of gun-control bills on Tuesday aimed at imposing stricter penalties on people whose firearms are accessed by minors and bolstering the state’s red-flag laws which allow law enforcement to temporarily seize weapons from people deemed dangerous, among other measures.
California already has some of the strictest gun laws in the U.S., even without the legislative package of 24 new bills signed into law. Gun-rights supporters opposed some of the new measures. |

A newly created state appeals court denied Texas Attorney General Ken Paxton request to temporarily block the State Fair of Texas’ policy banning all firearms from its fairgrounds as the event is set to start Friday.
The ruling comes after a Dallas County District Court struck down a similar request from Paxton on the new policy. The District Court Judge agreed with State Fair officials that they could enforce a gun ban as a private nonprofit.
Ed.: AG Paxton appealed to the Texas Supreme Court yesterday. |
