U.S. Rep Marc Molinaro criticized Tuesday New York state’s concealed carry gun laws as an infringement on constitutional rights.
Molinaro, R-Catskill, responded to Gov. Kathy Hochul’s pledge in a posting on X, formerly Twitter, to keep the Concealed Carry Improvement Act in place.
“Justice Clarence Thomas just granted a request for an emergency conference in a case trying to dismantle our concealed carry law,” Hochul said on X. “I know the far-right is focused on placating the MAGA extremists. I’m focused on protecting New Yorkers.”
But Molinaro, who represents the 19th Congressional District, said the law, known as Concealed Carry Improvement Act, was wrong.
“Your law is unconstitutional,” Molinaro responded on Tuesday night. |

A Georgia homeowner shot an early morning intruder twice to defend himself and his family; the intruder is suspected of having fatally stabbed a 77-year-old woman.
A homeowner in Fayette Country, GA, was home with his family on the morning of Sept. 14. He heard what sounded like an intruder in their basement, so he called the police to report the break-in and armed himself with a handgun.
He confronted the intruder in the basement and found that he was armed with a knife. He warned the intruder and fired one shot, hitting the armed intruder. The homeowner then retreated to the top of the basement stairs to protect his family on the second floor. |

The man who was fatally shot in an alleged act of self-defense at a Colorado Springs apartment complex Monday has been identified, according to a Wednesday announcement from the Colorado Springs Police Department.
At around 1:15 a.m., officers received reports of a shooting at an apartment complex in the 6900 block of Alpine Currant View.
According to police, the woman who reported the shooting told authorities she had been about to be attacked by a man she had met, so she shot him. |

Police say they’re investigating a stabbing that took place Wednesday night in south Tulsa as self-defense.
According to the Tulsa Police Department, a man was hitting a home near 63rd and Peoria with a stick and looking into the window.
Police said the teen then went out to investigate and the suspect hit him with a stick.
According to police, the teen defended himself with a kitchen knife and stabbed the suspect multiple times, including in the chest.
Police said the suspect was later taken to the hospital and is now in critical but stable condition. |

The future of one of the toughest gun control laws in the nation could be determined within the next couple of months.
Lawyers this week finished making their arguments in the state trial surrounding Measure 114, which voters narrowly passed in November.
Harney County Circuit Court Judge Robert S. Raschio, who put the implementation of the measure on hold while the court case advanced, will have 60 days to decide whether the measure violates the state constitution and if it should ever go into effect. |

New York state’s rule requiring background checks for ammunition purchases will be scrutinized by the U.S. Supreme Court.
On Tuesday, Justice Clarence Thomas granted a request for an emergency conference of the court to evaluate the new regulations.
The law now requires background checks on all ammo purchases and the payment of a $2.50 fee.
In response, Governor Kathy Hochul criticized Justice Thomas and said his decision is an attempt to placate conservative big donors.
Republican lawmakers who represent parts of the tri-county region are applauding Thomas. |

I enjoy disparate interests. I teach Second Amendment law, and teach and write a treatise on advertising law. I was surprised that two of my legal interests coincided when Illinois House Bill 218 was signed into law by the Illinois Gov, J.B. Pritzker.
H.B. 218 is an omnibus gun safety law, and one of its prohibitions is the advertising of a gun in a way that may support, recommend or encourage a person under 18 to unlawfully purchase, possess or use a firearm in Illinois. In addition to the vagueness of this criminal statute, it has First Amendment problems. Maybe Second Amendment issues, too. |

California has a gun and ammo tax now that Gov. Gavin Newsom signed several new gun control measures. One piece of legislation, California SB2, bans the carrying of firearms in most public places within the state. Another measure, AB 28, doubles the tax on guns and ammunition purchased in California. Senate Bill 2 by Senator Anthony Portantino’s (D–Burbank), which is California’s response bill to New York Rifle and Pistol Association v. Bruen, was signed into law Tuesday. SB 2 enacts numerous “sensitive locations” where guns are banned, and changes requirements to obtain a concealed carry license. SB 2 was also sponsored by Gov. Gavin Newsom and Attorney General Rob Bonta, and simply put illegally imposes restrictions on those seeking a California Concealed Carry Weapons (CCW) permit.
Notably, Newsom, Bonta and Portantino know they are imposing restrictions to those applying for CCWs, when virtually no crimes are committed by CCW holders, who are required to pass background checks by County Sheriffs, and take gun safety courses. |

To us, the jury’s verdicts resolved this case as fairly as possible, holding the Staffords accountable for going too far in their self-defense, while recognizing their natural response to defend themselves.
We wonder how any of us would respond to the Liming group’s actions, especially in a time where random shootings with real guns are far too common and “Stand Your Ground” is part of our laws. We’re grateful the outcome was not even worse.
With eight of 12 jurors against convicting Deshawn Stafford of involuntary manslaughter, we don’t see what would be gained by prosecutors seeking a second trial on that lone charge. His life is already forever changed with a felony conviction. |

Far-left Democrats have long pushed for overreaching and unconstitutional gun control legislation. Frustrated with the Second Amendment to the United States Constitution, California’s Democrat Governor Gavin Newsom is proposing a constitutional amendment that would effectively repeal the right to keep and bear arms.
Newsom’s 28th amendment petition has many hoops to jump through before becoming a reality. This would need to be approved by 2/3rds of both houses of Congress and then be ratified by 3/4ths of state legislatures. |

Another major gun rights dispute is coming to the justices as they are poised to decide whether a 1994 federal law that bars people under domestic violence restraining orders from possessing firearms violates the U.S. Constitution's Second Amendment. President Joe Biden's administration appealed a lower court's ruling that the law ran afoul of the Second Amendment's "right to keep and bear arms" because it fell outside "our nation's historical tradition of firearm regulation." A challenge to the law was filed by a Texas man charged with illegal gun possession while subject to a domestic violence restraining order after assaulting his girlfriend. The outcomes of several lawsuits aiming to broaden where gun owners can carry their weapons could hinge on how the US Supreme Court decides an upcoming case about the rights of domestic abusers.
The high court in June agreed to hear the case of Zackey Rahimi, who argues his Second Amendment rights were violated by a law that prohibits an individual under a domestic violence restraining order from owning a firearm.
