MO: Why the Eighth Circuit’s Invalidation of Missouri’s “Second Amendment Preservation Act,” While Possibly Correct as to Result, Was Premised on Inadequate Reasoning

But was this reasoning persuasive? For starters, note that the Eighth Circuit used “means” in a way that focused not on the mechanism by which Missouri withdrew support—which was simply a bland provision removing state-law authorization to assist—but on the fact that Missouri’s decision to withdraw support was seemingly grounded on its legislative assertion in SAPA that federal enactments were “invalid to” the State. In other words, the Eighth Circuit found wanting Missouri’s decision to enact a law embodying a statement of invalidity and then withdraw support on that premise.

The brief, filed in the U.S. Court of Appeals for the Seventh Circuit, urges the court to uphold a March decision from the Northern District of Illinois that affirmed Cook County’s regulation of assault weapons as consistent with the Second Amendment.

Two years ago in New York State Rifle & Pistol Association v. Bruen, the U.S. Supreme Court upheld the constitutional right to carry guns in public for self-defense. But in Illinois, people with concealed-carry permits are committing a misdemeanor if they bring their handguns with them when they use public transportation. Among other locations, that ban covers all Metra commuter trains in the Chicago area, all of the buses and trains operated by the Chicago Transit Authority (CTA), and all facilities, including parking lots, associated with them. Last Friday, a federal judge deemed those restrictions unconstitutional as applied to four permit holders.

Logan said Saturdayʻs shooting is still under investigation and detectives are interviewing witnesses, reviewing and authenticating videos and testing evidence. He added that the community needs to say something if they see something as officials try to address violence on Oahu’s West side.

Logan said the investigation into whether self-defense was justified in Saturday’s shooting in Waianae is still ongoing. The 42-year-old who allegedly shot and killed the man who had rammed a front loader into his home and shot three women is no longer in custody.

“Since this border opened up, we’re getting new people that never owned guns coming in and buying them,” Humphreys said.

“Getting a lot of women that never owned a gun before coming in and buying them,” he added, noting that many of these female customers are purchasing firearms for personal safety and self-defense purposes.

Illinois’ 2013 concealed carry law limited license holders from carrying weapons into certain places, such as government buildings, stadiums, hospitals, or public transportation.

In his ruling, Johnston said the defendants, including Illinois Attorney General Kwame Raoul, Cook County State’s Attorney Kim Foxx, and DuPage County State’s Attorney Robert Berlin, “failed to meet their burden to show an American tradition of firearm regulation at the time of the Founding that would allow Illinois to prohibit Plaintiffs — who hold concealed carry permits — from carrying concealed handguns for self-defense onto the CTA and Metra.”

The U.S. Supreme Court in New York State Rifle & Pistol Asssoc. v. Bruen instructed lower courts how to decide right to arms issues: "In keeping with Heller, we hold that when the Second Amendment's plain text covers an individual's conduct, the Constitution presumptively protects that conduct." If so, "the government must demonstrate that the regulation is consistent with this Nation's historical tradition of firearm regulation." This Post describes how some lower courts are evading Bruen by contrivances that claim particular regulations do not involve "the Second Amendment's plain text."

The Second Amendment grants me the right to collect an arsenal of firearms, but I am equally free to not have a Glock tucked under my pillow.

When the governed are denied rights, this freedom to make a choice evaporates.

Prior to Dobbs v. Jackson, women had the right to both seek an abortion or choose not to if they were opposed to the idea. By striking down Roe v. Wade the Supreme Court diminished everyone’s rights. Those who seek to strip away freedom rather than celebrate it, let me ask you this.

There has never been a better time to be a citizen journalist. The corporate media lost all credibility – followed by its audience – and the tools now available for independent news gatherers have never been better or more powerful.

All legacy media platforms have been hit hard economically – TV, print, radio and digital. Their advertising revenue has plummeted, and they’re laying off staffers while holding focus groups to understand why their audience left, and where they went.

IT ONLY TOOK A DAY after a new 11-percent tax on gun sales went into effect on July 1 for gun rights advocates to sue the state of California.

In the suit, filed in San Diego County Superior Court by the National Rifle Association, Second Amendment Foundation and others, the advocates state Assembly Bill 28, signed by Gov. Gavin Newsom in 2023, violates the Second Amendment and will force dealers to pass the costs of the tax down to the consumer.

Assembly Bill 28, known as the Gun Violence Prevention and School Safety Act, was authored by Assemblymember Jesse Gabriel, D-Encino, and Assemblymember Kevin McCarty, D-Sacramento.

Sorrell argued that it’s not just a bad idea, but would also go against recent decisions by the Supreme Court.

“It is my belief that any restriction on 18 to 21-year-olds obtaining a pistol permit in Alabama is unconstitutional, would be overturned by a federal appeals court, and ultimately by the United State Supreme Court,” he said. “And I believe Alabama’s current law which restricts 18-year-olds from carrying a pistol, from obtaining a pistol permit, is also unconstitutional.”

Sorrell pointed out that other states that have passed constitutional carry laws have not seen an increase in crime.

Vice President Kamala Harris has yet to define much of her policy agenda for voters to scrutinize. Much of that is being left to proxies. So far, she has indicated a continued march toward more unconstitutional gun control. She’s yet to actually deny that she would abandon her previous policy agenda of forced confiscation of Modern Sporting Rifles (MSRs). The only “denial” that’s been made purports to come from an unnamed campaign staffer. This election, though, will be a referendum on the future of the U.S. Supreme Court.

 QUOTES TO REMEMBER
The gun-control movement is driven by raw emotion. Facts are irrelevant. Logic is spurned. Utter nonsense is solemnly intoned. It's little wonder that our most emotive president has made gun control his signature domestic issue. — Don Feder
