"Shift the burden" is misleading. The entire purpose of the law was to establish a hearing that imposes upon the authorities the burden to show why an individual should be charged. The SCOF turned the law on its head. The proper reference would be "restore the burden" to follow the intent of the original law.
It shouldn't even be necessary, because the law's original purpose is self-evident, and the SCOF issued a shamelessly political ruling.
