Judicial activism is alive and flourishing on the Florida Supreme Court, and the victim of this activism is the Second Amendment and our fundamental right of self-defense.
On Thursday, July 9, 2015, liberals on the Florida Supreme Court issued an opinion in a self-defense case that clearly has a chilling effect on the constitutional right of self-defense and the immunity from prosecution for exercising self-defense provided by the Legislature in the “Castle Doctrine/Stand Your Ground” law.
The presumption of innocence until proven guilty has been turned on its head. Rather than follow the intent of the Legislature, the Court chose to rewrite the law to achieve its own policy goals. |

If this goes to federal court and reaches the SCOTUS, it will be reversed.
The Constitution guarantees due process of law that places the burden of proof on the government AT EVERY STEP. |

QUOTES
TO REMEMBER |
"Secrecy is the keystone of all tyranny. Not force, but secrecy ... censorship. When any government, or any church, for that matter, undertakes to say to it's subjects, 'This you may not read, this you must not see, this you are forbidden to know,' the end result is tyranny and oppression, no matter how holy the motives. Mighty little force is needed to control a man whose mind has been hoodwinked; contrariwise, no amount of force can control a free man, a man whose mind is free. No, not the rack, not fission bombs, not anything. You cannot conquer a free man; the most you can do is kill him." --Robert A. Heinlein, "Revolt in 2100" (Pg. 68-69, Baen Books paperback edition, 1999 printing) |
