The St. Paul man arrested in connection with a shooting at a Fourth of July fireworks gathering was released from custody Friday.
Jarrell Ray Kirk, 27, was arrested Thursday on suspicion of assault at a gathering on St. Paul’s West Side, according to officials. According to a search warrant, Kirk said he was involved in an altercation and that he fired his gun, which he has a permit to carry, after someone fired at him first. Kirk was released Friday afternoon from the Ramsey County Jail pending investigation.
No criminal charges were filed against him. |

The subject's claim that somebody shot at him and he returned fire constituted probable cause for a search warrant???
I'd like to see the probable cause affidavit before I recommend removal of the judge from the bench, but I'd bet money that I now know of better cause for removal than the judge knew when he signed the warrant. |

QUOTES
TO REMEMBER |
Government is not the solution to our problem; government is the problem.... We've been tempted to believe that society has become too complex to be managed by self-rule, that government by an elite group is superior to government for, by, and of the people. Well, if no one among us is capable of government himself, then who among us has the capacity to govern someone else? All of us together, in and out of government, must bear the burden. The solutions we seek must be equitable, with no one group singled out to pay a higher price. — Ronald Reagan |
