This 'law professor's' creds aren't worth the sheepskin they're printed on.
Legislative product, i.e. LAWS, are almost exclusively restrictions on liberty in one form or another. It is not now nor has it ever been in the legislative DNA to worry about protecting individual liberty - legislatures' natural bent is the expansion of government power. The Supreme Court exists precisely to rein in legislative excesses when they unconstitutionally burden fundamental rights and lower courts by rote defer to their acts as presumptively lawful.
Any law professor who doesn't know that (worse, refuses to accept it) should be bagging groceries instead. |
