Newsweek sticks to the meme that polls determine constitutional legitimacy, when the reality is that the Constitution is constructed precisely to foreclose overreach of the 'majority' (through government action) when it ignores or derogates self-evident fundamental rights of which it doesn't approve, that are the load-bearing pillars of our founding.
That's why we have a Bill of Rights - to clearly state that there are bright lines the government cannot cross viz individual liberty, regardless of whether or not the 'majority' approves. |
