Under US law, chasing down the guy who just tried to murder you after you gain control of the murder weapon is murder.
Under Mickey's law, if you put me on a jury, I'm finding him not guilty by reason of the attempted murderer needing to be dead before he tries to kill again.
Under Chinese law?
