An appellate court has thrown out the manslaughter conviction of a Deerpark man who fatally shot a fugitive wanted on rape charges in 2013.
David Carlson was indicted on a murder charge, and convicted after trial of first-degree manslaughter in the Oct. 11, 2013 shooting of Norris Acosta-Sanchez. He and his lawyer argued that he acted in self-defense.
The decision issued Wednesday by the Appellate Division, Second Department of state Supreme Court throws out the November 2016 trial verdict and grants Carlson a new trial on the manslaughter charge. |

If a cop had shot the fugitive, they would have decorated him for it.
They just don't like the competition, I guess. |
