But the even sadder truth is that, ever since the originalist intellectual project began in earnest in the early 1980s with the advent of the Federalist Society and the Reagan-era nomination of Antonin Scalia to the Court, the originalist project has been generally failing. There have undoubtedly been doctrinal victories — 1995's U.S. v. Lopez on the Commerce Clause, 2008's D.C. v. Heller on the Second Amendment, and 2010's Citizens United v. F.E.C. on the First Amendment all come to mind — but those victories have been more than overwhelmed by doctrinal losses and the generally lethargic and balkanized nature of the broader originalist project.

“Restricting access to high-capacity magazines for guns frequently used in mass shootings is not only reasonable – it is common sense.”

Except that those who use them in mass shootings will not honor the restrictions, and the result is, EXCLUSIVELY, an egregious infringement of peaceable citizens' right to bear arms suitable for use in a militia.

This philosophy of controlling criminal use of otherwise lawful arms is facially flawed. Criminals don't obey laws - ANY laws. Peaceable people do obey laws.

This magazine ban does not affect criminals, it directly affects ONLY peaceable, law-abiding citizens.

The people of California must pay better attention to what the Democrats are doing to their liberty - AND VOTE FOR REPUBLICANS.
